CALL TO ORDER The Chairman called the meeting to order at 10:00 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1 June 11, 2015 Meeting Minutes P-62/15 MOVED BY COUNCILOR A.M. PHILIPSEN that the minutes of the June 11, 2015 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. C5. ADOPTION OF AGENDA P-63/15 MOVED BY COUNCILLOR C. AMULUNG that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS a) DP 3984 Block 3, Plan 9912337, NW 23-18-14 W4M, Installation of a moved in building to be used as an office trailer The Development Clerk provided background information on the proposed permit. There were no questions from MPC. P-64/15 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning Commission APPROVE DP#3984, for the installation of a 384 ft2 (36 m2) moved in building to be used as an office trailer, subject to the following conditions: This permit is being granted only for the installation of a new 384 ft2 (36 m2) moved in building to be used as an office trailer, on lands legally described as Block 3, Plan 9912337, NW 23-18-14 W4M. Any additional development shall require prior approval of a separate permit application The proposed development complying with: a) The provisions pertaining to the Fringe District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw#1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes, and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP#3984 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under Schedule 4 in the County of Newell Land Use Bylaw#1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted May 21, 2015. Any changes to that plan shall require the written approval of the Development Officer. b) That there is a 10 ft. (3 m) separation distance between the new building and any other buildings or structures. c) That the proposed moved-in office trailer is not used for living purposes. d) The developer must start construction before July 9, 2016. In the event that this date cannot be met, the developer may be required to apply for a new permit. e) That the following setbacks on all sides are maintained for this development: Side (east&west): 25 ft (7.6 m) Rear(south): 25 ft(7.6 m) 3 Front (north): 100 ft (30 m) MOTION CARRIED 7. OTHER BUSINESS a) Bylaw 1840-15, Amendment to Land Use Bylaw 1755-12 (Point of clarification:The heading in the June 25,2015 MPC agenda on this item agenda incorrectly referenced Bylaw 1833-15 while the information discussed,and the written content of the June 25,2015 agenda on this item pertained to Bylaw 1840-15. Bylaw 1833-15 had previously been reviewed by MPC and is going to be the subject of a public hearing during the July 9,2015 Council Meeting.References in the June 25,2015 MPC minutes to this agenda item refer to the correct bylaw number) The County Planner provided background information on Bylaw 1840-15, amendments to Schedules 1 and 2 of Land Use Bylaw 1755-12. Councillor G. Simpson commented that there should be discussion about the proposed 100 ft. setback requirement for dugouts from property lines. This suggestion came from the committee in response to a discussion about seepage from dugouts. Councillor C. Amulung suggested that setbacks for dugouts should be based on soil conditions, which may require soil samples to be done prior to installation. There was further discussion about the need to keep dugouts back from property lines. The County Planner informed MPC that this change will not affect existing dugouts;going forward, however, permits will be needed if a waiver is required. She added that in the current bylaw, if a dugout is proposed to be closer than 100 ft. from a road allowance, the applicant may be required to install a barricade. Councillor C. Amulung asked why meteorological towers are being specified in . the new Land Use Bylaw. The County Planner responded that meteorological towers are part of wind energy conversion systems. Councillor C. Amulung inquired why communication towers have not been listed in the various land use districts. The County Planner replied that the County does not issue permits for communication towers because Industry Canada is the governing body for communication towers. Councillor C. Amulung asked if there was any wording allowing an 8 foot fence to be erected. The County Planner replied that a 6 foot fence is allowed in residential districts and an 8 foot fence is allowed in the industrial areas. Height restrictions to fences have not been included, but could be. Councillor B. de Jong inquired about granny and secondary suites. The County Planner said that granny suites will be found under the administration section. She added that the committee has yet to review that section. Councillor L. Juss asked about setbacks for septic fields. He felt that yards are becoming too small for them and was concerned that agricultural land may be taken to satisfy septic requirements. The County Planner replied that there are many types of septic fields, each with its own setback requirement. She added that there will be a section in the Land Use Bylaw that deals with septic systems, but the County must ultimately abide by the regulations set out by Alberta Safety Codes. b) GTE Solar Extension Request The Development Clerk provided background information on the proposed extension request. Councillor L. Juss inquired what GTE Solar was trying to achieve by requesting an extension to December 31, 2015, when it would be impossible for them to finish construction by then. The Development Clerk responded that the request was to have construction started by December 31, 2015, not finished. P-65/15 MOVED BY COUNCILOR B. DE JONG that the Municipal Planning Commission APPROVE an extension to December 31, 2015 for the commencement of construction of a solar array facility. MOTION CARRIED 8.
