HomeMy WebLinkAbout2025-01-16 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION January 16, 2025 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, January 16, 2025 commencing at 10:00 a.m. A notice was posted at the front entrance advising the public of the meeting. Stanway, Brooks Bulletin ATTENDANCE: 1 CALL TO ORDER The Chair called the meeting to order at 10: 00 a. m. 2. EXCUSED FROM MEETING All members were in attendance at this meeting. MINUTES P-01/25 MOVED BY COUNCILLOR LYNETTE KOPP that the minutes of the December 19, 2024 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. 5. ADOPTION OF AGENDA P-02/25 MOVED BY COUNCILLOR DAN SHORT that the agenda be adopted as presented. MOTION CARRIED ARRIVED AT THE MEETING G. Tiffin arrived at the meeting at 10:03 a.m. LEFT THE MEETING G. Tiffin left the meeting at 10:06 a.m. 6. SUBDIVISIONS 6.1 Subdivision 2024-0-007 To subdivide a 3.20-acre parcel from the NW 14-21-17 W4M containing an existing farmstead. The Supervisor of Planning and Development provided background information on this item and responded to questions from MPC. MPC had a question about one of the structures on the remnant parcel. The Planning and Development Supervisor indicated that the structure in question has been removed. The Supervisor of Planning and Development advised that the gas co-op condition is standard for a property that will now potentially have two separate owners, therefore requiring two separate meters. MPC questioned whether the existing abandoned home should be removed. The Supervisor of Planning and Development responded that the abandoned home does not need to be removed at this time and it is considered legal nonconforming because it was constructed prior to a land use bylaw being established. P-03/25 MOVED BY COUNCILLOR LYNETTE KOPP that the MPC approve, with conditions, the residential subdivision of one lot, 1.294-hectares (3.20 acres) in Municipal Planning Commission January 16, 2025 size from the NW 14-21-17W4M containing an existing farmstead, for the following reasons: The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions of Approval: That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. 3. That any conditions of Pioneer Gas be satisfied prior to finalization. 4. That, pursuant to Section 655(1)(b) of the MGA, the applicant enters into a Development Agreement with the County which shall be registered concurrently with the final plan against the title(s) being created. Harbicht arrived at the meeting at 10:13 a.m. 6.2 SUBDIVISION 2024-0-010 To subdivide out a 10.33-acre parcel containing two dwellings, a shop, barn, and several sheds The Supervisor of Planning and Development provided background information on this item and responded to questions from MPC. MPC requested clarification and further details regarding the deferred caveat option for municipal reserve. The Supervisor of Planning and Development explained that a caveat would be placed on title and any further subdivision would generate the municipal reserve requirement. The Supervisor of Planning and Development explained further regarding the policy of taking money in place of land or deferring the requirement. MPC inquired as to the Alberta Transportation variance. The Supervisor of Planning and Development explained the requirements ofAlberta Transportation. Municipal Planning Commission January 16, 2025 P-04/25 MOVED BY COUNCILLOR GREG SKRIVER that the MPC approve, with conditions, the subdivision of one residential lot, containing 4.182 hectares (10.33 acres) in size from the agriculture parcel, for the following reasons: The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions of Approval: That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. 3. That the applicant provide proof that the current PSDS system meets the Alberta Private Sewage Systems Standard prior to the finalization of the subdivision. 4. That, pursuant to Section 655(1)(b) of the MGA, the applicant enters into a Development Agreement with the County which shall be registered concurrently with the final plan against the title(s) being created. Reserve: That money in place of land be provided as per POL-010-23 at an amount of $10,846.50 (10% of $10,500/acre x 10.33 acres) MOTION CARRIED 7. OTHER BUSINESS There were no other business items to discuss at this meeting. 8. POST AGENDA ITEMS There were no post agenda items to discuss at this meeting. 9. No County ratepayers were in attendance. The moderator indicated that there were no questions from the public. 11.
