Bowen P. Hoffman 2. Minutes 1) Council Minutes -May 20, 1999 Minutes of the May20'h, 1999 meeting were presented. Moved by Councillor Fabian that we adopt these minutes as circulated. Carried. 3. Call for Post Agenda Items The Reeve called for post agenda items. Arrived at Meeting Councillor Berg arrived at the meeting at 10:03 a.m. June 3, 1999 Page 113 4. Adoption of Agenda Moved by Councillor Berg that we adopt the agenda as amended. Carried. 5. Correspondence 1. Municipal Affairs - Intermunic~al Dispute Resolution A letter from Municipal Affairs, with regard to a new Intermunicipal Dispute Resolution Initiative, was presented to Council as information. Office of the Premier -Surcharge on Tires A letter from the Office of the Premier, in reply to our letter regarding the surcharge on tires, was presented to Council as information. 3. Rolling Hills Fire Department -Investigation Costs A letter from the Rolling Hills Fire Department, with regard to fire investigations and their cost, was presented to Council. Moved by Councillor Loewen that communication be made with the Rolling Hills Fire Department explaining to them that they are responsible for the cost of tire investigations and that, in most cases, the property owner's insurance company will cover this cost. Carried. ~^ 7 Other Business f~ 1. CPR - Rosema /r~Gem Moved by Councillor Berg that we, once again, reaffirm our decision to have the Right-of--Way involved in the Rosemary/Gem CPR Line dispersal consolidated back into the quarter sections they came from. Invitation to Meet with Ed Stelmach, Minister of Agriculture An invitation from the Brooks Campus Progressive Conservative Club to meet with Ed Stelmach, Minister of Agriculture, was presented to Council. Moved by Councillor Harbinson that the Councillors wishing to attend this meeting do so on an individual basis and be responsible for. all costs associated with this meeting. Carried. 2. Siun on Old # 1 Highway -Town of Brooks Councillor Fabian had a question with regard to signage on the Old # 1 Highway. This item was referred to the Municipal Meeting. ,~-~ June 3, 1999 Page IIS 9. Committee Reports MPC Councillor Baksa gave this report. The Planner, G. Shaw was in attendance for this report. 1. Street Signs for Hamlets and Subdivisions The Planner gave an update on this item. 2. Bylaw 1289-99 -Greenwald Inlet Area Structure Plan ~. ~, Moved by Councillor Baksa that Bylaw 1289-99, being a bylaw to adopt the Greenwald Inlet Area Structure Plan, receive first reading. Carried. Moved by Councillor Baksa that the Developer of the Greenwald [nlet be informed that he is required, by Council, to hold an Information Meeting in this area on the Greenwald Inlet development prior to the County of Newell holding their public hearing. Carried. 3. 99 NL 15 - Pt. SW 31-16-15-W4 & Plan 9110006, Block 1, Lot 2 -Division 4 Hallman Donald & Anne/Schulz Bernhard & Rosel - Agricultural Subdivision Moved by Councillor Stobbs that we approve this subdivision subject to the applicant entering into an agreement with the County of Newell for the improvement of any required approaches; subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water and easements; subject to the applicant providing any required easements for franchise utilities; and subject to the applicant consolidating Parcel A with Plan 9110006, Block 1, Lot 2 and consolidating Parcel B with the SE 31-16-15-W4. Carried. June 3, 1999 Page 1 16 ,_ 4. 99 NL 16 -Plan 8310515, Block 1, Lots 9 & 10 -Division 10 Wells Ranching Company Ltd. -Industrial Subdivision Moved by Councillor Baksa that we approve this subdivision subject to the applicant entering into an agreement with the County of Newell for the installation of any required accesses for the proposed and remnant parcels; subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water and easements; and subject to the applicant providing any required easements for franchise utilities. Carried. 5. 99 NL 17 - W %2 7-18-14-W4 and NW & NE 6-18-14-W4 Greenwald Inlet -Residential Subdivision -Division 5 F-~ Moved by Councillor Baksa that we approve this subdivision subject to the Area Structure Plan being adapted; subject to the developer entering into a development agreement with the County of Newell for the construction of internal roads, intersection treatments, municipal reserve, pedestrian linkages, approaches and ~ utilities; subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water and easements; subject to the developer providing any required easements for franchise utilities and paying all costs associated with the installation, modification or relocation of existing services; subject ''~ to the applicant forming a resident's association for the maintenance of utilities and municipal reserve land within the development; subject to the applicant being responsible for preparing a drainage plan for the development prior to the endorsement of the subdivision mylar by the County that is acceptable to the County, the Eastern [rrigation District and Alberta Environmental Protection; subject to the developer being responsible for ensuring that the water quality within Lake Newell Reservoir does not deteriorate as a result of this proposed development; subject to the Eastern Irrigation District holding title to the lands from the shoreline to 30 m inland to ensure public access to this area; and subject to the developer being responsible for providing an adequate supply of water and treatment of sewage for this development. Carried. Moved by Councillor Loewen that an Area Structure Plan encompassing the entire development in the N '/z-7-18-14-W4, NE & NW 6-18-14-W4, Section 1-18-15-W4 and Pt. Gail & Don Cox -Renke Meadows Gail & Don Cox, representing Renke Meadows, were in attendance to ask Council to consider a reduction in their taxes. Committee Reports (cont'd) Workshop Session 1. County Property Appraisal Moved by Councillor Baksa that we tender for an appraisal of all County owned ~j property within the Town of Brooks and that the appraisal be funded with monies from reserves. Carried. 2. Subdivision & Development Appeal Board Administration was directed to obtain a legal opinion with regard to whether or not we have the authority by bylaw to request a Councillor to leave a meeting because of his position on an Appeal Board. B~aw # 1288-99 (2"d and 3~~ Reading Moved by Councillor Berg that Bylaw 1288-99, being a bylaw to amend Land Use Bylaw # 1004-90 as follows, receive second reading. r-~. " Section 6 -Definitions (add) Semi-detached dwelling "means a building designed and built to contain two side by side dwelling units, separated from each other by walls extending from foundation to roof and not attached to any other residential building". Section 56 (amend) the purpose of this district is to provide for low density residential development in the form of single family dwellings and semi-detached dwellings. Section 56.2 (amend) Home Occupation Moved-in Buildings, excluding Mobile Homes Park & Recreation Facilities Public &Quasi-Public Facilities & Uses Other uses of a similar nature as approved by the Municipal Planning Commission Semi-detached dwellings Section 56.7 (add) Semi-detached dwellings require the review of the Hamlet Advisory Committee prior to consideration by the Municipal Planning Commission. This type of housing must be new construction and substantially completed on-site. No renovations to existing residences or moved-in buildings to convert them to asemi-detached dwelling shall be permitted. The building design shall be satisfactory to the Approving Authority and complement the hamlet setting. ~-- Carried. CPR -Bassano/Empress Rail Line Moved by Councillor Loewen that we send a letter to Canadian Pacific Railway stating that, at this time, we would like to purchase only that portion of the Bassano/Empress Rail Line that is located within the County of Newell and the Village of Rosemary ~'"'~ from Bassano, East to the East Boundary of the West''/Z of Sec 10-20-13-W4; subject to all costs being borne by the individual property owners involved; where possible, all land being consolidated back into the quarter it was taken from; and that the County receive a commitment from the adjacent landowners to purchase all the land not required by the County. Carried. Salary Ne Jot~~, Committee Moved by Councillor Harbinson that we approve the salary increase for the Gravel and Dust Abatement Foreman as recommended by the Salary Negotiating Committee. Carried. Moved by Councillor Harbinson that we adopt the recommendation of the Salary Negotiating Committee for salary ranges for County of Newell staff with these ranges to be reviewed annually in the fall commencing in 1999. Carried. Dele atg ions (cont'd) 2. Brian Godwin -Emerson Brid eg mark Brian Godwin was in attendance to present to Council a proposal for operating Emerson Bridge Park. Moved by Councillor Baksa that we offer Brian Godwin a one year contract for the operation of Emerson Bridge Park for the balance of 1999 and negotiate with him a tive year contract with a five year option for renewal. Councillor Loewen requested a recorded vote. Business from Minutes (cont'd) 9-9 Newell Regional Solid Waste Management -Chan eg_to Agreement (cont'd} r- Moved by Councillor Douglass that, because the County of Newell is the only rural municipality in the Newell Regional Landfill Agreement and as rural residents generate a different type of waste, we feel we must protect the County ratepayers with regard to waste hauled to the Regional Landfill. Therefore, we would like the proposed agreement between the County of Newell and the Newell Regional Solid Waste Management Authority Limited approved at the next Regional Landfill Meeting. If the NRSWMAL is not prepared to enter into this agreement at this time, we feel that they should begin operation of the landfill immediately under the current agreement and if further changes are necessary, these can be negotiated after the landfill is operating. Carried. Left Meeting Councillor Scheuerman excused himself from the remainder of the meeting at 3:35 p.m. Moved by Councillor Loewen that we approve the proposed agreement between the County of Newell and the NRSWMAL with wording changes as suggested.
