COUNTY OF NEWELL
MUNICIPAL PLANNING COMMISSION
MARCH 28, 2024
The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held
in the County Office at Brooks, AB and livestreamed to the public on Thursday, March 28, 2024
commencing at 10:00 a.m.
A notice was posted at the front entrance advising the public of the meeting.

3. MINUTES
3.1 Minutes - Municipal Planning Commission (March 14, 2024)
P-05/24 MOVED BY COUNCILLOR HOLLY JOHNSON that the minutes of the March 14, 2024
Municipal Planning Commission meeting be adopted as presented.

The Chair called for post agenda items. There were no post agenda items.
5. ADOPTION OF AGENDA
P-06/24 MOVED BY COUNCILLOR AMANDA PHILPOTT that the agenda be adopted as
presented.

6. SUBDIVISIONS
6.1 Subdivision 2023-0-013 To subdivide two lots, 3.68 acres and 2.59 acres in
size from the agriculture parcei, each containing an existing residence.
The Supervisor of Planning and Development provided background information on
the proposed subdivision application. MPC was given the opportunity to ask
questions.
MPC inquired about how an encroachment agreement would be useful. The
Planning and Development Supervisor responded that an encroachment
agreement would be registered on the title of the newly created parcel and the
remnant parcel, so that future landowners would know about the existing
encroachment and be protected. MPC inquired about approving a subdivision with
buildings that do not meet the requirements in the Land Use Bylaw. The Planning
and Development Supervisor responded that those structures would become legal
nonconforming, and they can be used as is until such time as the landowner would
like to change or add to them. If potential buyers request a letter of compliance
prior to purchase, they would be made aware of this.
P-07/24 MOVED BY COUNCILLOR GREG SKRIVER That the MPC approve, with conditions,
the subdivision of two parcels from the SE 7-20-14W4M, one being 3.68 acres and the
other 2.59 acres in size for residential purposes for the following reasons:
1. The proposed subdivision is consistent with the South Saskatchewan Regional
Plan and complies with the County of Newell Municipal Development Plan, and
the Land Use Bylaw. , ` ,

2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for
the purpose for which the subdivision is intended pursuant to Section 7 of the
Subdivision and Development Regulations.
Conditions of approval:
1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all
outstanding property taxes shall be paid to the County of Newell.
2. That, pursuant to Section 655(1)(b) of the Municipal Government Act, the
applicant enters into a Development Agreement with the County of Newell which
shall be registered concurrently with the final plan against the title(s) being
created.
3. That the applicant supplies copies of any utility right of way plans, easements,
and/or agreements which are to be registered as a requirement for any affected
utilities to the County prior to the subdivision's registration with Alberta Land
Titles.
4. That the Land Use Amendment be approved by Council, changing the zoning of
the proposed Lot 5, Block 7 from Agriculture, General District, to Residential,
Rural District, prior to the finalization of the subdivision.
5. That the encroachment of the shelter on Lot 4, Block 7 be addressed by either
removal, or by registering an encroachment agreement on the title of proposed
Lot 4, Block 7 and the remnant parcel.
6. That the encroachment of the pivot on Lot 5, Block 7 be addressed by the
registering of an encroachment agreement on the title of proposed Lot 5, Block 7
and the remnant parcel.
Reserve:
The 10% municipal reserve requirement, pursuant to Section 666 and Section 667 of the
Municipal Government Act, be provided as money to be paid in place of land on the 2.59
acres, as per policy POL-010-23 with the determined land value of $10,500/acre. Money
in place of land would be approximately $2,719.50 (10% of 2.59 acres X$10,500 acre)
with the actual acreage and amount to be determined once the final subdivision plan has
been submitted.

7.1 DEVELOPMENT PERMITS
7.1 DP 2024010 - Construction of a single family dwelling with an attached
garage.
The Development Officer provided background information on this item to MPC.
MPC inquired as to the approach - fhere is not an approach currently but there is
an approach agreement in place.

APPROVE Development Permit 2024010 for the construction of a 218 m2 (2350 ft2)

described as NE 22-20-14-W4. This development approval is subject to the conditions
outlined below.
DP 2024010 is Approved for the following reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable
for the purpose for which it is intended under the Agriculture General Park District
(Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and
Activities as specified in the County of Newell Land Use Bylaw 2016-21.
3. Adjacent landowners and referral agencies have been notified and have the
opportunity to comment. Any comments or concerns should be received by the
County administration by March 21, 2024.
Conditions of the approval:
a) This approval is effective as ofApril 17, 2024 (21-day appeal period).
b) The development must be located as shown on the site plan approved with the
application and submitted February 23, 2024. It must be built according to the
description provided with this approval. Any changes shall require the written
approval of the Development Authority.
c) That the proposed development complies with all Federal, Provincial and
Municipal statutes, regulations, codes and standards.
d) The applicant/owner must obtain all construction permits applicable to
development and is responsible to ensure all permits are closed with work
complying to the building code.
e) Any additional development shall require prior approval of a separate permit
application.
fl That the property is not used for conducting a business or commercial operation
without first obtaining the required permits.
g) That the following setbacks are maintained for this development:
Front (east): 30 m (100 ft)
Side (north): 30 m (100 ft)
Side (south): 6 m (20 ft)
Rear (east): 6 m (20 ft)
h) That the applicant must install a temporary rural address sign at the road
approach to the site as soon as construction starts. The sign must display the
rural address as assigned by the County in the letter that will be mailed to the
applicant after the permit has been approved. No other address may be
displayed on the site. The sign must remain in place and in full view until it is
replaced by a County of Newell issued rural address sign.
i) Construction must commence before April 17, 2025 and be compete before April
17, 2026.
