HomeMy WebLinkAbout2023-10-05 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION October 5, 2023 The regular Municipal Planning Commission (MPC) Meeting ofthe County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, October 5, 2023 commencing at 10:02 a.m. A notice was posted at the front entrance advising the public of the meeting. P-58/23 4. CALL TO ORDER The Chair called the meeting to order at 10:03 a.m. EXCUSED FROM MEETING All members were in attendance at this meeting. MINUTES MOVED BY COUNCILLOR HOLLY JOHNSON that the minutes of the September 21, 2023 Municipal Planning Commission meeting be adopted as presented. ADOPTION OF AGENDA P-59/23 MOVED BY COUNCILLOR GREG SKRIVER that the agenda as adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Clerk pr�sented the Development Report and there were no questions from MPC. This item was accepted as information. 7. SUBDIVISIONS 7.1 Subdivision 2023-0-012 To subdivide an approximate 1.589 hectare (3.93 acre) parcel from the NW 34-20-14W4M for residential purposes The Supervisor of Planning and Development provided background information on the proposed subdivision application. MPC was given the opportunity to ask questions. MPC asked for an explanation on the standard EID requirement. The Supervisor of Planning and Development explained that if there are first water rights on the proposed subdivision, they must be removed and the applicant has the ability to exchange them for the right to use EID water for rural watering purposes for the newly created parcel. If there are no water rights to exchange, the applicant is able to pay for the ability to convey water to the newly created parcel. P-60/23 MOVED BY COUNCILLOR ELLEN UNRUH that the MPC approve, with conditions, the subdivision of an approximate 1.589 hectare (3.93 acre) parcel from the NW 34-20- 14W4M for residential purposes for the following reasons: 1. The proposed subdivision is consistent with the South Saskatchewan Regional Plan and complies with the County of Newell Municipal Development Plan, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions of Approval: 1. That, pursuant to Section 654(1)(d) of the Municipal GovernmentAct, all outstanding property taxes shall be paid to the County of Newell. 2. That, pursuant to Section 655(1)(b) of the Municipal GovernmentAct, the applicant enters into a Development Agreement with the County of Newell which shall be registered concurrently with the final plan against the title(s) being created. 3. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. POST AGENDA ITEMS There were no post agenda items to discuss at this meeting. 10. IN CAMERA There were no in camera items to discuss at this meeting. ARRIVED AT MEETING L. Johnson arrived at 10:09 a.m. 12. INFORMATION ITEMS 12.1 Lathom Solar Project MPC requested additional information about the cancellation of the Lathom Solar Project. The Supervisor of Planning and Development advised the project was located north of the #1 highway, east of Bassano and a development permit was issued in 2022. This was a$170 million dollar project, 128 megawatts on 8 quarter sections. The CAO estimated tax loss to be $20 million over 20 years. MPC requested contact be made with the solar company to obtain more information regarding this cancellation. 12.2 Special Areas - Land Use Order This item was accepted as information. 13. QUESTION PERIOD A question period was held. No County ratepayers were in attendance. The moderator indicated that fhere were no questions from the public. 14.
