HomeMy WebLinkAbout2023-12-21 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION December 21, 2023 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, December 21, 2023 commencing at 10:00 a.m. A notice was posted at the front entrance advising the public of the meeting. MINUTES 3.1 Minutes - Municipal Planning Commission (December 7, 2023) P-71/23 MOVED BY COUNCILLOR LYNETTE KOPP that the minutes of the December 7, 2023 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. There were no post agenda items. 5. ADOPTION OF AGENDA P-72/23 MOVED BY COUNCILLOR ADENA SKANDERUP that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS 6.1 DP 2023078 -Approval of an existing industrial business, specifically a transport company and the existing use of a manure storage facility. The Development Officer provided background information on this item to MPC. MPC was given the opportunity to ask questions. The applicant, G. Petrie, was present to answer questions and spoke in favour of the application and provided details regarding the manure pit operations. The Natural Resources Conservation Board (NRCB) suggestions have not yet been reviewed by the applicant. The applicant is willing to try and mitigate the flies and odor. The trailers used to transport that manure are sealed and only filled halfway to prevent spillage. Memos have been sent to all the truckers outlining efforts to reduce noise pollution. There are three residences within proximity of the manure pit. The applicant indicated that he has received complaints with regards to the road use but not the manure pit. J. Charlton, an adjacent landowner, spoke in opposition to the application expressing concerns with the noise pollution and odors associated with the 24 hour operation. The Supervisor of Planning and Development provided a history of planning, zoning, and subdivision of the parcel. In 2014 the NRCB advised the County of Newell that the amount of manure is below the threshold of their permitting requirements. MPC questioned who or what quantifies an increase in business intensity. The Supervisor of Planning and Development responded that when the land use changes the county should be engaged and decide if the use remains consistent with the regulations in the land use bylaw. Discussions with business owners can indicate an increase in business intensity or when there are complaints due to a business changing or intensifying over time. Municipal Planning Commission December 21, 2023 P-73/23 MOVED BY COUNCILLOR LYNETTE KOPP that the Municipal Planning Commission APPROVE Development Permit 2023078 for the existing industrial business, specifically a transport company. The approval of a temporary permit for the use of the existing manure storage pit, to be reviewed 12 months from the date of approval, after consultation between applicant and NRCB, on lands legally described as Lot 1, Block 7, Plan 1710461, NW 4-19-14-W4. This development approval is subject to the conditions outlined below. DP 2023078 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Industrial General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 3. Adjacent landowners and referral agencies have been notified and have the opportunity to submit comments. Any comments or concerns should be received by the County administration by December 14, 2023. Conditions of the approval: a) This approval is effective as of January 10, 2024 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted November 15, 2023. c) That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes, and standards. d) Any additional development shall require prior approval of a separate permit application. e) That access can be provided for Emergency Services vehicles to both buildings. f) That the manure storage facility does not exceed capacity and is emptied a minimum of once per week and manure is hauled offsite at that time.
