MUNICIPAL PLANNING COMMISSION
April 20, 2023
The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held
in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, April
20, 2023 commencing at 10:00 a.m.
A notice was posted at the front entrance advising the public of the meeting.

1. CALL TO ORDER
The Chairman called the meeting to order at 10:00 a.m.

3. MINUTES
P-18/23 MOVED BY COUNCILLOR LYNETTE KOPP that the minutes of the April 6, 2023,
Municipal Planning Commission meeting be adopted as presented.

4. CALL FOR POST AGENDA ITEMS
The Chairman called for post agenda items. There were no post agenda items.
5. ADOPTION OF AGENDA
P-19/23 MOVED BY COUNCILLOR AMANDA PHILPOTT that the agenda be adopted as
presented.

Councillor H. Johnson declared a pecuniary interest and left the meeting at 10:03 a.m.
6. SUBDIVISIONS
6.1 Subdivision 2023-0-003 to subdivide Plan 9811171, Block 1, Lot 2 into 2
parcels, approximately 35 hectares (86.7 acres) and 64.7 hectares (160
acres) in size.
The Supervisor of Planning and Development provided background information
on the proposed subdivision application. Discussion followed as to how this will
impact access for the adjacent landowner. The Supervisor of Planning
Development indicated that the adjacent landowner currently has access via
easement and this subdivision will have no affect on access to the adjacent
landowners.
P-20/23 MOVED BY COUNCILLOR NEIL JOHNSON That the Municipal Planning Commission
approve, with conditions, the agricultural subdivision of Plan 9811171, Block 1, Lot 2
into 2 parcels, approximately 35 hectares (86.7 acres) and 64.7 hectares (160 acres) in
size, for the following reasons:
1. The proposed subdivision is consistent with the South Saskatchewan Regional Plan
and complies with the County of Newell Municipal Development Plan, and the Land
Use Bylaw.
2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for
the purpose for which the subdivision is intended pursuant to Section 7 of the
Subdivision and Development Regulations
Conditions to be Considered:
1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding
property taxes shall be paid to the County of Newell.
2. That, pursuant to Section 655(1)(b) of the Municipal Government Act, the applicant
enter into a Development Agreement with the County of Newell which shall be
registered concurrently with the final plan against the title(s) being created.

3. That the applicant supplies copies of any utility right of way plans, easements,
and/or agreements which are to be registered as a requirement for any affected
utilities to the County prior to the subdivision's registration with Alberta Land Titles.
4. To satisfy Section 19 of the Subdivision and Development Regulation, a 30-metre
service road shall be dedicated by way of caveat on the title of the property.
Reserve:
The proposed subdivision complies with Section 663(b) of the Municipal Government
Act, that the created parcels are 16.0 hectares (± 40 acres) or more and are to be used
only for agriculture purposes, therefore Municipal Reserve is not required.

6.2 Subdivision 2023-0-004 to subdivide Plan 2111763, Block 5, Lot 27 into 2
parcels, approximately 0.126 hectares (0.311 acres) and 0.176 hectares
(0.435 acres) in size.
Supervisor of Planning provided background information and responded to
questions from MPC.
P-21/23 MOVED BY COUNCILLOR GREG SKRIVER That the Municipal Planning Commission
approve, with conditions, the residential subdivision of Plan 2111763, Block 5, Lot 27
(CoT 211 222 898) into 2 parcels, approximately 0.126 hectares (0.311 acres) and 0.176
hectares (0.435 acres) in size, for the following reasons:
The proposed subdivision is consistent with the South Saskatchewan Regional Plan
and complies with the County of Newell Municipal Development Plan, and the Land
Use Bylaw.
2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for
the purpose for which the subdivision is intended pursuant to Section 7 of the

Municipal Reserve is not applicable as it was taken at the time of subdivision 04 NL 007.

7. DEVELOPMENT PERMITS
7.1 DP 2023016 - Block X, Plan 2123FB, SE 6-15-13 W4M - Existing
campground and addition with a variance to the requirements for not
allowing year-round storage.
The Development Officer provided background information on the proposed
permit application. MPC was given the opportunity to ask questions. The Chief
Administrative Officer responded to questions regarding "squatter's rights, "
indicating that these have been abolished in Alberta. After much discussion
on liability to the organization and landowner to provide year round storage of
R. V.'s, MPC denied the variance request and added a condition that the
R. V.'s must be removed when the campground is not in operation. Mr. Hemsing
was present and responded to questions.
P-22/23 MOVED BY COUNCILLOR HOLLY JOHNSON That the Municipal Planning
Commission APPROVE Development Permit 20123016 for the operation of a 27 site
campground and the addition of 8 more campsites and a variance to the requirement of
the construction of an interior road to each campsite on the parcel, on lands legally
described as Block X, Plan 2123FB, SE 6-15-13-W4. This development approval is
subject to the conditions outlined below.
DP 2023016 is Approved for the following reasons:
The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable for
the purpose for which it is intended under the Special, Parks and Public Services
District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses
and Activities as specified in the County of Newell Land Use Bylaw 2016-21.
3. No objections have been received from adjacent landowners or referral agencies
with respect to the proposed development.
Conditions of the approval:
a) This approval is effective as of May 10, 2023 (21-day appeal period).
b) The development must be located as shown on the site plan approved with the
application and submitted March 17, 2023. It must be built according to the
description provided with this approval. Any changes shall require the written
approval of the Development Authority.
c) The applicant/owner must obtain all construction permits applicable to development
and is responsible to ensure all permits are closed with work complying to the
building code.
d) That all R.Ws must be removed from the campground when not in operation.

e) Any additional development shall require prior approval of a separate permit
application.
f) That the property is not used for conducting a business or commercial operation
without first obtaining the required permits.

11. QUESTION PERIOD
A question period was held.
M. Benci requested an update on the proposed animal control bylaw. This question will
be addressed during Question Period at the Council meeting of April 20, 2023.

a.m.
