HomeMy WebLinkAbout2023-09-21 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION September 21, 2023 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, September 21, 2023 commencing at 10:02 a.m. A notice was posted at the front entrance advising the public of the meeting. CALL TO ORDER The Chair called the meeting to order at 10:02 a.m. 2. EXCUSED FROM MEETING P-54/23 MOVED BY COUNCILLOR ELLEN UNRUH that Councillor D. Short, Councillor L. Kopp, and Councillor G. Skriver be excused from the meeting. MOTION CARRIED 3. MINUTES 3.1 Minutes - Municipal Planning Commission (September 7) P-55/23 MOVED BY COUNCILLOR HOLLY JOHNSON that the minutes of the September 7, 2023 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED � Municipal Planning Commission September21, 2023 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. 5. ADOPTION OF AGENDA P-56/23 MOVED BY COUNCILLOR AMANDA PHILPOTT that the agenda be adopted as presented. MOTION CARRIED 6. SUBDIVISIONS 6.1 Subdivision 2023-0-011 To subdivide a± 0.96-hectare (± 2.37 acre) parcel from the portion of the NE 7-21-15W4M which lies to the south of the north 430 feet of the quarter section for residential purposes. The Supervisor of Planning & Development provided background information on this item to Council. She provided an overview of the responses received from the circulation. She also provided information received from an adjacent landowner, indicating that there is a fence not constructed on the property line and the dugout encroaches on the adjacent parcel. The Supervisor of Planning & Development indicated that, if the dugout is confirmed to encroach on the neighbouring land, an encroachment agreement between the landowners should be established. Council was given the opportunity to ask questions. The Supervisor of Planning & Development indicated that the applicant does nof want the dugout associated with the residential parcel. Discussion followed regarding including conditions to the subdivision approval relating to the dugout and the fence. The Chief Administrative Officer and Supervisor of Planning & Development responded to questions regarding the fence. It was noted that development permits are not required for fences. The Supervisor of Planning & Development indicated that the landowners have been encouraged to discuss the fence between themselves. P-57/23 MOVED BY COUNCILLOR NEIL JOHNSON That the MPC approve, with conditions, the subdivision of a 0.96-hectare (2.37 acre) parcei from the portion of the NE 7-21- 15W4M which lies to the south of the north 430 feet of the quarter section for residential purposes for the following reasons: 1. The proposed subdivision is consistent with the South Saskatchewan Regional Plan and complies with the County of Newell Municipal Development Plan, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. � Page 2 of 4 Municipal Planning Commission September 21, 2023 Conditions on approval: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. 2. That, pursuant to Section 655(1)b of the Municipal Government Act, the applicant enters into a Development Agreement with the County of Newell which shall be registered concurrently with the final plan against the title(s) being created. 3. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. 4. That the Land Use Amendment be approved by Council, changing the zoning of the proposed parcel from Agriculture, General District, to Residential, Rural District, prior to the finalization of the subdivision. 5. That an agreement be established between the applicant and then adjacent landowner for the encroachment of the dugout on the northern property line of the subject parcel. Reserve: That municipal reserve be supplied as money in place of land as the proposed subdivision does not meet the provisions of section 663 of the MGA. Policy POL-010-23 would apply, with the determined land value of $10,500/acre. Money in place of land would be approximately $2488.50 (10% of 2.37 acres x$10,500 acre). MOTION CARRIED 7. OTHER BUSINESS There was no other business to discuss at this meeting. 8. POST AGENDA ITEMS There were no post agenda items to discuss at this meeting. 9. IN CAMERA There were no in camera items to discuss at this meeting. 10. QUESTION PERIOD A question period was held. No County ratepayers were in attendance.
