MUNICIPAL PLANNING COMMISSION MEETING
May 6, 2021
The regular Municipal Planning Commission Meeting of the County of Newell was held in the
County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, May 6,
2021 commencing at 10:02 a.m.
A notice was posted at the front entrance advising the public of the meeting. There was one
member of the public physically in attendance.

6. DEVELOPMENT REPORT
The Development Clerk was available to respond to questions.
This item was accepted as information.
7. SUBDIVISIONS
7.1 2021-0-004 - SW 11-21-16W4M, To create one new parcel, approximately 1.996
ha. (4.93 ac.) in size, containing an existing farmstead, from the SW 11-21-
16W4M (Certificate of Title 101 273 988).
The Supervisor of Planning & Development provided background information on
the proposed subdivision application.
MPC asked if there was a specific reason for deferring the Municipal Reserve
(MR). The Supervisor of Planning & Development responded that the department
has discussed how MR should be dealt with and would like to bring a more in-
depth policy to Council in the future. MR has not been dealt with consistently in
the past and a more specific Municipal Reserve policy will help the department
give consistent recommendations in the future. The MGA states that one lot that
is created out of a quarter section is exempt from the MR requirement. This
subdivision is not the first parcel out of the quarter section, but because the
remainder of the SW 11 will be consolidated with the NW 2, and there are no
subdivisions out of the NW 2-21-16W4M, staff recommends that the MR be
deferred to the NW 2-21-16W4M.
P-41121 MOVED BY COUNCILLOR ELLEN UNRUH THAT the Country Residential subdivision
to create one new parcel, approximately 1.996 ha. (4.93 ac.) in size, containing an
existing farmstead from the SW 11-21-16W4M (Certificate of Title 101 273 988) and the
remainder of the parcel to be consolidated with the NW 2-21-16W4M, be approved
subject to the following:
RESERVE:
The 10% reserve requirement, pursuant to Sections 661 and 669 of the Municipal
Government Act, be deferred to the title of the NW 2- 21-16W4M by way of a Deferred
Reserve Caveat in the amount of 1.996 ha. (4.93 ac.)

CONDITIONS:
1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding
property taxes shall be paid to the County of Newell.
2. That the remnant parcel be consolidated in a manner such that the resulting
Certificate of Title could not be subdivided without the approval of the Subdivision
Authority.
3. That, pursuant to Section 655(1)(b) of the Municipal Government Act, the applicant or
owner, or both enter into a Development Agreement with the County of Newell which
shall be registered concurrently with the final plan against the title(s) being created.

8. DEVELOPMENT PERMITS
8.1 DP 2021016 - Lot 3, Block 7, Plan 1211359, NE 29-20-14W4M, Operation of a
Home Occupation 2, specifically a confectionery shop.
The Development Clerk provided background information on the proposed permit
application.
MPC inquired if Alberta Transportation had been notified of the permit
application, due to access being off of Highway 873. The Development Clerk
l responded that Alberta Transportation had been notified and approval was given.

MPC gave the applicant the opportunity to speak.
P-42121 MOVED BY COUNCILLOR BRIAN DE JONG That the Municipal Planning Commission
APPROVE the operation of a Home Occupation 2, specifically a confectionary shop, on
lands legally described as Lot 3, Block 7, Plan 1211359, NE 29-20-14 W4M. This
development approval is subject to the conditions outlined below.
DP 2021016 is Approved for the following reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable for
the purpose for which it is intended under the Acreage Residential District (Schedule
2), Standards of Development (Schedule 3) and Home Occupations (Schedule 4
Section 9), as specified in the County of Newell Land Use Bylaw 1892-17.
Conditions of Development Approval
a) This approval is effective as of May 26, 2021 (21-day appeal period).
b) The development must be located as shown on the site plan approved with the
application and submitted March 1, 2021.
c) That any intensification of use will require re-evaluation of the permit.
d) Any additional development shall require prior approval of a separate permit
application.
e) The applicant/owner must obtain all construction permits applicable to development
and is responsible to ensure all permits are closed with work complying to the
building code.

f) That there are no more than 2 resident employees and up to 2 non-resident
employees involved in the operation of this business.
g) That the applicant obtains all approvals required by Alberta Health service prior to
the operation of the business.
h) That the only advertising being permitted on the property be limited to one sign of 1
mz (12 W).
The proposed development must comply with:
a) The provisions pertaining to the Acreage Residential District and all relevant
schedules, as outlined in the County of Newell Land Use Bylaw 1892-17.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.
