MUNICIPAL PLANNING COMMISSION
March 9, 2023
The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held
in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday,
March 9 commencing at 10:03 a.m.
A notice was posted at the front entrance advising the public of the meeting.

The Chairman called the meeting to order at 10:03 a.m.

3. MINUTES
P-09/23 MOVED BY COUNCILLOR NEIL JOHNSON that the minutes of the February 9, 2023
Municipal Planning Commission meeting be adopted as presented.

The Chairman called for post agenda items.
5. ADOPTION OF AGENDA
P-10/23 MOVED BY COUNCILLOR ARNO DOERKSEN that the agenda be adopted as
presented.

6. DEVELOPMENT REPORT
The Supervisor of Planning and Development presented the Development Report. This
item was accepted as information.
7. SUBDIVISIONS
7.1 Subdivision 2023-0-001 To subdivide an approximate 9.12 acre parcel from
the NE 27-23-16-W4 containing an existing farmstead for residential
purposes.
The Supervisor of Planning and Development provided background on proposed
subdivision. The applicant has been in contact with EID and there is a letter on file
allowing access to the remaining parcel via EID right of way. The Supervisor of Planning
and Development explained that the current septic disposal is a pump out which does
not meet required setbacks. The Supervisor of Planning and Development outlined the
options which were either adding a condition requiring the installation of a septic field
and removing the, pump out or a slight boundary change to increase the setbacks
allowing for the pump out to remain as constructed. The Supervisor of Planning and
Development responded to further questions, discussion followed.
P-11/23 MOVED BY COUNCILLOR ARNO DOERKSEN that the MPC approve, with
conditions, the subdivision of an approximate 3.692-hectare (9.12-acre) parcel from the
NE 27-23-16-W4 containing an existing farmstead, for residential purposes, for the
following reasons:

1. The proposed subdivision is consistent with the South Saskatchewan Regional Plan
and complies with the County of Newell Municipal Development Plan, and the Land Use
Bylaw.
2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the
purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision
and Development Regulations.
Conditions:
1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding
property taxes shall be paid to the County of Newell.
2. That MPC grant a variance to the Land Use Bylaw for the existing house that is 5
meters closer to the road than required.
3. That the applicant provides professional confirmation the current PSDS meets the
Alberta Private Sewage Systems Standard.
4. That, pursuant to Section 655(1)(b) of the Municipal Government Act, the applicant
enter into a Development Agreement with the County of Newell which shall be registered
concurrently with the final plan against the title(s) being created.
5. That the applicant supplies copies of any utility right of way plans, easements, and/or
agreements which are to be registered as a requirement for any affected utilities to the
County prior to the subdivision's registration with Alberta Land Titles.
Reserve:
Municipal Reserve is not applicable as per MGA 663 (a), one lot is created from a
quarter section of land.

7.2 Subdivision 2023-0-002 To reconfigure Plan 8810087, Block 1 to allow for
improved irrigation methods on the agricultural parcel known as NW 32-16-
13-W4.
The Supervisor of Planning and Development provided background information on
proposed subdivision application. There was an opportunity for questions. There were
no questions.
P-12/23 MOVED BY COUNCILLOR GREG SKRIVER That the MPC, approve, with
conditions, the boundary line adjustment of Plan 8810087, Block 1 (CoT 221285697)
and the NW 32-16-13-W4 (CoT 141326103), for the following reasons:

A question period was held. No County ratepayers were in attendance. The moderator
indicated that there were no questions from the public.

Being that the agenda matters have been concluded the meeting adjourned at 10:30
a. m.
