DE JONG that the minutes of the September 10, 2015 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS Amok. The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-88/15 MOVED BY COUNCILLOR A.M. PHILIPSEN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS a) DP 3877 - Block 1, Plan 931 0333, NE 24-18-14 W4M, Approval of a Light Industry business The Development Clerk provided background information on the proposed permit. Councillor C. Amulung asked why an extended length of time was being allowed for the completion of the permit. The Development Clerk replied that the applicant specifically requested a 2 year completion period. P-89/15 MOVED BY COUNCILLOR K. CHRISTMAN that the Municipal Planning Commission APPROVE Development Permit 3877 for the operation of a light industrial business, subject to the following conditions: This permit is being granted only to provide approval for the operation of a light industrial business, on lands legally described as Block 1, Plan 9310333, NE 24-18-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Rural Industrial District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw#1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is the responsibility of the developer to obtain all permits from an accredited inspection agency. Reasons for Approval The Municipal Planning Commission has approved DP 3877 for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Rural Industrial District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw#1755-12. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted August 28, 2015. Any changes to that plan shall require the written approval of the Development Officer. b) That no part of a building or structure shall be located within 30.5 m (100 ft) of Ask the right-of-way of Township Road 184. c) All structures and buildings must be setback 7.6 m (25 ft) from all property lines not fronting on or adjacent to a municipal roadway. d) All structures and buildings must be setback a minimum 3 m (10 ft) from all other structures on the parcel. e) The maximum site coverage for buildings and structures must not exceed 50%. f) This permit applies to the following existing buildings and structures: I. 720 ft2 (66.89 m2) office and lab with a 350 ft2 (32.5 m2) deck II. 60 ft2 (14.88 m2) electrical building III. 96 ft2 (8.89 m2) portable building IV. 388 ft2 (36.06 m2) frame storage V. 374 ft2 (34.77 m2) portable covered storage VI. 32 ft2 (3 m2) identification sign VII. 16146 ft2 (1500 m2) tank farm containing 10 tanks 1(/) g) This permit applies to the construction of the following buildings and structures, which must be completed by October 8, 2017: I. 801 ft2 (74.42 m2) covered storage II. 160 ft2 (14.88 m2) sample building III. 160 ft2 (14.88 m2) electrical building IV. 4844ft2 (450 m2) expansion to tank farm; number of tanks in expanded tank farm not to exceed 25 at any time. h) All structures, buildings and uses that are not listed under f) or g) above will require a separate permit application and approval. i) Additional concrete or asphalt work on the site does not require a development permit. MOTION CARRIED b) DP 2015083 -SW 6-19-14 W4M, Construction of a Dwelling, attached garage and deck LEFT THE MEETING A.M. Philipsen left due to a pecuniary interest at 10:03 a.m. The Development Clerk provided background information on the proposed permit. Councillor C. Amulung asked how far Municipal Services would maintain the road associated with this permit. The Manager of Engineering Services replied that, in testing the road, it met County standards to where the oil/gas well is located. He informed MPC that Municipal Services is prepared to maintain the road to the north end of the approach associated with this permit application. Councillor G. Simpson inquired about the access issues for the parcel on the east side of the road. The Manager of Engineering Services replied that he and the Director of Municipal Services met at the site and determined that the speed limit would be set at 50 km/hr. He added that a letter will be issued to the landowner of the parcel on the east side of the road that all vehicles and equipment must be parked on his property and not on the road allowance. P-90/15 MOVED BY COUNCILLOR K. CHRISTMAN that the Municipal Planning Commission APPROVE DP 2015083, for the construction of a 2600 ft2 (242 m2) dwelling, 1748 ft2 (162 m2) attached garage and 640 ft2(59 m2) deck, subject to the following conditions: This permit is being granted only for the installation of 2600 ft2 (242 m2) dwelling, 1748 ft2 (162 m2) attached garage and 640 ft2 (59 m2) deck, on lands legally described as SW 6-19-14 W4M. Any additional development shall require prior approval of a separate permit application The proposed development complying with: a) The provisions pertaining to the Fringe District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw#1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes, and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP 2015083 for the following reasons: The proposed development complies with the Municipal Development Plan. 1. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under Schedule 4 in the County of Newell Land Use Bylaw#1755-12. 2. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted July 23, 2015. Any changes to that plan shall require the written approval of the Development Officer. ogilot b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures. d) The developer must start construction before September 24, 2016. In the event that this date cannot be met, the developer may be required to apply for a new permit., f) That the following se sacks on all sides are maintained for this development: Front (east): 50 ft (15 m) Side: (north & south) 25 ft (7.6 m) Rear: (west) 25 ft (7.6 m) MOTION CARRIED LEFT THE MEETING G. Approval of an existing accessory building with a variance to the ROW setback The Development Clerk provided background information on the proposed permit. Ask There were no questions. P-91/15 MOVED BY COUNCILLOR C. AMULUNG that the Municipal Planning Commission APPROVE Development Permit 2015098, for the approval of an existing 2160 ft2 (201 m2) accessory building (quonset) with a variance to the road ROW setback subject to the conditions outlined below. This permit is being granted only to provide approval for an existing 2160 ft2 (201 m2) accessory building (quonset) with a variance to the road ROW setback on the farm site, on lands legally described as SE 36-18-16 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw#1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. f)pc) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP 2015098 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw#1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted August 20, 2015. Any changes to that plan shall require the written approval of the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That the following setbacks on all sides are maintained for this development: Front (east): 25 ft (7.6 m); variance from 100 ft (30 m) Side (north and south): 25 ft (7.6 m) Rear(west): 25 ft (7.6 m) MOTION CARRIED d) DP 2015099 - Lot 2, Block 1, Plan 801 1608, NE 7-19-14 W4M, Construction of an accessory building with a variance to side yard setback The Development Clerk provided background information on the proposed permit. There were no questions. P-92/15 MOVED BY COUNCILLOR L. JUSS that the Municipal Planning Commission APPROVE Development Permit 2015099 for the construction of a 1200 ft2 (111 m2) accessory building, subject to the following conditions: This permit is being granted only to provide approval for the construction of a 1200 ft2 (111 m2) accessory building, on lands legally described as Lot 2, Block 1, Plan 8011608, NE 7-19-14 W4M. Any additional development shall require prior approval of a separate Amok permit application. The proposed development complying with: a) The provisions pertaining to the Rural Industrial District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw#1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. Reasons for Approval The Municipal Planning Commission has approved DP 2015099 for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. Any changes to that plan shall require the written Amok approval of the Development Officer. a) That the accessory building is not used for living purposes. b) That there is a 2 m (6.6 ft.) separation distance between the new structure and the existing shop building. c) That the following setbacks on all sides are maintained for this development: Front (east): 50 ft (15 m) Side (north): 100 ft (30 m) Rear(west): 25 ft (7.6 m) Side (south): 10 ft (3 m); variance from 25 ft (7.6 m) MOTION CARRIED e) DP 2015100 - Lot 3, Block 3, Plan 961 1766, SW 10-19-14 W4M, Addition to existing garage with variance to side yard setback The Development Clerk provided background information on the proposed permit. There were no questions. P-93/15 MOVED BY COUNCILLOR C. AMULUNG that the Municipal Planning Commission APPROVE Development Permit 2015100, for the construction of a 480 ft2 (45 m2) addition to existing garage with a variance to the side yard setback, subject to the conditions outlined below. This permit is being granted only to provide approval for the construction of a 480 ft2 (45 API*m2) addition to existing garage with a variance to the side yard setback, on lands legally described as Lot 3, Block 3, Plan 9611766, SW 10-19-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Acreage Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw#1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP 2015100 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Acreage Residential District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw#1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan provided with this application and submitted August 25, 2015. Any changes to that plan shall0 require the written approval from the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That the following setbacks are maintained for this development: Front (east): 50 ft (15.2 m) Side (south): 15 ft (4.5 m); variance from 25 ft (7.6 m) Rear(west): 25 ft (7.6m) d) That the developer must start construction before October 8, 2016. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. MOTION CARRIED f) DP 2015102 -SE 22-21-15 W4M, Approval of a 2nd Dwelling The Development Clerk provided background information on the proposed permit. Councillor L. Juss asked why a permit was granted for the dwelling to be located in an area that was irrigated by the existing pivot. The Manager of Planning & Development responded that the alignment of the pivot has changed since that air photo was taken. P-94/15 MOVED BY COUNCILLOR B. DE JONG that the Municipal Planning Commission APPROVE Development Permit 2015102, for the original 2400 ft2 (223 m2) dwelling, to be used as a second dwelling on the farm site, subject to the conditions outlined below. This permit is being granted only to provide approval for the original 2400 ft2 (223 m2) dwelling, to be used as a second dwelling on the farm site, on lands legally described as SE 22-21-15 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw#1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP 2015102 for the following reasons: The proposed development complies with the Municipal Development Plan. 1. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw#1755-12. 2. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. POST AGENDA ITEMS There were no post agenda items. 8. IN CAMERA There were no in camera items. 9. QUESTION PERIOD Councillor C. Amulung inquired about the difference between an RTM(Ready to Move) dwelling and a manufactured home. The County Planner explained that the names for these types of dwellings are generally driven by the industry as they try to differentiate the different types of dwellings. She added that the County Land Use Bylaw differentiates between RTM homes, manufactured homes, and modular homes in order to help staff determine whether the permit will be permitted or discretionary. 10.
