HomeMy WebLinkAbout2025-04-10 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION April 10, 2025 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, April 10, 2025 commencing at 10:01 a.m. A notice was posted at the front entrance advising the public of the meeting. CALL TO ORDER The Chair called the meeting to order at 10:01 a.m. 2. EXCUSED FROM MEETING P-24/25 MOVED BY COUNCILLOR ELLEN UNRUH that Councillor H. Johnson be excused from the meeting. MOTION CARRIED Municipal Planning Commission April 10, 2025 3. MINUTES P-26/25 MOVED BY COUNCILLOR LYNETTE KOPP that the minutes of the March 20, 2025 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. There were no post agenda items to discuss. 5. ADOPTION OF AGENDA P-26/26 MOVED BY COUNCILLOR ADENA SKANDERUP that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS 6.1 DP 2025018 - Construction of a Single -Family Dwelling with an internal secondary suite to be used as a second dwelling. The Development Officer provided background on this development permit and MPC was given the opportunity to ask questions. Landowner was present to answer any questions. The cottage that was permitted as a bed and breakfast will continue to be used as a residence. MPC inquired as to the policy of removing dwellings. Development Officer advised that the County Assessor informs Planning and Development when he does his physical inspections on the status of the buildings. P-27/26 MOVED BY REEVE ARNO DOERKSEN that the Municipal Planning Commission APPROVE Development Permit 2025018 for the construction of a 223 m2 (2400 ft2) dwelling (single detached) which would include a 93 m2 (1000 ft2) secondary suite (internal) on lands legally described as SE 29-20-14-W4. This development approval is subject to the conditions outlined below. DP 2025018 is Approved for the following reasons: The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Any comments or concerns from adjacent landowners and referral agencies should be received by April 4, 2025. Should no concerns be raised administration recommends approval. Conditions of Approval 1. This approval is effective as of April 30, 2025 (21-day appeal period). The development complies with provisions pertaining to the Agriculture General District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #2016-21. 3. The development must be located as shown on the site plan approved with the application and submitted March 4, 2025. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. 4. That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 5. That the following setbacks on all sides are maintained for this development: Front (east): as approved by Alberta Transportation Side (south): 30 m (100 ft) Rear (west): 6 m (20 ft) Side (north): 6 m (20 ft) 6. That the existing residence must be removed upon occupancy of the new dwelling, not later than twenty-four (24) months from the date of the permit approval. 7. Wetlands are identified in the provincial wetland database. It is the developer's responsibility to ensure the development meets all applicable legislation and all permits from provincial or federal bodies are obtained. 8. That no structures be located on a right of way or easement on the parcel. 9. Any additional development or intensification shall require prior approval of a separate permit application. 10. That the developer must start construction before April 30, 2026 and be completed by April 30, 2027. MOTION CARRIED LEFT MEETING K. Ramer left meeting at 10:09 a.m. 6.2 DP 2025020 - Construction of an addition to be used as a mudroom for the single-family dwelling. The Development Officer provided background on this development permit and MPC had no questions. P-28125 MOVED BY COUNCILLOR GREG SKRIVER that the Municipal Planning Commission APPROVE Development Permit 2025020 for the construction of a 20.4 m2 (220 ft2) addition to the dwelling on lands legally described as Block 9, Plan 7510619, NE 8-19-14-W4. This development approval is subject to the conditions outlined below. DP 2025020 is Approved for the following reasons: The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Industrial General District Page 3 of 7 Municipal Planning Commission April 10, 2025 (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Any comments or concerns from adjacent landowners and referral agencies should be received by April 4, 2025. Should no concerns be raised administration recommends approval. Conditions of Approval: 1. This approval is effective as of April 30, 2025 (21-day appeal period). 2. The development complies with provisions pertaining to the Industrial General District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #2016-21. 3. The development must be located as shown on the site plan approved with the application and submitted March 12, 2025. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. 4. That the following setbacks on all sides are maintained for this development: Front (north): 30 m (100 ft) Side (east):3 m (10 ft) 6. That the height of the structure doesn't exceed 20 m. 7. That no structures be located on a right of way or easement on the parcel. 8. Any additional development or intensification shall require prior approval of a separate permit application. 9. SUBDIVISIONS 8.1 Subdivision 2025-0-003 - To subdivide 2 parcels from the public utility lot, one 0.074 hectares (± 0.18 acre) parcel and one 0.228 hectares (0.56 acres). The Planning and Development Supervisor provided background information on this item and responded to questions from MPC. This subdivision has been an administrative consolidation project and not a request generated by adjacent landowners. P-30/25 MOVED BY COUNCILLOR DAN SHORT that the MPC approve, with conditions, the subdivision of Plan 7910924 Block 15 Lot 1 PUL, into 2 parcels, one 0.074 hectares (± 0.18 acre) parcel and one 0.228 hectares (0.56 acres) for the following reasons: The proposed subdivision is consistent with the South Saskatchewan Regional Plan and complies with the County of Newell Municipal Development Plan, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions of Approval That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. Reserve: The proposed subdivision complies with Section 663(c) of the Municipal Government Act, being the land to be subdivided is 0.8 hectares or less, therefore Municipal Reserve in not required. MOTION CARRIED 8.2 Subdivision 2025-0-004 -To subdivide a 7.812 hectare (19.31 acre) parcel from the SW 15-20-14-W4, containing a farmstead and a waste management storage site. The Planning and Development Supervisor provided background information on this item and responded to questions from MPC. Landowner provided additional information on the shape of the subdivision along with irrigation practices and how the yard was set up. MPC questioned location of dugout and whether it' proximity to the road is an issue. The applicant indicated the dugout is used for yard irrigation and water for hydrovac trucks. P-31/25 MOVED BY COUNCILLOR ELLEN UNRUH that the MPC approve, with conditions, the subdivision of one lot, 7.812 hectare (19.31 acre) in size from the SW 15-20-14-W4, containing a farmstead and a waste management storage site for the following reasons: Page 5 of 7 Municipal Planning Commission April 10, 2025 The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions to be Considered: That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. 3. That, pursuant to Section 655(1)(b) of the MGA, the applicant enters into a Development Agreement with the County which shall be registered concurrently with the final plan against the title(s) being created. Grosfield left meeting at 10:33 a.m. 8.3 Subdivision 2025-0-005 - To subdivide a 36.48-hectare (90.14 acre) parcel containing the irrigated farmland from the remainder of the property. The Planning and Development Supervisor provided background information on this item and there were no questions from MPC. P-32/26 MOVED BY COUCNILLOR LYNETTE KOPP that the MPC approve, with conditions, the subdivision of one 36.48-hectare (90.14 acre) in size in the NE 18-21-15-W4, for agriculture purposes, for the following reasons: The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions of Approval: 1. That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. That, pursuant to Section 655(1)(b) of the MGA, the applicant enters into a Development Agreement with the County which shall be registered concurrently with the final plan against the title(s) being created. 4. That an easement for legal access across the SE 18-21-15-W4 for the benefit of the newly created parcel be established. A copy of the signed easement agreement is required by the Subdivision Authority prior to finalization of the subdivision. Reserve: Municipal reserve is not applicable as per MGA Section 663 (b) land to be subdivided into lots of 16.0 hectares or more and is to be used only for agricultural purposes. MOTION CARRIED 9.
