HomeMy WebLinkAbout2022-06-23 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION MEETING June 23, 2022 The regular Municipal Planning Commission Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, .tune 23, 2022 commencing at 10:00 a.m. A notice was posted at the front entrance advising the public of the meeting. P-28122 CALL TO ORDER The Chairman called the meeting to order at 10:00 a.m. EXCUSED FROM MEETING All members were present. MINUTES 3.1 Minutes - Municipal Planning Commission (June 9, 2022) MOVED BYCOUNCILLOR DAN SHORT that the minutes of the June 9, 2022 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission June 23, 2022 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-29122 MOVED BY REEVE ARNO DOERKSEN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS 6.1 DP 2022052 - Lot 2, Block 1, Plan 0714929, SE 29-20-14-W4, Installation of a Riding Stable 1 Arena for commercial use The Development Clerk provided background information on the proposed permit application. MPC noted that on the air photo, there was an area showing where horses were to be boarded and asked if that had changed to the area where horses would be grazing. The applicant indicated that was correct. MPC asked if the concerns regarding parking the Village of Duchess had were resolved. The Development Clerk replied that they had, all parking would remain on the applicant's parcel. P-30122 MOVED BY COUNCILLOR NEIL JOHNSON That the Municipal Planning Commission APPROVE Development Permit 2022052, for the installation of a portable 803 mZ (8640 ftz) riding arena for commercial use on lands legally described as Lot 2, Block 1, Plan 0714929, SE 29-20-14-W4. This development approval is subject to the conditions outlined below. LEFT THE MEETING D. Rempel and A. Ramer left 10:07a.m. DP 2022052 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Fringe District, Section 3 General Regulations and Section 4, Use Standards as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval: a) This approval is effective as of July 13, 2022 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted May 26, 2022. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. Page 2 of 5 Municipal Planning Commission June 23, 2022 c) Any additional development shall require prior approval of a separate permit application. d) The developer must start the operation before July 13, 2023 In the event that this date cannot be met, the developer may be required to apply for a new permit. e) Should the business cease operation for a period of 12 months or more this development permit is no longer valid. f) That the applicant adhere to the County of Newell Animal Control Bylaw 1720-11. g) That the following setbacks on all sides are maintained for this development: Side (north): 4 m (14 ft) — variance from 7.6 m (25 ft) Rear (west): 4 m (14 ft) — variance from 7.6 m (25 ft) MOTION CARRIED 6.2 DP 2022055 - NW 28-17-12-W4, Operation of an Industrial Heavy Use Business, specifically a power generation and datacenter operation with ancillary buildings and structures The Development Clerk provided background information on the proposed permit application. MPC asked if there were any concerns with neighbours. The Development Clerk replied that all the adjacent landowners had been notified by letter and there were no responses. MPC asked if there would be a conflict if the development permit was approved prior to third reading for the Land Use Amendment review on the Council agenda. The Development Clerk responded that in the development permit conditions, construction could not take place until the Land Use Amendment was approved. P-31122 MOVED BY COUNCILLOR LYNETTE KOPP That the Municipal Planning Commission APPROVE Development Permit 2022055 for the operation of an Industrial Heavy Use Business, specifically a power generation and datacenter operation with ancillary buildings and structures, on lands legally described as NW 28-17-12-W4. This development approval is subject to the conditions outlined below. DP 2022055 is Approved for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under Section 5, Industrial General District, Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval: a) This approval is effective as of July 13, 2022 (21-day appeal period). It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) The applicant/owner must obtain all construction permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. d) That the subject area is rezoned to Industrial General prior to commencing construction. e) That the applicant have AUC approval prior to construction, a copy of this submitted to the County of Newell. f) That the tower does not exceed 30 metres (98 ft) in height, variance from 20 m (66 ft). g) Any additional development shall require prior approval of a separate permit application. h) That any structure is not located on any right of way or easement on the parcel. i) That the moved -in building (Trailer) is not used for living purposes. j) That access can be provided for Emergency Services to all structures. k) That the following minimum setbacks on all sides are maintained for this development: Front (west): as per Alberta Transportation Side (north and east): 3 m (10 ft) MOTION CARRIED 6.3 DP 2021109 - Block 1, Plan 8610376, NE 32-22-14-W4, Installation of new camp sites at existing Emerson Bridge Park The Development Clerk provided background information on the proposed permit application. MPC inquired on the internet improvements that were to take place. The Director of Agriculture Services indicated that the fibre optics line would be installed from the cell phone location at the top of the park to three (3) locations at the bottom. P-32122 MOVED BY COUNCILLOR GREG SKRIVER That the Municipal Planning Commission APPROVE Development Permit 2021109 for the installation of 12 new full -service campsites, 3 tent campsites and an existing 42 m2 (456 ftZ) washroom building at the Emerson Bridge Park, on lands legally described as Block 1, Plan 8610376, NE 32-22- 14-W4. This development approval is subject to the conditions outlined below. DP 2021109 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Special, Parks and Public District (Section 5), as specified in the County of Newell Land Use Bylaw 2016-21. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Page 4 of 5 Municipal Planning Commission June 23, 2022 Conditions of Development Approval: a) This approval is effective as of July 13, 2022 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted January 19, 2022. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) The applicant/owner must obtain all construction permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. d) That the campground cannot be used for year-round vehicle storage. e) That roads shall be surfaced to the satisfaction of the Development Authority and be a minimum of 4 m (13 ft) width for one way traffic or 6 m (20 ft) in width for two-way traffic. f) Any additional development shall require prior approval of a separate permit application. g) That the following minimum setbacks on all sides are maintained for this development: Front (east): 97 m (318 ft); as per Alberta Transportation MOTION CARRIED 7.
