HomeMy WebLinkAbout2021-08-05 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION MEETING August 5, 2021 The regular Municipal Planning Commission Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, August 5, 2021 commencing at 10:03 a.m. A notice was posted at the front entrance advising the public of the meeting. EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1 Minutes - Municipal Planning Commission (July 22, 2021) P-68/21 MOVED BY COUNCILLOR HUBY KALLEN that the minutes of the July 22, 2021 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 0 Municipal Planning Commission August 5, 2021 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-69/21 MOVED BY COUNCILLOR ELLEN UNRUH that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Clerk was available to respond to questions. This item was accepted as information. 7. DEVELOPMENT PERMITS 7.1 DP 2021043 - Lot 13, Block 1, Plan 0612491, SW 5-18-14 W4M, Construction of a detached garage and loft with a variance to setbacks The Development Clerk provided background information on the proposed permit application. MPC inquired if the issue with unsuitable setbacks will be handled in the new Land Use Bylaw. The Development Clerk confirmed that yes, most setback issues would be resolved. P-70/21 MOVED BY COUNCILLOR WAYNE HAMMERGREN That the Municipal Planning Commission APPROVE Development Permit 2021043, for the construction of a 68 mZ (735 ftZ) detached garage and upstairs loft with a variance to the setbacks, on lands legally described as Lot 13, Block 1, Plan 0612491, SW 5-18-14 W4M. This development approval is subject to the conditions outlined below. DP 2021043 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Acreage Residential District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval: a) This approval is effective as of August 25, 2021 (21-day appeal period) The development must be located as shown on the site plan approved with the application and submitted May 5, 2021. It must be built according to the description, provided with this approval. Any changes shall require the written approval of the Development Authority. 0 Page 2 of 5 Municipal Planning Commission August 5, 2021 b) Any additional development shall require prior approval of a separate permit application. c) The applicant/owner must obtain all construction permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. d) That the three accessory buildings currently on the parcel are removed. e) That any dwelling/structure is located a minimum distance of 3 m (10 ft) from any right of way or easement on the parcel. f) That there be a separation between the new building and existing dwelling of .9 m (3 ft); a variance from 3 m (10 ft). g) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. h) That the following minimum setbacks are maintained for this development: Side (south): 2.7 m (9 ft) - variance from 7.6 m (25 ft) Side (north): .9 m (3 ft) — variance from 7.6 m (25 ft) Rear (east): 1.8 m (6 ft) — variance from 15 m (50 ft) i) That the developer must start construction before August 25, 2022. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. The proposed development must comply with: a) The provisions pertaining to the Acreage Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED LEFT THE MEETING G. Patterson, M. Patterson and J. Patterson left at 10:11 a.m. 7.2 DP 2021061 - Lot 3, Block 9, Plan 1412327, SW 10-19-14 W4M, Approval of two existing additions to detached garage The Development Clerk provided background information on the proposed permit application. There were no questions. P-71/21 MOVED BY REEVE MOLLY DOUGLASS That the Municipal Planning Commission APPROVE Development Permit 2021061, for the approval of a 32 mz (344 ftz) addition and 48 mz (520 ftz) addition to detached garage on lands legally described as Lot 3, Block 9, Plan 1412327, SW 10-19-14 W4M. This development approval is subject to the conditions outlined below. MOTION CARRIED 8. OTHER BUSINESS 8.1 Xplornet Tower - NW 24-20-14 W4M The Development Clerk provided background information on the Xplornet tower application. MPC indicated that a waiver has not been granted for an open house in previous applications. The Development Clerk indicated that a waiver had been granted for the Tervita tower in 2019. The Development Clerk added that notifications and responses will still be required prior to the application moving forward. MPC inquired on who will be notified. The Development Clerk replied that the notification area is a 2 mile radius with notifications being mailed 25 days prior to the public meeting date. Page 4 of 5 Municipal Planning Commission August 5, 2021 There was a discussion regarding notifying all concerned parties and it was decided that an open house would be required so all interested parties would be able to attend. P-72/21 MOVED BY COUNCILLOR KELLY CHRISTMAN That the applicant is required to hold a public meeting in addition to notifying all landowners within the required area. MOTION CARRIED 9.
