HomeMy WebLinkAbout2024-05-23 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICPAL PLANNING COMMISSION May 23, 2024 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, May 23, 2024 commencing at 10:00 a.m. A notice was posted at the front entrance advising the public of the meeting. Wagner, DP 2024044 L. Wagner, DP 2024044 1. CALL TO ORDER The Chair called the meeting to order at 10:00 a.m. 2. EXCUSED FROM MEETING All members were in attendance at this meeting. MINUTES 3.1 Minutes - Municipal Planning Commission (May 9, 2024) P-23/24 MOVED BY COUNCILLOR HOLLY JOHNSON that the minutes of the May 9, 2024 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. There were no post agenda items. 5. ADOPTION OF AGENDA P-24/24 MOVED BY COUNCILLOR AMANDA PHILPOTT that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS 6.1 DP 2024044 - Installation of a manufactured home with deck The Development Clerk provided details on this development permit and MPC had the opportunity to ask questions. P-25/24 MOVED BY COUNCILLOR HOLLY JOHNSON that the Municipal Planning Commission APPROVE Development Permit 2024044 for the installation of a 113 m2 (1216 ft2) manufactured dwelling with a 46 m2 (500 ft2) deck for residential use, on lands legally described as Lot 2, Block 1, Plan 7811389, NE 19-15-15-4. This development approval is subject to the conditions outlined below. DP 2024044 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Residential Hamlet District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. 3. Adjacent landowners and referral agencies have been notified and have had the opportunity to comment. Any comments or concerns should be received by the County administration by May 17, 2024 2 V Municipal Planning Commission May 23, 2024 Conditions of approval: a) All Federal, Provincial and Municipal statutes, regulations, codes, and standards. b) The provisions pertaining to the Hamlet Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 2016-21. c) This development approval is effective on June 12, 2024. The approved development must be located as shown on the site plan and must be built according to the description provided with this approval. Any changes to that plan or description shall require the written approval of the Development Authority. d) The applicant/owner must obtain all Alberta Safety Code permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. e) That any dwelling/structure is not located on any right of way or easement on the parcel. f) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. g) That the following minimum setbacks on all sides are maintained for this development: Front (west) 6 m (20 ft) Side (north & south) 1.5 m (5 ft) Rear (east) 6 m (20 ft) h) That the applicant submits the $5000 security deposit as specified in Section 4.15 Moved -in Buildings in the Land Use Bylaw 2016-21, to be returned when the Alberta Building Code permits have been approved and closed. i) That the dwelling is connected to the County of Newell potable water and sanitary servicing. j) That the dwelling does not exceed 5 m in height. k) That the dwelling has CSA certification. 1) That the dwelling be placed on a foundation, skirted within 30 days of siting to the satisfaction of the Development Authority and all axles, wheels and trailer hitches removed. rn) That the developer must start construction before June 12, 2025. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. The Development shall be completed before June 12, 2026. MOTION CARRIED Municipal Planning Commission May 23, 2024 7. OTHER BUSINESS There were no other business items to discuss at this meeting. 8. POST AGENDA ITEMS There were no post agenda items to discuss at this meeting. 9. IN CAMERA There were no in camera items to discuss at this meeting. 10. QUESTION PERIOD A question period was held. No County ratepayers were in attendance. The moderator indicated that there were no questions from the public. 11.
