HomeMy WebLinkAbout0192-59 Homes for the Aged, Establishment ofBY-LAW N0. 192 A by-law of the County of Newell No. t~., in the province of Alberta, to authorize a Master Agreement under the Horner for the Aged Act. WHEREAS under the provisions of The Homes for the Aged Act, being chapter 29 of the Statutes of Alberta, 1959, the County of Newell No. 4 has power to enter into an agreement with the Minister of Public Welfare and with other municipalities for the establishment and maintenance of a home for elderly persons; and WI~E`,RF,AS it is desirable that such an agreement be entered into for the purpose of establishing and maintaining a home for elderly residents of this and the other participating municipalities: THEREFORE the council of the County of Newell No. /~ in council assembled enacts as follows: 1. The County of Newell No. ~ is hereby authorized to enter into a Master Agreement with the Minister of Public Welfare and all or any of the following municipalities, to wit: The Town of Brooks The Town of Bassano The Village of Duchess The Village of Rosemary The Village of Tilley making provision far the fallowing and related matters; (a) for the erection by the Minister of Fublic Welfare of a home for elderly persons upon that parcel of land described as follows: That part of the N.E. 32-18-]1i W.4 formerly known as the Provincial Horticultural reserve bounded on the West by Third Street East in the to~msite of Brooks, bounded on the North by the East West road allowance, bounded on the East by the existing main irrigation ditch and bounded on the South by an Easterly extension of Fourth Avenue in the townsite of Brooks. Containing eleven and six tenths acres, more or less. L~ ~~~ ~ N ~ }~ ~ ~ '' Pv ~ n s X 149-P-Special .L SUPPLiE'sS LTD. - 2 , (b) for the donation of the aforesaid land by the participating municipalities to the Foundation to be established to operate and manage the said home, with the cost of the land being shared by the participating municipalities in the same pro- portion that the assessment of each municipality bears to the total assessment of all the participating municipalities; (c) for the furnishing and equipping and making serviceable by the Minister of Public Welfaxe of the home to be erected on the said land; (d)that the town of Brooks will undertake, in accordance with the Master Agreement, to extend its utilities and other services to a point on the boundary line of the said land upon which the home is to be constructed; (e) that the County of Newell No. 1,. shall undertake to share the annual operating deficits, if any, of the home in the proportion that the assessment of this municipality bears to the total assessment of all the participating municipalities, including this municipality; (f) that a Foundation to manage and operate the home shall be established pursuant to the Master Agreement, to receive, hold, manage and operate the lands and buildings of the home and that a member or members of the council of the County of Newell No. 4 will be on the board of directors of the said Foundation. 2. The Agreement hereby authorized may provide for such other matters and things, not being inconsistent with or differing in substance from the above mentioned provisions, as may be necessary for the purposes of the project hereby contemplated for the establishment and working of the Foundation and the operation and management of units or homes to be provided pursuant to the said agreement. 3.
