HomeMy WebLinkAbout2022-06-09 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION MEETING June 9, 2022 The regular Municipal Planning Commission Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, June 9, 2022 commencing at 10.00 a.m. A notice was posted at the front entrance advising the public of the meeting. CALL TO ORDER The Chairman called the meeting to order at 10:00 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1 Minutes - Municipal Planning Commission (April 21, 2022) P-22122 MOVED BY COUNCILLOR NEIL JOHNSON that the minutes of the April 21, 2022 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission June 9, 2022 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-23122 MOVED BY COUNCILLOR ARNO DOERKSEN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Clerk was available to respond to questions. 7. DEVELOPMENT PERMITS 7.1 DP 2021077 - Lathom Solar Project Extension Request The Planning & Development Intern provided background information on the proposed application. There were no questions. P-24122 MOVED BY COUNCILLOR HOLLY JOHNSON that it is recommended that MPC provide a 12 month extension to Development Permit 2021077 to start construction before June 9, 2023. MOTION CARRIED 7.2 DP 2019070 - SunAlta Solar Inc. Extension Request The Development Clerk provided background information on the proposed application. There were no questions. P-25122 MOVED BY COUNCILLOR ADENA SKANDERUP that it is recommended that MPC provide a 12 month extension to Development Permit 2019070 to start construction before June 9, 2023. MOTION CARRIED 7.3 DP 2022046 - Lot 3, Block 2, Plan 9710954, NE 33-18-15-W4, Construction of an accessory building (shop) with a variance to the height for residential use The Development Clerk provided background information on the proposed permit application. The applicant spoke to MPC about his permit application and added that he would also like to accommodate a motor home in the building in the future which would require an extended door. Page 2 of 5 Municipal Planning Commission June 9, 2022 The Supervisor of Planning & Development explained that the height restriction variance is new and has not previously been included in a Land Use Bylaw. The Supervisor of Planning & Development indicated that to her knowledge, no one has been refused for requesting a variance to the height restriction. MPC inquired on who would be notified. The Supervisor of Planning & Development replied that the adjacent landowners are sent notifications. P-26/22 MOVED BY COUNCILLOR ELLEN UNRUH That the Municipal Planning Commission APPROVE Development Permit 2022046, for the construction of a 180 m2 (1938 ftz) accessory building (shop) with a variance to the maximum height on lands legally described as Lot 3, Block 2, Plan 9710954, NE 33-18-15-W4. This development approval is subject to the conditions outlined below. DP 2022046 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the County Land Use Bylaw 2016-21, Section 5: Residential Rural District, Section 3: General Regulations and Section 4: Specific Uses and Activities. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval: a) This approval is effective as of June 29, 2022 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted May 16, 2022, It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) Any additional development shall require prior approval of a separate permit application. d) The applicant/owner must obtain all construction permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. e) That the accessory building be similar to and complement the principal building in exterior material, colour and appearance. f) That the building does not exceed 7.32 metres (24 ft) in height, a variance of 2.3 metres (8 ft) from the Land Use Bylaw. g) That any dwelling/structure is not located on a right of way or easement on the parcel. h) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. i) That the following minimum setbacks are maintained for this development: Side (east & west) 1.5 m (5 ft) Rear (south): 3 m (10 ft) j) That the developer must start construction before June 29, 2023. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. Clizbe left at 10:07 a.m. 7.4 DP 2022048 - Lot 1, Block 37, Plan 1610712, NE 28-21-13-W4, Construction of a single-family dwelling for residential use, with a variance to the maximum number of dwelling units The Development Clerk provided background information on the proposed permit application. MPC asked if 40 dwellings is the usual for a colony this size. The Development Clerk commented that there have been a few colonies that have been growing, MPC asked why a single family dwelling was being installed instead of a multi family dwelling. The Development Officer responded that the colony only requires a single family dwelling at this time and that the building is being constructed is such a way that it can be moved off in the future if they choose to relocate it. There was further discussion on the merits of future residential buildings being allowed on a colony. P-27122 MOVED BY COUNCILLOR GREG SKRIVER That the Municipal Planning Commission APPROVE Development Permit 2022048, for the construct a 166 m2 (1782 ft2) single- family dwelling for residential use, with a variance to the maximum number of dwelling units on lands legally described as Lot 1, Block 37, Plan 1610712, NE 28-21-13-W4. This development approval is subject to the conditions outlined below. DP 2022048 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural General District, Section 3 General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval: a) This approval is effective as of June 29, 2022 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted May 17, 2022. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) The applicant/owner must obtain all construction permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. d) That any structure is not located on any right of way or easement on the parcel. e) Any additional development shall require prior approval of a separate permit application. Page 4 of 5 Municipal Planning Commission June 9, 2022 f) The developer must start construction before June 29, 2023 In the event that this date cannot be met, the developer may be required to apply for a new permit. g) That the following setbacks on all sides are maintained for this development: Front (west): 30 m 100 ft) Side (south): 30 m (100 ft) Rear (east): 6 m (20 ft) MOTION CARRIED 8.
