HomeMy WebLinkAbout2024-10-10 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION OCTOBER 10, 2024 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, October 10, 2024 commencing at 10:00 a.m. A notice was posted at the front entrance advising the public of the meeting. EXCUSED FROM MEETING P-38/24 MOVED BY COUNCILLOR AMANDA PHILPOTT that Councillor K. Christman and Councillor N. Johnson be excused from the meeting. MINUTES 3.1 Minutes - Municipal Planning Commission (September 5, 2024) P-39/24 MOVED BY COUNCILLOR LYNETTE KOPP that the minutes of the September 5, 2024 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. There were no post agenda items. 5. ADOPTION OF AGENDA P-40/24 MOVED BY COUNCILLOR GREG SKRIVER that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Officer presented the Development Report and responded to questions from Council. P-41/24 MOVED BY COUNCILLOR ADENA SKANDERUP that this item be accepted as information. MOTION CARRIED 7. DEVELOPMENT PERMITS 7.1 DP 2024074 - Operation of an Agriculture Processing business The Development Officer provided background on this development permit and MPC was given the opportunity to ask questions. This permit was reviewed by the Bassano IDP prior to the MPC meeting. Landowner was available to answer questions and further describe his project. Discussion followed. MPC noted that any intensification would require a new permit. 1 z Municipal Planning Commission October 10, 2024 P-42/24 MOVED BY COUNCILLOR DAN SHORT that the Municipal Planning Commission APPROVE Development Permit 2024074, with the addition of the IDP committee, for the approval of an Agriculture (Processing) operation, specifically six grain bins and a scale, on lands legally described as SE 20-21-18- W4. This development approval is subject to the conditions outlined below. DP 2024074 is APPROVED for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. 3. Adjacent landowners and referral agencies have been notified and have opportunity to comment. Conditions of approval: 1. This approval is effective as of October 30, 2024 (21-day appeal period). The development must be located as shown on the site plan approved with the application and submitted August 20, 2024. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. 2. That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. That an Alberta Transportation approval is submitted to the County of Newell prior to development. 4. The applicant/owner must obtain all construction permits applicable to development and is responsible to ensure a►I permits are closed with work complying to the building code. 5. Any additional development or intensification shall require prior approval of a separate permit application, including but not limited to additional agricultural buildings or an increase in the number of vehicles attending the business. 6. That the applicant install proper waste containment systems to manage all waste and control vegetation to ensure cleanliness of the property and maintain proper aesthetics as per the County of Newell & Town of Bassano Intermunicipal Development Plan. 7. That the applicant enters into a Development Agreement with the County of Newell for improvements to the approach. 8. That the applicant installs a hard packed gravel foundation on all the usable area. � Municipal Planning Commission October 10, 2024 9. That the following setbacks are maintained for this development: Front (east): 30 m (100 ft) Side (north & south): 6 m (20ft) Rear (west): 6 m (20ft) 10. The applicant obtains guidance from Alberta Health Services to ensure the proposed setback of the development will not impact the flight path of the hospital Helipad. 11. That the applicant provides a designated parking area for the trucks that would include barriers to identify the parking area for the trucks. MOTION CARRIED LEFT THE MEETING J. Gill left at the meeting at 10:13 a.m. 7.2 DP 2024080 - Approval for existing bunkhouse The Development Officer provided background on this development permit and MPC was given the opportunity to ask questions. Landowner was available to answer questions. P-43/24 MOVED BY REEVE ARNO DOERKSEN that the Municipal Planning Commission APPROVE Development Permit 2024080 for the approval of an existing 138 mz (1490 ft2) bunkhouse, on lands legally described as Lot 1, Block 3, Plan 2110490, SW 21-21-18-W4. This development approval is subject to the conditions outlined below. DP 2024080 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture Generat District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. Adjacent landowners and referral agencies have been notified and have the opportunity to comment. Conditions of approval: 1. This approval is effective as of October 30, 2024 (21-day appeal period). 2. The development must be located as shown on the site plan approved with the application and submitted September 3, 2024. That the building does not have cooking facilities as stated in the definition of a bunkhouse in the glossary of the Land Use Bylaw and is not to be used as a dwelling. 6. Any additional development shall require prior approval of a separate permit application. 7. That the property is not used for conducting a business or commercial operation without first obtaining the required permits. 8. That the following setbacks are maintained for this development: Front (west): As per Alberta Transportation Side (north & south): 6m (20 ft) MOTION CARRIED LEFT THE MEETING K. Douglass and S. Douglass left the meeting at 10:16 a.m. 8. SUBDIVISIONS 8.1 2024-0-002 - To subdivide one lot, 11.235 hectares (27.76 acres) in size from the agriculture parcel, containing an existing residence and pastureland. The Supervisor of Planning and Development provided background information on this item. MPC was given the opportunity to ask questions. Supervisor of Planning and Development recommended adding a condition for a septic system inspection to ensure it meets the Alberta Safety Code standard. MPC questioned the shape of the proposed parcel and indicated that straight lines were preferred. The applicant indicated that the proposed shape was to allow access to the pivot point, while keeping pastureland and irrigated farmland on separate parcels. Discussion was had regarding municipal reserve. The landowner indicated they would prefer to defer the Municipal Reserve Payment to the future. P-44/24 MOVED BY COUNCILLOR ELLEN UNRUH that the MPC approve, with conditions, the subdivision of one lot, 11.235 hectares (27.76 acres) in size from the agriculture parcel, for residential and agriculture purposes, for the following reasons: C Municipal Planning Commission October 10, 2024 The proposed subdivision is consistent with the South Saskatchewan Regional Plan and complies with the County of Newell Municipal Development Plan, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions of Approval: 1. That, pursuant to Section 654(1)(d) of the Municipal GovernmentAct, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. 3. That the Land Use Amendment Bylaw 2082-24 be approved by Council, changing the zoning of Plan 1112945, Block 1, Lot 1 in the SW 26-21-16W4M from Agriculture, General District to Residential, Rural District, prior to the finalization of the subdivision. 4. That the applicant provide proof that the current PSDS system meets the Alberta Private Sewage Systems Standard (2015). Reserve: The 10% Municipal Reserve requirement, pursuant to Section 666 and 669 of the Municipal Government Act, be deferred by caveat on the newly created parcel with the actual acreage to be determined at the time of finalization. Watson left meeting at 10:40 am 8.2 2024-0-003 - To subdivide one lot, 1.887 hectares (4.66 acres) in size from the agriculture parcel, containing an existing residence. The Supervisor of Planning and Development provided background information on this item. MPC was given the opportunity to ask questions. 1 Municipal Pianning Commission October 10, 2024 P-45/24 MOVED BY COUNCILLOR AMANDA PHILPOTT that the MPC approve, with conditions, the subdivision of one lot, 1.887 hectares (4.66 acres) in size from the agriculture parcel located in the SW 23-14-14W4M, for residential purposes, for the following reasons: 1. The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions of Approval: 1. That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. 3. That the encroachment of the dugout be addressed by either removal, or by registering an encroachment agreement on the titles of the proposed subdivision and the remnant parcel. 4. That the applicant provide proof that the current PSDS system meets the Alberta Private Sewage Systems Standard (2015). Reserve: Municipal reserve will not be applicable as per Section 663(a) of the MGA, that one lot is to be created from a quarter section of land. MOTION CARRIED 8.3 2024-0-004 - To subdivide one lot, 7.045 hectares (17.41 acres) in size from the agriculture parcel, containing an existing residence The Supervisor of Planning and Development provided background information on this item. MPC was given the opportunity to ask questions. P-46/24 MOVED BY REEVE ARNO DOERKSEN that the MPC approve, with conditions, the subdivision of one lot, 7.045 hectares (17.41 acres) in size from the agriculture parcel, containing an existing residence in size from the � Municipal Planning Commission October 10, 2024 agriculture parcel located in the NE 28-21-19W4M, for residential purposes, for the following reasons: 1. The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions of Approval 1. That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. 3. That, pursuant to Section 655(1)(b) of the MGA, the applicant enters into a Development Agreement with the County which shall be registered concurrently with the final plan against the title(s) being created. 4. That the applicant provide proof that the current PSDS system meets the Alberta Private Sewage Systems Standard (2015). Reserve: Municipal reserve will not be applicable as per Section 663(a) of the MGA, that one lot is to be created from a quarter section of land. MOTION CARRIED 9.
