HomeMy WebLinkAbout2020-05-07 Municipal Planning Commission (Regular) MinutesP-29/20 COUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION MEETING May 7, 2020 The regular Municipal Planning Commission Meeting of the County of Newell was held via Lifesize Livestream Video on Thursday, May 7, 2020 commencing at 10:06 a.m. The Chief Administrative Officer, being the Designated Officer for the County of Newell, attended at the County Council Chambers to allow members of the public to watch the livestream meeting proceedings. Notice was posted at the front entrance advising the public of the meeting. No members of the public were physically in attendance. MEMBERS PRESENT: M. Douglass, Reeve C. Amulung, Councillor, M.P.C. MINUTES 3.1 April 23, 2020 Meeting Minutes P-30/20 MOVED BY REEVE MOLLY DOUGLASS that the minutes of the April 23, 2020 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-31/20 MOVED BY COUNCILLOR HUBY KALLEN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Clerk was available to answer questions. Councillor A. M. Philipsen asked fora description for DP 2020017. The Development Clerk replied that it was for an existing manufactured home. Councillor K. Christman noted that DP 2020017 was listed as Division 7 but the location of the property is Division 6. This item was accepted as information. 7. DEVELOPMENT PERMITS 7.1 DP 2020005 Conditions Lot 1, Block 2, Plan 1712141 (NW 19-15-15-W4) - Operation of a Bulk Fertilizer Storage & Sales Business The Development Clerk provided background information on the proposed change. There were no questions. P-32/20 MOVED BY COUNCILLOR LIONEL JUSS That the Municipal Planning Commission amend their motion for approval of DP 2020005 to be approved with the deletion of condition E. MOTION CARRIED 8. LIFT OFF THE TABLE 8.1 Lift Off the Table Item: 2020-0-029 Page 2 of 5 Municipal Planning Commission May 7, 2020 P-33-20 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN that subdivision 2020-0-029 be LIFTED from the Table. MOTION CARRIED 9. SUBDIVISIONS 9.1 2020-0-029 - W1/2 33-21-14-W4M and Parcel B, Plan 5437FC within NE1/4 33-21-14-W4M, To create one new parcel approximately 216.21 acres (87.50 ha) in size, by subdividing a 92.21 acre (37.32 ha) portion from a previously unsubdivided quarter section and consolidating with NW 1/4 33-21-14-W4M (95.50 acres) and Parcel B, Plan 5437 FC (28.50 acres). The County Planner provided background information on the proposed subdivision application. Councillor B. de Jong commented that if the creek changes there could be an issue with having two separate parcels. The County Planner said the cost of surveying the bed and shores of waterbodies can be quite costly. The County Planner added that Alberta Environment did not express any concerns with the parcel layout. Councillor W. Hammergren inquired how access to the residual parcel in the SE corner of the SW quarter would be handled. The County Planner replied that to make the need for physical access clearer, it can be added to the conditions. The Manger of Planning, Development & Engineering commented that there is legal access to all parcels, although the terrain may limit the ability to construct a physical road. The Manager of Planning, Development & Engineering recommended that physical access to the remnant parcel could be granted by easement across adjacent lands that are all currently owned by the applicant. P-34/20 MOVED BY COUNCILLOR BRIAN DE JONG THAT the Agricultural subdivision of W1/2 33-21-14-W4M and Parcel B, Plan 5437FC within NE1/4 33-21- 14-W4M (Certificate of Title No. 127R160, 001 276 659 +4), to create one new parcel approximately 216.21 acres (87.50 ha) in size, by subdividing a 92.21 acre (37.32 ha) portion from a previously unsubdivided quarter section and consolidating with NW'/4 33- 21-14-W4M (95.50 acres) and Parcel B, Plan 5437 FC (28.50 acres); BE APPROVED subject to the following: CONDITIONS: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. 2. That, pursuant to Section 655(1)(b) of the Municipal Government Act, the applicant or owner or both enter into a Development Agreement with the County of Newell which shall be registered concurrently with the final plan against the title(s) being created. 3. That the applicant submit a copy of the Historical Resources Act clearance prior to registration of the plan of subdivision. Page 3 of 5 Municipal Planning Commission May 7, 2020 4. That the subdivided portion of SW % 33-21-14-W4M be consolidated with the adjacent parcels legally known as NW % 33-21-14-W4M and Parcel B, Plan 5437 FC in a manner such that the resulting Certificate of Title could not be subdivided without the approval of the Subdivision Authority. 5. That an easement for legal access across adjacent lands owned by the applicant for the benefit of the residual parcel shall be established. A copy of the signed easement agreement is required by the Subdivision Authority prior to finalization of the subdivision. MOTION CARRIED 9.2 2020-0-050 - Block 1 & 2 Plan 8211674 within N1/216-21-18-W4M, To separate portions of two titles which are fragmented by Highway 1, that lie within both the Town of Bassano and the County of Newell. The County Planner provided background information on the proposed subdivision application. Councillor K. Christman asked why the subdivision application was not presented to the Bassano/County of Newell IDP Committee. Councillor K. Christman also inquired on how access will be provided to the campground. The Manager of Planning, Development & Engineering indicted that as long as the campground remains within the boundaries of the parcel the landowner will have to install a private driveway into the campground. Councillor B. de Jong asked why there hadn't been an IDP meeting for this subdivision application. The Manager of Planning, Development & Engineering explained that the municipalities are trying to handle any discussion by email, but in hindsight, he realized there should have been a meeting with the proper notifications and responses done. Councillor W. Hammergren inquired about access to the campground and if Emergency Services would require the road be built to County standard. The Manager of Planning, Development and Engineering responded that the County does not have a standard for private driveways. The Manager of Planning, Development and Engineering mentioned that the campground is operating under a valid Development permit that was issued in 2002 to use the parcel as a campsite with the number of sites drawn in. He added that the plan show's the access into the campground, which is from the north, across the road from the Esso station. P-36/20 MOVED BY COUNCILLOR KELLY CHRISTMAN THAT the Industrial and Agricultural subdivision of Block 1 and 2, Plan 8211674 within N1/2 16-21-18-W4M (Certificate of Title No. 951 065 313 +1, 951 064 858 +3, 151 103 700), to separate portions of two titles which are fragmented by Highway 1, that lie within both the Town of Bassano and the County of Newell BE APPROVED subject to the following: CONDITIONS: 1. The applicant should contact Alberta Transportation to finalize this condition. 4.
