HomeMy WebLinkAbout2022-09-22 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION MEETING September 22, 2022 The regular Municipal Planning Commission Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, September 22, 2022 commencing at 10:03 a.m. A notice was posted at the front entrance advising the public of the meeting. MINUTES 3.1 Minutes - Municipal Planning Commission (September 8, 2022) P-50122 MOVED BY COUNCILLOR HOLLY JOHNSON that the minutes of the September 8, 2022 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-51122 MOVED BY COUNCILLOR GREG SKRIVER that the agenda be adopted as presented. MOTION CARRIED 6. SUBDIVISIONS 6.1 2022-0-007 - NW 15-15-15-W4, To subdivide a 4.38 hectare (10.82 acre) parcel from the 31.43 hectare parcel located in the NW 15-15-15-W4 for residential purposes. The Municipal Intern, Planning & Development provided background information on the proposed subdivision application. There were no questions from MPC. P-52122 MOVED BY COUNCILLOR NEIL JOHNSON That the MPC approve the subdivision to create one new parcel 4.38 hectare (10.82 acre) in size from Plan 0011221, Block 1 in the NW 15-15-15-W4 for residential purposes with conditions, for the following reasons. 1. The proposed subdivision is consistent with the South Saskatchewan Regional Plan and complies with the County of Newell Municipal Development Plan, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. MOTION CARRIED 6.2 2022-0-009 - NE 16-15-15-W4, To subdivide a 2.98 hectare (7.37 acre) parcel from the 64.44 hectare (159.14 acre) parcel of NE 16-15-15-W4 for residential purposes. The Municipal Intern, Planning & Development provided background information on the proposed subdivision application. MPC noted that according to the map, the proposed property line runs through Page 2 of 4 Municipal Planning Commission September 22, 2022 the middle of a hay storage structure and asked if that structure will be removed prior to finalization and will staff be confirming it was done. The Municipal Intern, Planning & Development confirmed that the hay storage structure will be removed. MPC Chair Christman inquired whether or not we would be following up to ensure the hay storage structure was moved. The Manager of Planning, Development & Engineering indicated that the request to have the hay storage structure moved can be made a condition of subdivision approval. MPC asked if the applicant will be applying for rural water. The Manager of Planning, Development & Engineering responded that the Supervisor of Planning & Development had discussed signing up for rural water with the applicants and identified the deadline to register for the $1,500 incentive program. MPC had questions regarding the odd shape of the proposed subdivision as well as why the extension at the south crosses the access road. There was a discussion regarding the sharp jag on the west side of the proposed subdivision and the south extension. The Municipal Intern, Planning & Development stated the irregular shape was to accommodate a new irrigation system. MPC requested that a condition be added regarding confirmation from the applicant that the hay storage structure has been moved, and that further information be gathered regarding the proposed irrigation system. P-53122 MOVED BY COUNCILLOR GREG SKRIVER That MPC TABLE the subdivision of a 2.98-hectare (7.37 acre) parcel from the 64.44 hectare (159.14 acre) parcel of NE 16-15- 15-W4 for residential purposes to a future MPC meeting. MOTION APPROVED 7. DEVELOPMENT PERMITS 7.1 DP 2022075 - SE 08-19-14-W4, Addition to existing commercial building. The Municipal Intern, Planning & Development, provided background information on the proposed permit application. MPC asked if there had been a response from the lntermunicipal Planning Commission (IDP). The Municipal Intern, Planning & Development indicated that the City of Brooks had no comments and that an IDP meeting was not required. P-54122 MOVED BY COUNCILLOR NEIL JOHNSON That the Municipal Planning Commission APPROVE Development Permit 2022075 for the construction of a 279 mz (3000 ftz) addition to a 669 mz (7200 ftz) existing shop, on lands legally described as SE 08-19-14- W4. This development approval is subject to the conditions outlined below. DP 2022075 is Approved for the following reasons: Conditions of approval: a) This approval is effective as of October 12, 2022 (21-day appeal period). Page 3 of 4 Municipal Planning Commission September 22, 2022 b) The development must be located as shown on the site plan approved with the application and submitted August 17, 2022. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) The applicantlowner must obtain all construction permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. d) That any structure is not located on any right of way or easement on the parcel. e) Any additional development shall require prior approval of a separate permit application. f) That the following minimum setbacks on all sides are maintained for this development: Front (south): 30 m (100 ft) Side (east): 3.0 m (1Oft) Rear (north): 40 m (131 ft) as per Alberta Transportation highway right- of-way g) The developer must start construction before October 12, 2023. In the event that this date cannot be met, the developer may be required to apply for a new permit. MOTION CARRIED 8. POST AGENDA ITEMS There were no post agenda items. 9.
