HomeMy WebLinkAbout2022-10-06 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION MEETING October 6, 2022 The regular Municipal Planning Commission Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, October 6, 2022 commencing at 10:01 a.m. A notice was posted at the front entrance advising the public of the meeting. CALL TO ORDER The Chairman called the meeting to order at 10:01 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1 Minutes - Municipal Planning Commission (September 22, 2022) P-55122 MOVED BY COUNCILLOR HOLLY JOHNSON that the minutes of the September 22, 2022 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission October 6, 2022 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-56122 MOVED BY COUNCILLOR LYNETTE KOPP that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT This item was accepted as information. 7. LIFT OFF THE TABLE P-57122 MOVED BY COUNCILLOR HOLLY JOHNSON to Lift off the Table Item: Subdivision 2022-0-009 MOTION CARRIED 8. SUBDIVISIONS 8.1 2022-0-009 - NE 16-15-15-W4, To subdivide a 2.98 hectare (7.37 acre) parcel from the 64.44 hectare (159.14 acre) parcel of NE 16-15-15-W4 for residential purposes The Supervisor of Planning & Development provided background information on the proposed subdivision application. MPC asked if it would make sense to move the proposed dotted lines lying south of the access road and move the boundary north of the access road. The applicant responded that the south boundary layout was at the request of the buyer. The applicant indicated that Toren Energy submitted a letter indicating that the access road will be removed once the well it leads to has been abandoned. MPC inquired on the odd shape of the proposed parcel. The applicant replied that the new owner requested as much property as possible to accommodate a new pivot. There was discussion regarding EiD irrigation and residential water and the Supervisor of Planning & Development indicated that the surveyor works with the EID to ensure all conditions are met and signed off. The applicant informed MPC that the hay shed removal would take place during the winter months and asked if it was possible to proceed with the subdivision and sale prior to confirmation of removal. A discussion followed and it was agreed that it would be a few months by the time all conditions were complete. P-58/22 MOVED BY COUNCILLOR DAN SHORT That the MPC approve the subdivision of an approximate 2.98 hectare (7.37 acre) parcel from the 64.44 hectare (159.14 acre) parcel of NE 16-15-15-W4 for residential purposes subject to the following conditions: Page 2 of 3 Municipal Planning Commission October 6, 2022 That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant registers an easement for the conveyance of potable water from the dwellings to the dugout on the NW 15-15-15W4 3. That, pursuant to Section 655(1)b of the Municipal Government Act, the applicant enter into a Development Agreement with the County of Newell which shall be registered concurrently with the final plan against the title(s) being created. 4. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. 5. That the applicant remove the encroaching hay storage building prior to finalization of the subdivision. MOTION CARRIED 9. POST AGENDA ITEMS There were no post agenda items. 10.
