IN THE PROVINCE OF ALBERTA
BYLAW NO. 1858-16
A BYLAW OF THE COUNTY OF NEWELL, IN THE PROVINCE OF ALBERTA, FOR THE
ESTABLISHMENT OF FIRE PROTECTION AREAS WITHIN THE COUNTY OF NEWELL.
WHEREAS Sections 7, 8 and 9 of the Municipal Government Act. R.S.A. 2000 c. M-26 provide
that Council may pass bylaws for the safety, health & welfare of people and the protection of
people and property; and
WHEREAS the Forest and Prairie Protection Act, R.S.A. 2000 c. F-19 grants powers and
responsibilities to the County of Newell; and
WHEREAS the Council of the County of Newell pursuant to the powers and responsibilities
granted to it pursuant to the Municipal Government Act and the Forest and Prairie Protection
Act wishes to provide fire protection within the County of Newell on the terms hereinafter
provided;
NOW THEREFORE, the Council of the County of Newell in Council duly assembled enacts as
follows:
1. This Bylaw may be cited as "the Fire Areas Bylaw".
2. In this Bylaw:
2.1 "Council" shall mean the Council of the County of Newell;
2.2 "County" shall mean the County of Newell;
2.3 "Emergency Services Agreement" shall mean a Council authorized agreement
that establishes the day to day operations of the local fire department for both
capital and operating expenditures via an annual requisition set out in a budget
format submitted to the County prior to September 30 each year.
2.4 "Fire Protection Area" shall mean a geographical area consisting of whole or part
Sections of Townships.
2.5 "Fire Protection Services Agreement' shall mean an agreement for the shared
provision of emergency services that has been formally approved by County
Council and another Municipal Council within the Newell Region;
2.6 "General Municipal Mill Rate" shall mean the rate applied to the various
categories of assessed property within the County to raise sufficient tax revenues
to fund County services;
3. That the following areas be established as Fire Protection Areas:

3.1 Division 1 to be known as Rolling Hills Fire Protection Area consisting of all of
Division 1, except Sections 1 through to and including Section 18 located within
Township 16, in Ranges 11 through to and including Range 14 West of the 4th;
3.2 Division 2 to be known as Tilley Fire Protection Area consisting of all of Division
2, except Sections 25 through to and including Section 36 of Township 17,
Range 14, West of the 4th. and Kinbrook Island Provincial Park boundaries. But
includes Sections 1 through to and including Section 18 located within Township
16, in Ranges 11 through to and including Range 14, West of the 4th;
3.3 Division 3 to be known as Patricia Fire Protection Area consisting of all of
Division 3;
3.4 Division 4 North to be known as Bow City Fire Protection Area consisting of all of
Division 4 except all sections located South of SH 873 and Township Road 16-4;
3.5 Division 4 South to be known as Scandia Fire Protection Area consisting of all of
Division 4 except all sections located North of SH 873 and Township Road 16-4;
3.6 Divisions 5 and 10 to be known as Brooks Fire Protection Area consisting of all of
Division 5 and 10 and also including Sections 25 through to and including
Section 36 of Township 17, Range 14, West of the 4th. and Kinbrook Island
Provincial Park boundaries;
3.7 Division 6 to be known as Bassano Fire Protection Area consisting of all of
Division 6 plus all of Township 23, Range 18, W4th;
3.8 Division 7 to be known as Rosemary Fire Protection Area consisting of all of
Division 7;
3.9 Division 8 to be known as Duchess Fire Protection Area consisting of all of
Division 8;
3.10 Division 9, to be known as Gem Fire Protection Area consisting of all of Division
9, except all of Township 23, Range 18, W4th.
4. That funding required for each of the Fire and Emergency Services Protection Areas be
raised through the General Municipal Mill Rate applied to the combined assessment of
all property throughout the County.
5. That the amount allocated for each Fire Protection Area shall be determined each year
by one of the following methods:
5.1 Via the annual budget process for each Fire Protection Area that falls under the
direct operational control of the County
5.2 A cost shared arrangement provided for in accordance with an approved
Emergency Services Agreement between the County and another Municipality;

6. That emergency services funding paid by the County to a municipality can be used only
for the established budget expenditures set for that Fire Protection Area and in
accordance with a formal Emergency Services Agreement approved by the respective
Councils of the municipalities that are a party to the agreement.
This Bylaw shall come into force and effect on the final day of passing thereof and rescinds
Bylaw 934-87, Bylaw 935-87, Bylaw 936-87, Bylaw 939-87, Bylaw 1081-93, Bylaw 1344-01,
Bylaw 1347-01, Bylaw 1393-02, and Bylaw 1395-02.
