HomeMy WebLinkAbout1769-13 Tax - Well DrillingCOUNTY OF NEWELL IN THE PROVINCE OF ALBERTA BYLAW NO. 1769 -13 A By -law of the County of Newell in the Province of Alberta, to provide for the imposition of a tax on persons engaged in drilling of a well for which a permit is required pursuant to the Oil & Gas Conservation Act, and /or engaged in the servicing of existing wells. Under authority and subject to the provisions of the Municipal Government Act, RSA 2000 M -26 and regulations published pursuant to the said Act, the Council of the County of Newell duly assembled does hereby enact: 1) That the County Administrator is hereby authorized and required to levy a tax upon persons who are in legal possession of equipment engaged in the drilling of a well for which a permit is required pursuant to the Oil & Gas Conservation Act and /or in the servicing or deepening of an existing well with drilling equipment. 2) That a tax imposed pursuant to this By -law shall be computed in the manner and in accordance to the rates set out in the Municipal Government Act "Well Drilling Equipment Tax Rate Regulation" and amendments thereto, and shall be due and payable to the County of Newell upon completion of the drilling, deepening or servicing of any well as the case may be. 3) That, in the event a tax imposed pursuant to this By -law remains unpaid for a period of thirty (30) days after the cessation of the drilling, deepening or servicing operation, the County Administrator or any person appointed by him in writing, may levy the same with costs by distress under the provisions of the Municipal Government Act. 4) By -law 1645 -08 is rescinded on passing of By -law 1769 -13.
