HomeMy WebLinkAbout2025-03-06 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION March 6, 2025 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, March 6, 2025 commencing at 10:00 a.m. A notice was posted at the front entrance advising the public of the meeting. CALL TO ORDER The Chair called the meeting to order at 10:00 a.m. � Municipal Planning Commission March 6, 2025 2. EXCUSED FROM MEETING All members were in attendance at this meeting. 3. MINUTES P-14/25 MOVED BY COUNCILLOR ADENA SKANDERUP that the minutes of the March 6, 2025 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED ARRIVED AT MEETING Mark Harbicht arrived at 10:02 a.m. 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. 5. ADOPTION OF AGENDA P-15/25 MOVED BY COUNCILLOR LYNETTE KOPP that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Officer presented the Development Report and there were no questions from MPC. This item was accepted as information. 7. SUBDIVISIONS 7.1 SUBDIVISION 2025-0-001 To subdivide an approximate 125.5-acre parcel from the E'/2 1-18-18W4M for agriculture purposes and to allow for the sale of the remnant parcel to the adjacent landowner. The Planning and Development Supervisor provided background information on this item and responded to questions from MPC. Nathan Fontaine from the Eastern Irrigation District was available to answer questions. He explained that the EID is going to be purchasing the remnant parcel of land from Bow City Colony. The Planning and Development Supervisor explained historical resources and environmentally significant areas. P-16/25 MOVED BY COUNCILLOR NEIL JOHNSON that the MPC approve, with conditions, the subdivision of an approximate 125.5-acre parcel from the E%z 1-18-18W4M for agriculture purposes for the following reasons: �(/ Municipal Planning Commission March 6, 2025 The proposed subdivision is consistent with the South Saskatchewan Regional Plan and complies with the County of Newell Municipal Development Plan, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions of Approval: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. 2. That, pursuant to Section 655(1)(b) of the Municipal Government Act, the applicant enters into a Development Agreement with the County of Newell which shall be registered concurrently with the final plan against the title(s) being created. 3. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. Reserve: Municipal reserve is not applicable, as the proposed subdivision meets the provisions of Section 663 (b) of the MGA, that the land to be subdivided into lots of 16.0 hectares or more and is to be used only for agriculture purposes. MOTION CARRIED 7.2 SUBDIVISION 2025-0-002 To subdivide an approximate 92.1-acre parcel from the E'/2 36-17-18W4M for agriculture purposes and to allow for the sale of the remnant parcel to the adjacent landowner. The Planning and Development Supervisor provided background information on this item and there were no new questions from MPC. P-17/25 MOVED BY COUNCILLOR DAN SHORT that the MPC approve, with conditions, the subdivision of an approximate 92.1-acre parcel from the E'h 36-17-18W4M for agriculture purposes for the following reasons: The proposed subdivision is consistent with the South Saskatchewan Regional Plan and complies with the County of Newell Municipal Development Plan, and the Land Use Bylaw. 2. DEVELOPMENT PERMITS 8.1 DP 2025007 - Installation of a ground mount solar array The Development Officer provided background on this development permit and MPC was given the opportunity to ask questions. Solar company representative, Matthew Horvath, was available to answer questions. Matthew explained the timing of the project to be between 6- 12 months. The farmer would not be required to disconnect from three phase power. Matthew explained further technical operating details. P-18/25 MOVED BY Ellen Unruh that the Municipal Planning Commission APPROVE Development Permit 2025007 for the installation of a 175.5 m2 ground mount solar array on lands legally described as SE 03-21-16-W4. This development approval is subject to the conditions outlined below. DP 2025007 is Approved for the following reasons: The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities, as specified in the County of Newell Land Use Bylaw 2016-21. � Municipal Planning Commission March 6, 2025 2. The proposed development complies with the Municipal Development Plan. a) Section 3.1 — The integration of alternative energy facilities in appropriate settings is encouraged. 3. Adjacent landowners and referral agencies have been notified and had the opportunity to comment. Conditions of Approval: This approval is effective as of March 26, 2025 (21-day appeal period). 2. The development complies with provisions pertaining to the Agriculture- General District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 2016-21. 3. The development must be located as shown on the site plan approved with the application and submitted February 4, 2025. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. 4. That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes, and standards. 5. That no structures be located on a right of way or easement on the parcel. 6. That the property is not used for conducting a business or commercial operation without first obtaining the required permits. 7. Any additional development or intensification shall require prior approval of a separate permit application. MOTION CARRIED 8.2 DP 2025008 - Installation of a ground mount solar array The Development Officer provided background on this development permit and MPC was given the opportunity to ask questions. There were no new questions. P-19/25 MOVED BY COUNCILLOR GREG SKRIVER that the Municipal Planning Commission APPROVE Development Permit 2025008 for the installation of a 129 m2 ground mount solar array on lands legally described as NE 28-21-16-W4. This development approval is subject to the conditions outlined below. DP 2025008 is Approved for the following reasons: The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture - � Municipal Planning Commission March 6, 2025 General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities, as specified in the County of Newell Land Use Bylaw 2016-21. 2.
