HomeMy WebLinkAbout1829-15 Inter-Municipal Development Plan (Vulcan County)BYLAW NO. 1829-15 COUNTY OF NEWELL IN THE PROVINCE OF ALBERTA Bylaw No. 1829-15 of the County of Newell is for the purpose of adopting the Vulcan County and County of Newell Intermunicipal Development Plan in accordance with sections 631 and 692 of the Municipal Government Act, Revised Statutes of Alberta 2000, Chapter M-26, as amended. WHEREAS municipalities are encouraged by the province to expand intermunicipal planning efforts to address common planning issues and where the possible effects of development transcends municipal boundaries. AND WHEREAS both the Councils of the County of Newell and Vulcan County agree that it is to their mutual benefit to establish joint planning policies, and this negotiation and agreement reflects a continuing cooperative approach between the two municipalities and the desire to see well-planned, orderly, and managed growth. AND WHEREAS the municipality must prepare a corresponding bylaw and provide for its consideration at a public hearing. NOW THEREFORE, under the authority and subject to the provisions of the Municipal Government Act, Revised Statutes of Alberta 2000, Chapter M-26 as amended, the Council of the County of Newell duly assembled hereby enacts the following: 1. Council shall adopt the Vulcan County and County of Newell Intermunicipal Development Plan in consultation and as agreed to with Vulcan County. 2. This plan, upon adoption, shall be cited as the Vulcan County and County of Newell Intermunicipal Development Plan Bylaw No. 2015-008 and Bylaw No. 1829-15. 3. MunicipalitiesareencouragedtoworktogethertoadoptIDPsto: promoteconsultation,coordinationandcooperationregardingplanningmattersofjointinterest withinadefinedplanningarea; provideaframeworkforaddressinglanduseconcernswithregardtojointplanningmatters; establishprocedurefordealingwithdevelopmentproposalswithinadefinedplanningarea;and addressanyothermattersrelatingtodevelopmentconsiderednecessarywithinajointplanning area. AnIDPisaplanningtoolthatcanprovidenumerousbenefitstothoseparticipatingmunicipalities, including,butnotlimitedtothefollowing: municipalcostsavings,asaresultofinfrastructureandservicesharing,whichalsoprovides residentswithahigherqualityoflife; reinforcingandprotectingbothƒǒƓźĭźƦğƌźƷźĻƭ͸developmentphilosophiesandgoalswhile mitigatingthepotentialforfutureintermunicipalconflict;and ensuringdevelopmentforbothmunicipalitiesoccursinanorderly,efficientandharmonious mannerthatissustainablebyconsideringexistingdevelopmentconditionsandfuturemunicipal goals. ThePlancontainspolicythatistobeusedasaframeworkforworkingcooperatively,communicating andmakingdecisionsineachmunicipality.Eachmunicipalityisultimatelyresponsibleformaking decisionswithintheirownmunicipaljurisdiction. VulcanCounty&CountyofNewell 1 IntermunicipalDevelopmentPlanBylawNo.2015008&BylawNo.182915 Page|1 1.2MunicipalProfiles VulcanCounty VulcanCountycoversanareaofapproximately550,000hectares(1.3millionacres),withapopulationof 3,984(AlbertaMunicipalAffairs,2017).TheCountysurroundssixurbanmunicipalities,containseight hamlets,andisborderedbysixruralmunicipalitiesandoneFirstNation.TheeconomyofVulcanCounty hastraditionallycenteredonagriculture,althoughrecentlytherehasbeenanincreaseinoil,gasand renewableenergydevelopment.TheCountyhasanumberofrecreationalresidentialdevelopments, particularlyaroundMcGregorLakeandTraversReservoirs. CountyofNewell TheCountyofNewellspansanareaofapproximately620,000hectares(1.5millionacres)witha populationof7,524(AlbertaMunicipalAffairs,2017).TheCountyofNewellsurroundsfoururban municipalities,containstenhamletsandisborderedbyfourruralmunicipalities,oneSpecialAreaand oneFirstNation.TheeconomyoftheCountyofNewellisbasedonagricultureandenergyresource development.TheCountyofNewellincludesseverallargereservoirs,thetwolargestbeingLakeNewell andCrawlingValley,whichprovideirrigationandrecreationalopportunities. Specificallythe MGA states: 631(1)Twoormorecouncilsofmunicipalitiesthathavecommonboundariesthatarenotmembersofa growthregionasdefinedinsection708.01must,byeachpassingabylawinaccordancewiththisPartor inaccordancewithsections12and692,adoptanintermunicipaldevelopmentplantoincludethoseareas oflandlyingwithintheboundariesofthemunicipalitiesastheyconsidernecessary. (1.1)Despitesubsection(1),theMinistermay,byorder,exemptoneormorecouncilsfromthe requirementtoadoptanintermunicipaldevelopmentplan,andtheordermaycontainanytermsand conditionsthattheMinisterconsidersnecessary. (1.2)Twoormorecouncilsofmunicipalitiesthatarenototherwiserequiredtoadoptanintermunicipal developmentplanundersubsection(1)may,byeachpassingabylawinaccordancewiththisPartorin accordancewithsections12and692,adoptanintermunicipaldevelopmentplantoincludethoseareasof landlyingwithintheboundariesofthemunicipalitiesastheyconsidernecessary. (2)Anintermunicipaldevelopmentplan (a)mustaddress (i)thefuturelandusewithinthearea, (ii)themannerofandtheproposalsforfuturedevelopmentinthearea, (iii)theprovisionoftransportationsystemsforthearea,eithergenerallyorspecifically, (iv)thecoordinationofintermunicipalprogramsrelatingtothephysical,socialand economicdevelopmentofthearea, (v)environmentalmatterswithinthearea,eithergenerallyorspecifically,and (vi)anyothermatterrelatedtothephysical,socialoreconomicdevelopmentofthearea thatthecouncilsconsidernecessary, and (b)mustinclude (i)aproceduretobeusedtoresolveorattempttoresolveanyconflictbetweenthe municipalitiesthathaveadoptedtheplan, (ii)aproceduretobeused,byoneormoremunicipalities,toamendorrepealtheplan,and theadministrationoftheplan. (iii)provisionsrelatingto (3)Thecouncilofamunicipalitythatisrequiredunderthissectiontoadoptanintermunicipal developmentplanmusthaveanintermunicipaldevelopmentplanthatprovidesforallofthematters referredtoinsubsection(2)within2yearsfromthedatethissubsectioncomesintoforce. (5)Increatinganintermunicipaldevelopmentplan,themunicipalitiesmustnegotiateingoodfaith. Inadditiontothe MGA,theSouthSaskatchewanRegionalPlan(SSRP)cameintoeffectSeptember1, 2014.TheSSRPusesacumulativeeffectsmanagementapproachtosetpolicydirectionfor municipalitiestoachieveenvironmental,economicandsocialoutcomeswithintheSouthSaskatchewan Regionuntil2024. PursuanttoSection13ofthe AlbertaLandStewardshipAct,regionalplansarelegislativeinstruments. TheSSRPhasfourkeypartsincludingtheIntroduction,StrategicPlan,ImplementationPlanand RegulatoryDetailsPlan.PursuanttoSection15(1)of ALSA,theRegulatoryDetailsoftheSSRPare enforceableaslawandbindtheCrown,decisionmakers,localgovernmentsandallotherpersonwhile theremainingportionsarestatementsofpolicytoinformandarenotintendedtohavebindinglegal effect. TheRegionalPlanisguidedbythevision,outcomesandintendeddirectionssetbytheStrategicPlan portionoftheSSRPwhiletheImplementationPlanestablishestheobjectivesandthestrategiesthatwill beimplementedtoachievetheregionalvision.AspartoftheImplementationPlan,Section8: CommunityDevelopmentincludesguidanceregardingPlanCooperationandIntegrationbetween municipalitieswiththeintentiontofostercooperationandcoordinationbetweenneighbouring municipalitiesandbetweenmunicipalitiesandprovincialdepartments,boardsandagencies.Section8 containsthefollowingbroadobjectivesandstrategies. Objectives Cooperationandcoordinationarefosteredamongalllanduseplannersanddecisionmakers involvedinpreparingandimplementinglandplansandstrategies. Knowledgesharingamongcommunitiesisencouragedtopromotetheuseofplanningtoolsand theprinciplesofefficientuseoflandtoaddresscommunitydevelopmentintheregion. Strategies 8.1 Worktogethertoachievethesharedenvironmental,economic,andsocialoutcomesintheSouth SaskatchewanRegionalPlanandminimizenegativeenvironmentalcumulativeeffects. 8.2 Addresscommonplanningissues,especiallywherevaluednaturalfeaturesandhistoricresources areofintereststomorethanonestakeholderandwherethepossibleeffectofdevelopment transcendsjurisdictionalboundaries. 8.3 Coordinateandworkwitheachotherintheirrespectiveplanningactivities(suchasinthe developmentofplanandpolicies)anddevelopmentapprovalprocesstoaddressissuesofmutual interest. withthephysicalinfrastructure 8.4 Worktogethertoanticipate,planandsetasideadequateland andservicesrequiredtoaccommodatefuturepopulationgrowthandaccompanyingcommunity developmentneeds. VulcanCounty&CountyofNewell 4 IntermunicipalDevelopmentPlanBylawNo.2015008&BylawNo.182915 Page|4 8.5 Buildawarenessregardingtheapplicationoflanduseplanningtoolsthatreducetheimpactof residential,commercialandindustrialdevelopmentsontheland,includingapproachesandbest practicesforpromotingtheefficientuseofprivateandpubliclands. 8.6 Pursuejointuseagreements,regionalservicescommissionsandanyotherjointcooperative arrangementsthatcontributespecificallytointermunicipallanduseplanning. 8.7 Considerthevalueofintermunicipaldevelopmentplanningtoaddresslanduseonfringeareas, airportvicinityprotectionplanorotherareasofmutualinterest. 8.8 CoordinatelanduseplanningactivitieswithFirstNations,irrigationdistricts,schoolboards, andotheragenciesonareasofmutualinterest. healthauthorities TheabovestrategieswereconsideredbybothmunicipalitieswhendevelopingpolicywithinthisIDPand willbeconsideredwhenrenderinglandusedecisionspertainingtodevelopmentwithinthePlanArea. OtherstrategiescontainedintheSSRPshouldbeconsideredinthecontextofeachruralƒǒƓźĭźƦğƌźƷǤ͸ƭ MunicipalDevelopmentPlan,LandUseBylaworthroughpoliciesfoundwithinthisPlan. 1.4OtherPlansandStatutoryDocuments MajorvilleGuidelinesforLandandResourceManagement OntheVulcanCountysideofthePlanArea,adjacenttotheBowRiver(seeMap2),theGovernmentof Alberta(GoA)haspreparedtheͻağƆƚƩǝźƌƌĻGuidelinesforLandandResourceağƓğŭĻƒĻƓƷͼ(MGLRM). Thisareaconsistsprimarilyofrelativelyundisturbednativegrasslands,muchofwhichisoccupiedby grazingleaseholders.Recognizingtheexistenceofsignificantculturalfeatures,includingtheMajorville CairnandMedicineWheel,andtheuniquebiophysicalresourcesassociatedwiththeplanningarea,the GoAcommissionedthedevelopmentofGuidelinesthatwouldassistinprotectingtheculturaland historicresourcescontainedwithinthearea. ReferencetotheMGLRMcanbefoundintheImplementationPlan(notablyStrategy3.6)sectionofthe SouthSaskatchewanRegionalPlan.TheGuidelines,whichwereadoptedinNovember2015,were establishedfollowingarobust,10yearplanningprocess,whichincludedFirstNationsandstakeholder engagement.TheMGLRMarea,whichiscomprisedprimarilyofCrownownedlands,isfurtherdivided intowestandeastͻIĻƩźƷğŭĻ\[ğƓķƭĭğƦĻͼareas.Landuseactivityismorestringentlyregulatedwithin theseareas,andprohibitsdevelopmentlikesolarfarmsorrecreationaluse.Withintheseareasaretwo ͻƓƚsurfaceğĭĭĻƭƭͼdesignations(limitingsurfacemineralextraction)thatarefencedoff,andwhich containsthesitedesignatingtheMajorvilleCairnandMedicineWheelprovincialhistoricresource. Archaeologicalstudiesindicatethatthissitehasbeenusedforthelast4,500years,makingitoneofthe oldestreligiousmonumentsintheworld. TheMGLRMdocumentshouldbereferencedalongsiderelevantGoAdepartmentsforanylanduse applicationswithintheMGLRMarea.ThedevelopmentofIDPpoliciesmustbeconsistentwith MajorvilleGuidelinesforLandandResourceManagementestablishedforthisimportantarea. VulcanCounty&CountyofNewell 5 IntermunicipalDevelopmentPlanBylawNo.2015008&BylawNo.182915 Page|5 "Knowledgesharingamongcommunitiesisencouragedtopromotetheuseof planningtoolsandtheprinciplesofefficientuseoflandtoaddresscommunity developmentintheregion." 1.5PlanPreparationProcess TheformationofthePlanwasguidedbytheIDPReviewCommitteeasestablishedbytherespective municipalities.TheReviewCommitteewascomposedoftwoCouncilorsfromeachmunicipality.Senior administrativestafffrombothmunicipalitieswerealsoinvolvedthroughouttheprocessastechnical advisors.Withrespecttodecisionmaking,bothpartiesagreedattheoutsetoftheprocessthat Committeedecisionswouldbebasedonreachingconsensusontheissuesdiscussed. Abackgroundandstudyareaanalysiswasundertakenwhichservedasthefoundationfromwhichboth municipalitiescouldreviewtheexistinglanduseconditionsanddeterminetherelevantissues,goalsand objectives.Priortoidentifyingthemesofimportanceandconcern(seePart3)withtheReview Committee,plannersfromtheOldmanRiverRegionalServicesCommission(ORRSC)metwitheach municipalityprivatelytoclarifytheirmunicipalperspectivesongeneralissues.OnceeachƒǒƓźĭźƦğƌźƷǤ͸ƭ perspectiveswereidentified,adraftdocumentwaspreparedfortheReview/ƚƒƒźƷƷĻĻ͸ƭreview.An outlineoftheprojectpurpose,process,ideasandconceptswasthenreviewedwithaffected landowners,stakeholdersandthegeneralpublicatanOpenHouse. AftertheOpenHousetheReviewCommitteeandeachmunicipalCouncilreviewedthedraft;arefined documentwasthenpreparedandsubmittedfortheReview/ƚƒƒźƷƷĻĻ͸ƭfinalapproval.Uponapproval, thefinaldraftdocumentwasthenforwardedtoeachCouncilforreview.Asrequiredbythe MGA, mandatorypublichearingswereheldbyeachCouncilandsubsequenttothepublichearings,theIDP wasadoptedbyeachmunicipalityunderseparatemunicipalbylaws.Bothmunicipalitiesthenappointed twoCouncilorstotheIntermunicipalDevelopmentPlanCommitteetoensurecontinueddialogueand cooperationthroughoutthecontinueduseofthisPlan. KeycharacteristicsofthePlanAreaincludethefollowing: Agriculture o Thereisamixofagriculturaloperationsincludinggrazing,irrigation,drylandfarmingand CFOs. o Alllandsarezonedforagriculturaluse(RuralGeneralΑ"RG"inVulcanCountyand AgriculturalΑ"A"intheCountyofNewell,withtheexceptionoftheHamletofBowCity). LimitedResidentialDevelopment o ThemajorityofthelandinVulcanCountyisCrownlandandcontainsfewresidences. o TheonlyhamletisBowCity(SW191717W4),locatedintheCountyofNewell. POLICIES 4.1.1Themunicipalities,asperthisPlan,shallstrivetoengageineffectivedialoguewhen consideringlanduseinthePlanArea,whilestillmaintainingcompletejurisdictiononlands withintheirownboundaries. 4.1.2Themunicipalitiesmaycollaborateandinvestigatemethodsofgivingsupporttoprojects thatmaymutuallybenefitorenhancethequalityoflifeofresidentsfromboth municipalities.Thiscouldbeintheformofinkinddonations,materials,municipallettersof support,unifiedgovernmentlobbying,applicationforgrants,orothermorepermanent arrangementsifbothmunicipalitiesagreeandenterintodiscussionsandmakespecific agreementsforsuch. 4.1.3Bothmunicipalitiesagreetojointlydiscusswaystocooperatewithprovincialandfederal agenciesandutilityproviderstohelpfacilitatetheefficientdeliveryofinfrastructureand servicesthatareofamutualbenefit. 4.1.4VulcanCountyandtheCountyofNewellshallstrive,tothebestoftheirabilityand knowledge,toreferallnoticesofgovernmentprojectswithinthePlanAreatotheadjacent municipality. 4.1.5Bothmunicipalitiesareencouragedtosharewiththeadjacentmunicipality,theresultsofall publiclyavailabletechnicalanalysesrequiredbyaSubdivisionandDevelopmentAuthority aspartofanapplication,wherethereisthepotentialforimpactsonlandsandbodiesof waterwithintheadjacentmunicipality. 4.1.6TheMajorvilleGuidelinesforLandandResourceManagement(MGLRM)applyexclusivelyto landsthatfallwithintheMGLRMboundaryasillustratedinMap2.Ifthereisany discrepancybetweentheIDPpoliciesandthepoliciesintheMGLRM,theMGLRMprevails. VulcanCounty&CountyofNewell 10 IntermunicipalDevelopmentPlanBylawNo.2015008&BylawNo.182915 Page|10 4.1.7SubdivisionordevelopmentoflandsthathavebeenidentifiedinMap5thatmaycontainan environmentallysignificantsitemayberequiredtoconductanenvironmentalimpact assessment(EIA)andshouldcontactAlbertaEnvironmentandSustainableResource Developmentregardingtheland. 4.1.8SubdivisionordevelopmentoflandsthathavebeenidentifiedinMap9thatmaycontaina historicresourcemayberequiredtoconductahistoricalresourceimpactassessment(HRIA) andshouldconsulttheHistoricalResourcesActandAlbertaCultureandTourismregarding land. 4.1.9ThepotentialdevelopmentofadditionalwaterstorageatEyremorealongtheBowRiverhas thepotentialtoimpactbothmunicipalitiesifitisendorsedandconstructed.Policies regardingthedevelopmentoftheEyremoreReservoirshouldbeconsideredatthetimethe projectmaycommence. 4.2Agriculture INTENT AgricultureandgrazingwillcontinuetobetheprimaryuseoflandinthePlanArea,andnon agriculturalusesshouldbeconsideredonlyinsuchareaswheretheywillnotnegativelyimpact agricultureandgrazing. POLICIES 4.2.1AgriculturewillcontinuetobethepredominantlanduseinthePlan.Area.Theimpacton agriculturalusesshouldbeaconsiderationwhendeterminingsuitabilityofnonagricultural landusesinthePlanArea. 4.2.2Bothmunicipalitieswillstrivetoworkcooperativelytoencouragegoodneighbourfarming practices,suchasdust,weedandinsectcontroladjacenttodevelopedareas,throughbest managementpracticesandAlbertaAgricultureguidelines. VulcanCounty&CountyofNewell 11 IntermunicipalDevelopmentPlanBylawNo.2015008&BylawNo.182915 Page|11 4.2.3Ifdisputesorcomplaintsineithermunicipalityshouldarisebetweenratepayersand agriculturaloperators,themunicipalityreceivingthecomplaintshallstrivetodirectthe affectedpartiestotheappropriateagency,governmentdepartmentormunicipalityfor consultationorresolutionwherevernecessary. 4.3ConfinedFeedingOperations(CFOs) INTENT ThemunicipalitiesrecognizethatitisthejurisdictionoftheNaturalResourcesConservationBoard (NRCB)tograntapprovalsandregulateCFOs.However,bothmunicipalitiesagreeitisdesirableto specificallyregulateintensiveagriculturaloperationsforthedefinedPlanAreainanattemptto minimizepotentialnuisanceandconflict. POLICIES 4.3.1ExistingCFOslocatedwithinthePlanAreawillbeallowedtocontinuetooperateunder acceptableoperatingpracticesandwithintherequirementsofthe AgriculturalOperation PracticesActandRegulations. 4.3.2NewCFOsarenotpermittedtobeestablishedwithintheIntermunicipalDevelopmentPlan ConfinedFeedingOperationsExclusionAreaasillustratedonMap4. 4.3.3AnyexistingCFOpermitholdersmaybeallowedtoexpandoperationswithinthedesignated CFOExclusionAreaifitistoupgradeandmodernize(withintherequirementsofthe AgriculturalOperationPracticesActandRegulations),demonstratingchangeswillreduce negativeimpacts(e.g.,odours)totheresidentsofthearea,additionalenvironmental protectionwillbeconsidered,andcommentsfromboththemunicipalitiesarereceivedand consideredbytheNRCB. 4.3.4IfeitherVulcanCountyortheCountyofNewellareinreceiptofanapplicationfornewor expandedCFOswithinthePlanArea,theyshallforwardacopyoftheapplicationtothe otherCounty. 4.3.5Forstatutoryplanconsistency,asrequiredunderthe MGA,both/ƚǒƓƷǤ͸ƭMunicipal DevelopmentPlanCFOpoliciesandassociatedmapshallbereviewedandupdatedtoreflect theCFOExclusionAreaasdefinedbyMap4withinthefirstyearofthisIDPbeingadopted. POLICIES 4.4.1Themunicipalitiesshallconsidertheeffectsofvisualintrusion,dust,noise,traffic,andair andwaterpollutionwhenevaluatingapplicationsfor neworexpandedgravelpits,orother extractiveactivities,wheretheymaintainjurisdiction. 4.4.2Eachmunicipalitymustbenotifiedofanyresourcedevelopmentproposalintheother municipalitythatwillresultinaccessbeingrequiredfromaroadunderitscontrolor management.Theaffectedmunicipalitymustgiveitsapprovalfortheuseofaroadin writingpriortotheapplicationbeingconsideredascompletebytheothermunicipality. 4.4.3Eithermunicipalitymayrequireanagreementregardingtheconstruction,repair,and maintenanceofanymunicipalroads,whichmaybeimpactedbyresourcedevelopment, whenthedevelopmentrequiresaccesstocomefromtheotherƒǒƓźĭźƦğƌźƷǤ͸ƭroad. 4.4.4IfeitherVulcanCountyortheCountyofNewellareinreceiptofanoticefornewor expandedAlbertaTransportationgravelpitwithinthePlanArea,theyshallforwardacopy ofthenoticetotheotherCounty. 4.5IndustryandEnergyDevelopment INTENT VulcanCountyandtheCountyofNewellrecognizetheimportantrolethatindustryandenergy developmentplayinsupportingthelocalandregionaleconomy.ThepoliciesinthisSectionaddress theneedtoensurethecompatibilityoflanduses. POLICIES 4.5.1Landsunderconsiderationforindustrialdevelopmentthatdonotcurrentlyallowfora proposeduse,shallberequiredtorezonetoasuitablelandusedistrict. 4.5.2ThemunicipalitiesencouragethelocationofRenewableEnergydevelopmentswithinthe PlanArea: a)wherecompatiblewithexistinglanduses, b)inconsiderationofcommentsfromtheadjacentmunicipality. VulcanCounty&CountyofNewell 13 IntermunicipalDevelopmentPlanBylawNo.2015008&BylawNo.182915 Page|13 4.6TransportationandRoadNetworks INTENT RoadinfrastructureinthePlanAreaislimitedgiventhepresenceofCrownLandinVulcanCounty andthelimitedcurrentdevelopmentintheCountyofNewell.Itisimportantthatthemunicipalities takeintoconsiderationtheimpactofdevelopmentonmunicipalandprovincialroadinfrastructure. POLICIES 4.6.1Eachmunicipality shallbenotifiedofanysubdivisionordevelopmentproposalintheother municipalitythatwillresultinaccessbeingrequiredfromaroadunderitscontrolor management.Theaffectedmunicipalitymustgiveitsapprovalinwritingpriortothe applicationbeingconsideredascompletebytheothermunicipality. 4.6.2BothmunicipalitiesagreetoconsultandworkwithAlbertaTransportationregardingthe implementationofthisPlanand,atthetimeofsubdivisionanddevelopment,considerhow developmentmayimpactHighway539. 4.6.3WhenrequiredbyAlbertaTransportation,developersshallconductTrafficStudieswith respecttotheimpactandaccessontheHighway.AnyupgradingidentifiedbyaTraffic StudyconductedbyadeveloperwithrespecttotheHighwayshallbeimplementedbythe developeratitssolecostandtothesatisfactionofAlbertaTransportation. 4.7TelecommunicationsTowers/Utilities INTENT Thecontinueddemandforthelocationoftelecommunicationsinfrastructureandutilityservicing hasthepotentialtoimpactlandusewithinmunicipalities;however,themunicipalitiesareaware thatthejurisdictionofutilityapprovalsisoutsideoftheirdirectcontrol.Thefollowingpoliciesare tobeusedbythemunicipalitieswhenprovidingcommentstoapplicantsorrelevantagencies regardingapplicationswithinthePlanArea. POLICIES 4.7.1Wherethereisanapplicationforanew,expandedorretrofittedtelecommunicationstower withinthePlanArea,VulcanCountyandtheCountyofNewellshallnotifytheother municipalitytoseektheircomments. 4.7.2WhenprovidingaLetterofConcurrenceforanew,expandedorretrofitted telecommunicationstower,VulcanCountyandtheCountyofNewellshallrequest telecommunicationscompaniestocolocatewithinthePlanAreawheretechnicallyfeasible. VulcanCounty&CountyofNewell 14 IntermunicipalDevelopmentPlanBylawNo.2015008&BylawNo.182915 Page|14 4.7.3Whenprovidingcommentstoprovincialandfederaldepartmentsregardingutility developmentwithinthePlanArea,VulcanCountyandtheCountyofNewellshallrequest thatconsiderationbegiventotheestablishmentofutilitycorridorswithmultipleusers. 4.8NaturalEnvironment INTENT Bothmunicipalitiesrecognizetheconnectionbetweenthenaturalenvironmentandqualityoflife andstrivetoprotect,preserveandenhancenaturalsystemsandenvironmentallysignificantareas, whilepromotingappropriatedevelopment. POLICIES 4.8.1Whenmakinglandusedecisions,eachmunicipalitywill: a)utilizeandincorporatemeasureswhichminimizepossibleimpactson theBow Riverandanyotherimportantwaterresource; b)determineappropriatelandusepatternsinthevicinityofsignificantwater resourcesandotherwaterfeatures; c)establishappropriatesetbackstomaintainwaterquality,floodwaterconveyance andstorage,bankstabilityandhabitat. 4.8.2Landsthathavebeenidentifiedthatmaycontainanenvironmentallysignificantsitemaybe requiredtoconductanenvironmentalimpactassessment(EIA)andtheproponentshould contactAlbertaEnvironmentandParks. 4.8.3Landsthathavebeenidentifiedthatmaycontainahistoricresourcemayberequiredto conductahistoricalresourceimpactassessment(HRIA)andtheproponentshouldconsult theHistoricalResourcesActandAlbertaCultureandTourism.Bothmunicipalitiesshould giveconsiderationtotheMajorvilleGuidelinesforLandandResourceManagementwhere appropriate. 4.8.4BothmunicipalitiesshouldconsidertheprovincialWetlandPolicywhenmakinglanduse decisionswiththegoalofsustainingenvironmentandeconomicbenefits. 4.9Interpretation 4.8.1Unlessotherwiserequiredbythecontext,wordsusedinthepresenttenseincludethe futuretense;wordsusedinthesingularincludetheplural;andthewordpersonincludesa corporationaswellasanindividual.Unlessotherwisestipulated,the InterpretationAct, ChapterI8,RSA2000 asamended,shallbeusedintheinterpretationofthisbylaw.Words havethesamemeaningwhethertheyarecapitalizedornot. VulcanCounty&CountyofNewell 15 IntermunicipalDevelopmentPlanBylawNo.2015008&BylawNo.182915 Page|15 4.8.2Allreferencestoaspecificagency,body,ordepartmentwereaccurateatthetimeof writing.Itisunderstoodthatagency,bodyanddepartmentnameschangefromtimeto time.AllreferencesthroughoutthePlanshallthereforebeconsideredtobeapplicableto therelevantagency,bodyordepartment. 4.8.3Thegeographicalorrelativeboundariesoranyvariablepresentedonthemapscontainedin thisPlan,withtheexceptionoftheboundariesofthePlanArea,shallbeinterpretedasa roughapproximationandnotanaccuratedepictionofitsactualorfullextension.The OldmanRiverRegionalServicesCommission(ORRSC),therespectivemunicipalities,orthe council,administrationstafforagentsofeithermunicipalitydonotguaranteeorendorse theaccuracyofanyoftheinformationorinterpretationsthereofaspartofapprovalofthis Plan. VulcanCounty&CountyofNewell 16 IntermunicipalDevelopmentPlanBylawNo.2015008&BylawNo.182915 Page|16 5|PLANADMINISTRATION&IMPLEMENTATION 5.1IntermunicipalDevelopmentPlanCommitteePolicies INTENT TheimplementationofthisPlanisintendedtobeanongoingprocesstoensureitismaintainedand remainsapplicable.AnIntermunicipalDevelopmentPlanCommitteewithjointrepresentationwill ensurecontinueddialogueandcooperation,asthepurposeofthiscommitteeistopromoteactive cooperationandconflictresolutionthroughaconsensusbasedapproach. POLICIES 5.1.1ForthepurposesofadministeringandmonitoringtheIDP,VulcanCountyandtheCountyof NewellestablishtheIntermunicipalDevelopmentPlanCommittee(theCommittee),beinga workingcommittee,comprisedoftwo(2)membersofCouncilfrombothVulcanCountyand theCountyofNewell.EachmunicipalitymayappointanalternateCommitteememberin theeventaregularmembercannotattendascheduledmeeting.AlternateCommittee membersshallhavestanding.Quorumshallconsistoffour(4)votingmembers. 5.1.2ThetermofappointmentforCommitteemembersshouldbefour(4)years,coincidingwith theelectioncycle.Followingeachelection,MembersoftheCommitteeshallbeappointed byrespectiveCouncilsattheirOrganizationalMeeting.IfaCouncilwishestoappointanew membertotheCommittee(includingthealternate),theymustdosobymotionofCouncil ataregularCouncilmeeting.Themunicipalitiesshallnotifyoneanotheruponappointing membersandalternatememberstotheCommittee. 5.1.3VulcanCountyandtheCountyofNewellagreethatthemainfunctionsoftheCommittee areto: a)createaforumfordialogueonissuesofcommonconcernandinterest; b)addressconcernsregardingthepoliciesofthePlan; c)addressproposedamendmentstothePlan; d)addressrezoningapplications,changestolandusedistrictsorotherlanduse amendmentsaffectingthePlanArea; e)addressissuesinrelationtotheimplementationofPlanpolicies,andtoprovide commentsrelatedtosubdivisionand/ordevelopmentproposals; f)engageinresolvinganyconflictsordisputeswhicharisefromthistƌğƓΓĬƚƷŷ municipalitieswillequallysharecostsassociatedwithusingoutsideassistanceto resolveadispute;and g)addressanyotherlanduseissuesdeemedappropriate,butwhicharenotexplicitly identifiedinthePlan. VulcanCounty&CountyofNewell 17 IntermunicipalDevelopmentPlanBylawNo.2015008&BylawNo.182915 Page|17 5.1.4MeetingsoftheCommitteeshallbeheldonanͻğƭƓĻĻķĻķͼbasis,orattherequestofeither municipality.Committeemeetingsshouldbeheldasquicklyaspossibleifanyconflict arises,orifanymatterisbroughtbeforeit. 5.1.5AmunicipalitymaycallameetingoftheCommitteeatanytimeuponnotlessthanfive(5) days'noticeofthemeetingbeinggiventoallmembersoftheCommitteeandsupport personnel,statingthedate,thetime,purposeandtheplaceoftheproposedmeeting.The five(5)days'noticemaybewaivedwith¾oftheCommitteeƒĻƒĬĻƩƭ͸agreementnoted. 5.1.6ThemunicipalitythatcalledthemeetingoftheCommitteeshallhostandchairthemeeting andisresponsibleforpreparinganddistributingagendasandminutes. 5.1.7Atleastone(1)memberofeachƒǒƓźĭźƦğƌźƷǤ͸ƭadministrativestaffshouldattendeach meetinginthecapacityoftechnical,nonvotingadvisor. 5.1.8BothCouncilsagreetheCommitteeisnotadecisionmakingbodyandthattheCommittee shallissueawrittenresponseintheformofcommentsand/orrecommendationstothe appropriateandrelevantdecisionmakingbodywithin10businessdaysfromtheCommittee meetingdate. 5.1.9AnychangestotheCommitteeformat,composition,roles,responsibilitiesoranyaspectof itsexistenceoroperationmayberequestedbyeithermunicipality. 5.1.10WhereamatterhasbeenreferredtotheCommitteeandaresolutioncannotbefound,the DisputeResolutionprocessinSection6ofthisPlanshouldbeadheredto. 5.2IntermunicipalReferralPolicies INTENT ThepurposeofthisSectionistoestablishaclearandconsistentreferralprocesswherebyeach municipalityisabletoprovidecommentsonproposedchangestostatutoryandnonstatutoryplans aswellasproposedsubdivisionanddevelopmentapplicationswithinthePlanArea. POLICIES AddressingProvincialRegionalPlanningRequirements TheSouthSaskatchewanRegionalPlan(SSRP)hasbeencompletedandcameintoeffectSeptember 1,2014.Themunicipalitiesareunderthemandateofthislegislationandwillconsiderthefollowing inrespectoftheSSRPlegislation: 5.3.1Themunicipalitiesagreethattheywillcomplywiththeadoptedregionalplanstrategies,and areoftheopinionthisPlanalignswithstrategiesoftheSSRP. 5.3.2AfterthetƌğƓ͸ƭadoption,ifitissubsequentlydeterminedthatadditionalamendmentsare neededtothePlantoadheretoprovincialrequirementsoftheSSRP,bothmunicipalities willreviewanddiscusspossibleamendmentsthroughtheIntermunicipalDevelopmentPlan Committee. VulcanCounty&CountyofNewell 22 IntermunicipalDevelopmentPlanBylawNo.2015008&BylawNo.182915 Page|22 6.0|DISPUTERESOLUTIONPOLICIES 6.1GeneralDisputeProcess INTENT ThepoliciesofthisPlanaredesignedtobegeneralinnature,ensuringthatbothVulcanCountyand theCountyofNewellmaintainjurisdictionoverthedecisionsmadewithintheirborders.Itis anticipatedthatbyfollowingtheprocessbelow,anydisputesorconflictsthatmayarisecanfirstbe avoided,andwherenecessary,settledatthelocallevel.Onlyinthosecircumstanceswherea resolutioncannotbeachievedlocallywouldthedisputebereferredtooutsideparties. POLICIES GeneralAgreement Themunicipalitiesagreethat: 6.1.1ItisimportanttoavoiddisputebyensuringthatthePlanisadheredtoasadopted,including fullcirculationofanypermitorapplicationthatmayaffectthemunicipalityasrequiredin thePlanandpromptenforcementofthePlanpolicies. 6.1.2PriortothemeetingoftheCommittee,eachmunicipalitythroughitsadministration,will ensurethefactsoftheissuehavebeeninvestigatedandclarified,andinformationismade availabletobothparties.Staffmeetingsareencouragedtodiscusspossiblesolutions. 6.1.3TheCommitteeshoulddiscusstheissueordisputewiththeintenttoseekarecommended solutionbyconsensus. DisputeResolution Inthecaseofadispute,thefollowingprocessshallbefollowedtoarriveatasolution: 6.1.4Whenapotentialintermunicipalissuecomestotheattentionofeithermunicipalityrelating toatechnicalorproceduralmatter,suchasinadequatenotificationorprescribedtimelines, misinterpretationofPlanpolicies,oraclericalerrorregardingthepoliciesofthisPlan,either ƒǒƓźĭźƦğƌźƷǤ͸ƭLandUseBylaw,oranyotherplanaffectinglandsinthePlanarea,itwillbe directedtotheadministratorsofeachmunicipality.Theadministratorswillreviewthe technicalorproceduralmatterandifbothadministratorsareinagreement,takeactionto rectifythematter. 6.1.5ShouldeithermunicipalityidentifyanissuerelatedtothisPlanthatmayresultinadispute thatcannotbeadministrativelyresolvedunderSection6.1.4oranyotherissuethatmay resultinadispute,themunicipalityshouldcontacttheotherandrequestthatan VulcanCounty&CountyofNewell 23 IntermunicipalDevelopmentPlanBylawNo.2015008&BylawNo.182915 Page|23 IntermunicipalDevelopmentPlanCommitteemeetingbescheduledtodiscusstheissue. TheCommitteewillreviewtheissueandattempttoresolvethematterbyconsensus. 6.1.6ShouldtheIntermunicipalDevelopmentPlanCommitteebeunabletoarriveataconsensus, theadministrationofeachmunicipalitywillscheduleajointmeetingofthetwoCouncilsto discusspossiblesolutionsandattempttoreachconsensusontheissue. 6.1.7ShouldtheCouncilsbeunabletoresolvethematter,eithermunicipality,mayinitiatea formalmediationprocesstofacilitateresolutionoftheissue. FilinganIntermunicipalDisputeundertheMunicipalGovernmentAct 6.1.8Inthecaseofadisputeinvolvingtheadoptionofastatutoryplan,LandUseBylawor amendmenttosuch,within30daysofadoption,themunicipalityinitiatingthedisputemay, withoutprejudice,fileanappealtotheMunicipalGovernmentBoardundersection690(1) ofthe MGA sothattheprovincialstatutoryrightandtimeframetofileanappealisnotlost. 6.1.9Theappealmaythenbewithdrawn,withoutprejudice,ifasolutionoragreementisreached betweenthetwomunicipalitiespriortotheMunicipalGovernmentBoardmeeting.Thisis toacknowledgeandrespectthatthetimerequiredtoseekresolutionormediationmaynot beabletooccurwithinthe30dayappealfilingprocessasoutlinedinthe MGA. Agricultural Operation: If not defined in the municipality’s Land Use Bylaw, it is an agricultural activity conducted on agricultural land for gain or reward or in the hope or expectation of gain or reward, and can include, but is not limited to: a) the cultivation of land; b) the raising of livestock, including game-production animals within the meaning of the "Livestock Industry Diversification Act" and poultry; c) the raising of fur-bearing animals, pheasants or fish; d) the production of agricultural field crops; e) the production of fruit, vegetables, sod, trees, shrubs and other specialty horticultural crops; f) the production of eggs and milk; g) the production of honey (apiaries); h) the operation of agricultural machinery and equipment, including irrigation pumps on site; i) the application of fertilizers, insecticides, pesticides, fungicides, and herbicides, including application by ground and aerial spraying, for agricultural purposes; j) the collection, transportation, storage, application, use transfer and disposal of manure; k) the abandonment and reclamation of confined feeding operations and manure storage facilities. Alberta Land Stewardship Act (ALSA): Alberta Land Stewardship Act, Statues of Alberta 2009, Chapter A-26.8, as amended. Area Structure Plan (ASP): A statutory plan in accordance with the Municipal Government Act for the purpose of providing a framework for subsequent subdivision and development of an area of land in a municipality. The Plan typically provides a design that integrates land uses with the requirements for suitable parcel densities, transportation patterns (roads), storm water drainage, fire protection and other utilities across the entire Plan Area. Confined Feeding Operation (CFO): An activity on land that is fenced or enclosed or within buildings where livestock is confined for the purpose of growing, sustaining, finishing or breeding by means other than grazing and requires registration or approval under the conditions set forth in the Agricultural Operation Practices Act (AOPA), as amended from time to time, but does not include seasonal feeding and bedding sites. CFO Exclusion Area: The area within the Intermunicipal Development Plan where new confined feeding operations (CFOs) are not permitted to be established or existing operations allowed to expand. Vulcan County & County of Newell 26 Intermunicipal Development Plan Bylaw No. 2015-008 & Bylaw No. 1829-15 Appendix A Council(s): The Council of Vulcan County and the Council of the County of Newellin the Province of Alberta. Development: As defined by the Municipal Government Act in Part 17, section 616, means: a) an excavation or stockpile and the creation of either of them; b) a building or an addition to or replacement or repair of a building and the construction or placing of any of them on, in, over or under land; c) a change of use of land or a building or an act done in relation to land or a building that results in or is likely to result in a change in the use of the land or building; or d) a change in the intensity of the land or a building or an act done in relation to land or a building that results in or is likely to result in a change in the intensity of use of the land or building. Discretionary Use: The use of land or a building in a land use district for which a development permit may be approved at the discretion of the Development Authority with or without conditions. Dispute Settlement or Resolution: A formal process that provides the means by which differences of view between the parties can be settled, in a peaceful and cooperative manner. These differences may be over their opinion, interpretations, or actions of one party in regards to decision making in the IDP Plan Area or interpretation of IDP policies. Energy Industry or Development: Industry that uses some form of alternative energy either as the source of its operation or the result of its operation, such as, but not limited to, wind farms, solar farms, hydroelectric dams among others. Environmentally Significant Areas (ESAs): a) “Hazard” lands and areas which are unsuitable for development in their natural state such as floodplains, permanent wetlands, and steep and unstable slopes, or which pose severe constraints on types of development such as areas of artesian flow and aeolian surficial deposits; b) areas which perform a vital environmental, ecological or hydrological function such as aquifer recharge; c) areas which contain unique geological or physiographic features; d) areas which contain significant, rare or endangered species; e) areas which are unique habitats with limited representation in the region or are a small remnant of once large habitats which have virtually disappeared; f) areas which contain an unusual diversity of plant and/or animal communities due to a variety of geomorphological features and microclimatic effects; g) areas which contain large and relatively undisturbed habitats and provide sheltered habitat for species which are intolerant of human disturbance; h) areas which contain plants, animals or land forms which are unusual or of regional, provincial or national significance; i) areas which provide an important linking function and permit the movement of wildlife over considerable distance. Vulcan County & County of Newell 27 Intermunicipal Development Plan Bylaw No. 2015-008 & Bylaw No. 1829-15 Appendix A Extensive Agriculture:The general raising of crops and grazing of livestock in a non-intensive nature. Extractives or Renewable: Use of lands that are governed by the location of a natural resource such as, but not limited to, sand and gravel, oil and gas, or logging, which involves the extraction or onsite processing and/or storage of a natural resource. Historical Resource Value (HRV): Lands that contain or are believed to contain historic resources, including primarily archeological and paleontological sites, Aboriginal traditional use sites of a historic resource nature, and historic structures. Intensive Agriculture: If not defined in the respective municipality’s Land Use Bylaw, it is any concentrated method used to raise crops or to rear or keep livestock, animals, poultry or their products for market including, but not limited to, such operations as horse riding stables, poultry farms, pastures, rabbitries, fur farms, greenhouses, tree farms, sod farms, apiaries, dairies, nurseries and similar specialty uses conducted as the principal use of a building or site. Intermunicipal Border: The shared border between Vulcan County and the County of Newell. Intermunicipal Development Plan (IDP): A statutory document, adopted by bylaw in accordance with section 631 of the Municipal Government Act, which is used by municipalities as a long-range planning tool. Intermunicipal Development Plan Committee (The Committee): The members assigned by each respective Council for the purposes of administering and monitoring the Intermunicipal Development Plan. May: An operative word that means that there is a choice, with no particular direction or guidance intended. Municipalities (The Municipalities): The municipalities of Vulcan County and the County of Newell. Municipal Government Act (MGA): The Municipal Government Act, Revised Statues of Alberta 2000, Chapter M-26, as amended. Municipal Development Plan (MDP): A statutory plan, adopted by bylaw in accordance with section 632 of the Municipal Government Act and used by municipalities as a long-range planning tool. Permitted Use: The use of land or a building in a land use district for which a Development Authority shall issue a development permit with or without conditions providing all other provisions of the Bylaw are conformed with. Plan (The Plan): The Vulcan County and County of Newell Intermunicipal Development Plan. Plan Area: The lands defined in this document to which the policies of this document pertain. Vulcan County & County of Newell 28 Intermunicipal Development Plan Bylaw No. 2015-008 & Bylaw No. 1829-15 Appendix A Provincial Highway: A road development as such by Ministerial Order pursuant to the Highway Development and Protection Act(Alberta Regulation 326/2009). Ratepayer: A land owner within the municipality who pays taxes to the respective municipality and is considered a stakeholder in public matters relating to the municipality. Renewable Resource/Energy: A natural resource or form of energy that can replenish on its own with time. Shall: Is an operative word that means the action is mandatory. Should: Is an operative word that means that in order to achieve that Plan’s objectives, it is strongly advised that the action be taken. Soil Classifications: The classification of soils in accordance with the Canada Land Inventory on the basis of soil survey information, and are based on intensity, rather than kind, of their limitations for agriculture. Class 1 – Soils in this class have no significant limitations in use for crops Class 2 – Soils in this class have moderate limitations that restrict the range of crops or require moderate conservation practices Class 3 – Soils in this class have moderately severe limitations that restrict the range of crops or require special conservation practices Class 4 – Soils in this class have severe limitations that restrict the range of crops or require special conservation practices Class 5 – Soils in this class have very severe limitations that restrict their capability in producing perennial forage crops, and improvement practices are feasible Class 6 – Soils in this class are capable only of producing perennial forage crops, and improvement practices are not feasible Class 7 – Soils in this class have no capacity for arable culture or permanent pasture land South Saskatchewan Regional Plan (SSRP): The regional plan and regulations established by order of the Lieutenant Governor in Council pursuant to the Alberta Land Stewardship Act. Stakeholder: A person with an interest or concern in matters pertaining to this Plan. Statutory Plan: As per Part 17 of the Municipal Government Act, is an intermunicipal development plan, a municipal development plan, an area structure plan, or an area redevelopment plan adopted by a municipality under Division 4 of the MGA. Study Area: The area identified by both municipalities that encompasses areas of importance and concern and has been identified has an area where additional study took place in order to help define the parameters of the Plan Area.
