COUNTY OF NEWELL
MUNICIPAL PLANNING COMMISSION MEETING
July 8, 2021
The regular Municipal Planning Commission Meeting of the County of Newell was held in the
County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, July 8,
2021 commencing at 9:59 a.m.
A notice was posted at the front entrance advising the public of the meeting. There were no
members of the public physically in attendance.

MOVED BY REEVE MOLLY DOUGLASS that the minutes of the June 24, 2021
Municipal Planning Commission meeting be adopted as presented.

P-60121 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN that the agenda be adopted as
presented.

The Development Clerk was available to respond to questions.
This report was accepted as information.
7. DEVELOPMENT PERMITS
7.1 DP 2021047 - Lot 19, Block 3, Plan 9611596, Hamlet of Rolling Hills,
Approval of existing accessory building with a variance to setback.
The Development Clerk provided background information on the proposed permit
application.
There were no questions.
P-61/21 MOVED BY COUNCILLOR KELLY CHRISTMAN That the Municipal Planning
Commission APPROVE Development Permit 2021047 for the existing 22.4 mz (241 ftz)
accessory building with a variance to the rear setback on lands legally described as Lot
19, Block 3, Plan 9611596, Hamlet of Rolling Hills. This development approval is subject
to the conditions outlined below.
DP 2021047 is Approved for the following reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable for
the purpose for which it is intended under the Hamlet Residential District (Schedule 2)
as specified in the County of Newell Land Use Bylaw #1892-17.
3. No objections have been received from adjacent landowners or referral agencies with
respect to the proposed development.
Conditions of Development Approval
a) This approval is effective as of July 28, 2021 (21-day appeal period)
b) The development must be located as shown on the site plan approved with the
application and submitted May 21, 2021. Any changes shall require the written
approval of the Development Authority.
c) That any dwelling/structure is located a minimum distance of 3 m (10 ft) from any right
of way or easement on the parcel.

d) The applicant/owner must obtain all construction permits applicable to development
and is responsible to ensure all permits are closed with work complying to the building
code.
e) Any additional development shall require prior approval of a separate permit
application.
f) That the property is not used for conducting a business or commercial operation
without first obtaining the required permits.
g) That the following minimum setbacks on all sides are maintained for this development:
Side (north & south): 1.5 m (5 ft)
Rear (east): .59 m (2 ft); variance from 1.5 m (5 ft)
The proposed development must comply with:
a) The provisions pertaining to the Hamlet Residential District and all relevant schedules,
as outlined in the County of Newell Land Use Bylaw 1892-17.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.

7.2 DP 2021051 - Lot 3, Block 1, Plan 7910951, NE 22-18-14 W4M, Installation of a
manufactured home 2 with an addition and deck for residential use.
The Development Clerk provided background information on the proposed permit
application.
There were no questions.
P-62/21 MOVED BY COUNCILLOR TRACY FYFE That the Municipal Planning Commission
APPROVE Development Permit 2021051, for the installation of a 141 mz (1520 ftz)
manufactured dwelling 2 with a 71 mz (760 ftz) addition and attached 45 mz (480 ftz) deck,
on lands legally described as Lot 3, Block 1, Plan 7910951, NE 22-18-14 W4M. This
development approval is subject to the conditions outlined below.
DP 2021051 is Approved for the following reasons:
1. The proposed development complies with the Municipal Development Plan.
2, The Development Authority is satisfied that the proposed development is suitable for
the purpose for which it is intended under the Acreage Residential District (Schedule
2) and Standards of Development (Schedule 4) as specified in the County of Newell
Land Use Bylaw 1892-17.
3. No objections have been received from adjacent landowners or referral agencies with
respect to the proposed development.
Conditions of Development Approval:
a) This approval is effective as of July 28, 2021 (21-day appeal period) The development
must be located as shown on the site plan approved with the application and
submitted June 2, 2021. It must be built according to the description provided with this
approval. Any changes shall require the written approval of the Development
Authority.
b) Any additional development shall require prior approval of a separate permit
application.

c) That the addition will be constructed with materials and colours which will match and
complement the dwelling.
d) The applicant/owner must obtain all construction permits applicable to development
and is responsible to ensure all permits are closed with work complying to the building
code.
e) That the applicant submit a $5000 security deposit which will be refunded on request
when the construction permits have been approved and closed.
f) That any dwelling/structure is located a minimum distance of 3 m (10 ft) from any right
of way or easement on the parcel.
g) That the property is not used for conducting a business or commercial operation
without first obtaining the required permits.
h) That the following minimum setbacks are maintained for this development:
Front (north-east): 30 m (100 ft)
Side (west): 15 m (50 ft)
Rear (south-west): 7.6 m (25 ft)
Side (east): 7.6 m (25 ft)
i) That the developer must start construction before July 28, 2022. In the event that this
date cannot be met, the developer must apply for an extension and may be required to
apply for a new permit.
The proposed development must comply with:
a) The provisions pertaining to the Acreage Residential District and all relevant
schedules, as outlined in the County of Newell Land Use Bylaw 1892-17.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.

7.3 P 2021055 - Lot 2, Block A, Plan 9610029, SW 14-20-14 W4M, Approval of an
existing shed with a variance to the setback between buildings.
The Development Clerk provided background information on the proposed permit
application.
MPC requested clarification on the variance which the Development Clerk
confirmed.
P-63121 MOVED BY COUNCILLOR BRIAN DE JONG That the Municipal Planning Commission
APPROVE Development Permit 2021055, for the approval of an existing 19 m2 (205 ft)
accessory building (shed), on lands legally described as Lot 2, Block A, Plan 9610029,
SW 14-20-14 W4M. This development approval is subject to the conditions outlined
below.
DP 2021055 is Approved for the following reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable for
the purpose for which it is intended under the Acreage Residential District (Schedule
2) and Standards of Development (Schedule 4) as specified in the County of Newell
Land Use Bylaw 1892-17.

schedules, as outlined in the County of Newell Land Use Bylaw 1892-17.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.

7.3 DP 2021057 - SE 15-21-18 W4M, Installation of a 15 mz (160 ftz) sign with
variance to size.
The Development Clerk provided background information on the proposed permit
application.

P-64121 MOVED BY COUNCILLOR KELLY CHRISTMAN That the Municipal Planning
Commission APPROVE Development Permit 2021057 for the installation of a sign with a
variance to the size, on lands legally described as SE 15-21-18 W4M. This development
approval is subject to the conditions outlined below.
DP 2021057 is Approved for the following reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable for
the purpose for which it is intended under the Public Service District (Schedule 2),Use
Specific Standards of Development (Schedule 4), as specified in the County of Newell
Land Use Bylaw 1892-17.
3. No objections have been received from adjacent landowners or referral agencies with
respect to the proposed development.

Conditions of Development Approval

provided with this approval. Any changes shall require the written approval of the
Development Authority.
c) That any structure is located a minimum distance of 3 m (10 ft) from any right of way
or easement on the parcel.
The proposed development must comply with:
a) The provisions pertaining to the Public Service District and all relevant schedules, as
outlined in the County of Newell Land Use Bylaw 1892-17.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.
