MUNICIPAL PLANNING COMMISSION
May 9, 2024
The regular Municipal Planning Commission (MPC) Meeting of the County of Newell
was held in the County Office at Brooks, AB and livestrearned to the public on Thursday,
May 9, 2024 commencing at 10:00 a.m.
A notice was posted at the front entrance advising the public of the meeting.

3. MINUTES
3.1 Minutes - Municipal Planning Commission (April 25, 2024)
P-19/24 MOVED BY COUNCILLOR GREG SKRIVER that the minutes of the April 25,
2024 Municipal Planning Commission meeting be adopted as presented.

5. ADOPTION OF AGENDA

6. DEVELOPMENT REPORT
The Development Officer presented the Development Report and this item was
accepted as information.
7. DEVELOPMENT PERMITS
7.1 DP 2024008 - Construction and operation of an off -grid cabin
experience business similar to a campground
The Development Officer provided background information on this item to
MPC. MPC had the opportunity to ask questions. Landowner Kersey
Daniels was available to answer questions. She confirmed that there will
be an 11 pm quiet time in their operating policy. MPC questioned the safety
precautions for children and privacy for neighbors. Landowner advised that
200 new trees have recently been planted for privacy. Individual cabins will
not have cooking appliances installed, there will be a communal kitchen and
fire area. MPC inquired as to whether they would consider accommodating
private travel trailers. The applicant responded that having vacation trailers
on the property is not an attraction to them currently, this is more of a
"glamping" industry project. The Development Officer indicated that the
permit is for 3 cabins only. If the landowners wanted to intensify their
business at a later date, a new development permit would be required. The
Applicant indicated that solar panels will be on the roof of the three cabins.
They have spoken to local farmers and producers, health and safety
inspectors and neighbors. MPC inquired as to a fire plan and the landowner
responded that several dead trees will be cleaned out and each cabin will

have a fire extinguisher. The acreage is a 5 acre parcel with a variety of
trees, (cottonwood, willow and poplar). MPC questioned if there have been
other permits issued for a similar use in the County, and what the setbacks
were for solar installations. The Supervisor of Planning and Development
indicated that this is a unique permit request however both the cabins and
solar panels meet the setbacks in the district in the land use bylaw.
P-21/24 MOVED BY COUNCILLOR GREG SKRIVER that the Municipal Planning
Commission APPROVE Development Permit 2024008 for the construction and
seasonal operation of an off -grid cabin experience similar to a campground, on
lands legally described as Lot 1, Block 4, Plan 1111177, NW 7-20-13-W4. This
development approval is subject to the conditions outlined below.
DP 2024008 is APRROVED for the following reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is
suitable for the purpose for which it is intended under the Agriculture General
District (Schedule 2) Section 3, General Regulations and Section 4, Specific
Uses and Activities as specified in the County of Newell Land Use Bylaw
2016-21.
Conditions of approval:
a) This approval is effective as of May 29, 2024 (21-day appeal period).
b) The development must be located as shown on the site plan approved with
the application and submitted February 27, 2024. It must be built according to
the description provided with this approval. Any changes shall require the
written approval of the Development Authority.
c) That the proposed development complies with all Federal, Provincial and
Municipal statutes, regulations, codes, and standards.
d) The applicant/owner must obtain all construction permits applicable to
development and is responsible to ensure all permits are closed with work
complying to the building code.
e) Any additional development or intensification of the use shall require prior
approval of a separate permit application.
f) Section 4.15 of Land Use Bylaw 2016-21 states that moved in buildings shall
require a security deposit of $5000.00 to ensure that the conditions of the
development permit are met. This deposit will be refunded when the County
inspection agency submits the report stating that all work complies with
Alberta Safety Codes requirements.

7.2 DP 2024017 - Intensification of use, Agricultural Academy
The Development Officer provided background information on this
item. The animals will be managed by the school and the committee. The
number of animals indicated on the development permit are within the
animal control bylaw.
MOVED BY COUNCILLOR NEIL JOHNSON that the Municipal Planning
Commission APPROVE Development Permit 2024017 for the following
developments on lands legally described as Block Y, Plan 2123FB, SE 6-15-13
W4:
• existing 2511 m2 (27023 ft2) school,
• existing 3.3 m2 (36 ft2) accessory building used as a shed,
• existing 12 m2 (128 ft2) accessory building used as a greenhouse,
• installation of a 30 m2 (320 ft2) shipping container and
• construction of a 223 m2 (2400 ft2) accessory building to be used as a barn.
This development approval is subject to the conditions outlined below.
DP 2024017 is APPROVED for the following reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is
suitable for the purpose for which it is intended under the Special, Parks and
Public Services District (Schedule 2) Section 3, General Regulations and
Section 4, Specific Uses and Activities as specified in the County of Newell
Land Use Bylaw 2016-21.
Conditions of approval:
a) This approval is effective as of May 29, 2024 (21-day appeal period).
b) The development must be located as shown on the site plan approved with
the application and submitted March 11, 2024. It must be built according to
the description provided with this approval. Any changes shall require the
written approval of the Development Authority.

c) The applicant/owner must obtain all construction permits applicable to
development and is responsible to ensure all permits are closed with work
complying to the building code.
d) That the proposed development complies with all Federal, Provincial and
Municipal statutes, regulations, codes, and standards.
e) Any additional development shall require prior approval of a separate permit
application.
f) That the applicants adhere to the Animal Control Bylaw.
