HomeMy WebLinkAbout2021-04-08 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION MEETING April 8, 2021 The regular Municipal Planning Commission Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, April 8, 2021 commencing at 10:00 a.m. A notice was posted at the front entrance advising the public of the meeting. Hall, Ratepayer The Chairman called the meeting to order at 10:00 a.m. 2. EXCUSED FROM MEETING Councillor H. Kallen had previously informed MPC he would be late due to another commitment. 3. MINUTES 3.1 Minutes - Municipal Planning Commission (March 25, 2021) P-30121 MOVED BY COUNCILLOR BRIAN DE JONG that the minutes of the March 25, 2021 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission April 8, 2021 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. S. ADOPTION OF AGENDA P-31121 MOVED BY COUNCILLOR LIONEL JUSS that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT This item was accepted as information 7. DEVELOPMENT PERMITS 7.1 DP 2021012 - SE 18-21-17 W4M, Change of use to work camp for commercial use to be used annually for the season. The Development Clerk provided background information on the proposed permit application. MPC inquired if a parcel has two separate zoning designations, in this case; Agricultural and Rural Business, does the Rural Business Land Use District support the housing that is being applied for. The Development Clerk indicated that a work -camp is allowed in Rural Business. T. Hall, an adjacent landowner, indicated to MPC that he was concerned with the proposed housing being located on the immediately adjacent property which is not zoned Rural Business. It was confirmed that the application being considered involves the parcel zoned as Rural Business. j P-32121 MOVED BY COUNCILLOR ELLEN UNRUH That the Municipal Planning Commission APPROVE Development Permit 2021012 for the use of a 480 ftz (45 ml) office trailer to be used as housing for temporary seasonal employees, on lands legally described as a 1.16 hectare (2.87 acres) parcel in the SE 18-21-17 W4M. This development approval is subject to the conditions outlined below. DP 2021012 is Approved for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Rural Business District (Schedule 2), as specified in the County of Newell Land Use Bylaw 1892-17. Conditions of Development Approval a) This approval is effective as of April 28, 2021 (21-day appeal period}. b) The development must be located as shown on the site plan approved with the application and submitted February 19, 2021. Page 2 of 4 Municipal Planning Commission April 8, 2021 c) The housing will only be used as temporary housing for seasonal workers between March and October annually. d) The housing will consist of one building utilized by two employees, any intensification of the work camp will require a separate application. e) That refuse and garbage shall be stored in suitable containers. Refuse and garbage holding areas, including containers, shall be effectively screened from public view. f) That Alberta Health Services inspect the housing prior to habitation. g) Any additional development or use shall require prior approval of a separate permit application. The proposed development must comply with: a) The provisions pertaining to the Rural Business District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED 7.2 DP 2021019 - Lot 1, Block 1, Plan 1512382, SE 33-19-14 W4M, Operation of a personal service business. The Development Clerk provided background information on the proposed permit application. There were no questions. LEFT THE MEETING T. Hall left at 10:11 a.m. P-33121 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN That the Municipal Planning Commission APPROVE Home Occupation Permit 2021019 to establish a personal service business, on lands legally described as Lot 1, Block 1, Plan 1512382, SE 33-19- 14 W4M. This development approval is subject to the conditions outlined below. DP 2021019 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), StandArds of Development (Schedule 3) and Home Occupations (Schedule 4 Section 9), as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval a) This approval is effective as of April 28, 2021 (21-day appeal period). b) Any additional development shall require prior approval of a separate permit application. c) Any intensification of the business will require separate approval. d) That the applicant obtain an Alberta Health Service inspection and approval. e) That there are no more than 2 non-resident employees involved in the operation of this business.
