HomeMy WebLinkAbout1830-15 Inter-Municipal Development Plan (Wheatland County) (Consolidated to 1926-18)BYLAW NO. 1830-15 COUNTY OF NEWELL IN THE PROVINCE OF ALBERTA Bylaw No. 1830-15 of the County of Newell is for the purpose of adopting the County of Newell and Wheatland County Intermunicipal Development Plan in accordance with sections 631 and 692 of the Municipal Government Act, Revised Statutes of Alberta 2000, Chapter M-26, as amended. WHEREAS municipalities are encouraged by the province to expand intermunicipal planning efforts to address common planning issues and where the possible effects of development transcends municipal boundaries. AND WHEREAS both the Councils of the County of Newell and Wheatland County agree that it is to their mutual benefit to establish joint planning policies, and this negotiation and agreement reflects a continuing cooperative approach between the two municipalities and the desire to see well-planned, orderly, and managed growth. AND WHEREAS the municipality must prepare a corresponding bylaw and provide for its consideration at a public hearing. NOW THEREFORE, under the authority and subject to the provisions of the Municipal Government Act, Revised Statutes of Alberta 2000, Chapter M-26 as amended, the Council of the County of Newell duly assembled hereby enacts the following: 1. Council shall adopt the County of Newell and Wheatland County Intermunicipal Development Plan in consultation and as agreed to with Wheatland County. 2. This plan, upon adoption, shall be cited as the County of Newell and Wheatland County Intermunicipal Development Plan Bylaw No. 1830-15 and Bylaw No. 2015-14. 1|INTRODUCTION 1.1PurposeofthePlan ThepurposeoftheCountyofNewell&WheatlandCountyIntermunicipalDevelopmentPlan(also knownastheIDPorthePlan)istofosteraninterjurisdictionalapproachtoaddressplanningissueson landsthatconnectthesemunicipalities.ThePlanservesasameansforinformationexchangebetween themunicipalities,inaccordancewiththe AlbertaLandStewardshipAct,StatutesofAlberta2009, ChapterA26.8(ALSA)andthe MunicipalGovernmentAct,RevisedStatutesofAlberta2000,ChapterM 26,asamended(MGA). MunicipalitiesareencouragedtoworktogethertoadoptIDPsto: promoteconsultation,coordinationandcooperationregardingplanningmattersofjointinterest withinadefinedplanningarea; provideaframeworkforaddressinglanduseconcernswithregardtojointplanningmatters; establishprocedurefordealingwithdevelopmentproposalswithinadefinedplanningarea;and addressanyothermattersrelatingtodevelopmentconsiderednecessarywithinajointplanning area. AnIDPisaplanningtoolthatcanprovidenumerousbenefitstoparticipatingmunicipalities,whichmay include,butarenotlimitedtothefollowing: municipalcostsavings,asaresultofinfrastructureandservicesharing,whichalsoprovides residentswithahigherqualityoflife; reinforcingandprotectingbothƒǒƓźĭźƦğƌźƷźĻƭ͸developmentphilosophiesandgoalswhile mitigatingthepotentialforfutureintermunicipalconflict;and ensuringdevelopmentforbothmunicipalitiesoccursinanorderly,economic,efficientand harmoniousmannerthatissustainablebyconsideringexistingdevelopmentconditionsand futuremunicipalgoals. ThePlancontainspolicythatistobeusedasaframeworkforworkingcooperatively,communicating andmakingdecisionsineachmunicipality.Eachmunicipalityisultimatelyresponsibleformaking decisionswithintheirownmunicipaljurisdiction. CountyofNewell&WheatlandCounty IntermunicipalDevelopmentPlanBylawNo.183015&BylawNo.201514 Page|1 1.2MunicipalProfiles CountyofNewell TheCountyofNewellspansanareaofapproximately620,000hectares(1.5millionacres)witha populationof7,524(AlbertaMunicipalAffairs,2017).TheCountyofNewellsurroundsfoururban municipalities,containstenhamletsandisborderedbyfourmunicipalities,oneSpecialAreaandone FirstNation.TheeconomyoftheCountyofNewellisbasedonagricultureandenergyresource development.TheCountyofNewellincludesseverallargereservoirs,thetwolargestbeingLakeNewell andCrawlingValley,whichprovideirrigationandrecreationalopportunities. WheatlandCounty WheatlandCountycoversanareaofapproximately460,000hectares(1.1millionacres),witha populationof8,788(AlbertaMunicipalAffairs,2017).WheatlandCountysurroundsfoururban municipalities,containstwelvehamletsandanumberofothercommunitiesnotofficiallydesignatedas hamlets.TheCountyisborderedbyfiveruralmunicipalities,oneurbanmunicipalityandoneFirst Nation.TheeconomyofWheatlandCountyisbasedonagriculture,includingbeefandgrainproduction. Inrecentyearsindustry,manufacturing,oilandgashaveplayedkeyrolesinthe/ƚǒƓƷǤ͸ƭeconomic growth.AportionofWheatlandCountyisincludedintheCalgaryMetropolitanRegionBoard(CMRB), establishedbyregulation190/2017,butonlythosepartsoftheCountyclosetotheCalgaryregionwill besubjecttothegrowthplanasoutlinedintheCMRBregulationandthelandssubjecttothis intermunicipaldevelopmentplanfalloutsideoftheCMRBboundary. Specificallythe MGA states: 631(1)Twoormorecouncilsofmunicipalitiesthathavecommonboundariesthatarenotmembersofa growthregionasdefinedinsection708.01must,byeachpassingabylawinaccordancewiththisPartor inaccordancewithsections12and692,adoptanintermunicipaldevelopmentplantoincludethoseareas oflandlyingwithintheboundariesofthemunicipalitiesastheyconsidernecessary. (1.1)Despitesubsection(1),theMinistermay,byorder,exemptoneormorecouncilsfromthe requirementtoadoptanintermunicipaldevelopmentplan,andtheordermaycontainanytermsand conditionsthattheMinisterconsidersnecessary. (1.2)Twoormorecouncilsofmunicipalitiesthatarenototherwiserequiredtoadoptanintermunicipal developmentplanundersubsection(1)may,byeachpassingabylawinaccordancewiththisPartorin accordancewithsections12and692,adoptanintermunicipaldevelopmentplantoincludethoseareasof landlyingwithintheboundariesofthemunicipalitiesastheyconsidernecessary. (2)Anintermunicipaldevelopmentplan (a)mustaddress (i)thefuturelandusewithinthearea, (ii)themannerofandtheproposalsforfuturedevelopmentinthearea, (iii)theprovisionoftransportationsystemsforthearea,eithergenerallyorspecifically, (iv)thecoordinationofintermunicipalprogramsrelatingtothephysical,socialandeconomic developmentofthearea, (v)environmentalmatterswithinthearea,eithergenerallyorspecifically,and (vi)anyothermatterrelatedtothephysical,socialoreconomicdevelopmentoftheareathat thecouncilsconsidernecessary, and (b)mustinclude (i)aproceduretobeusedtoresolveorattempttoresolveanyconflictbetweenthe municipalitiesthathaveadoptedtheplan, (ii)aproceduretobeused,byoneormoremunicipalities,toamendorrepealtheplan,and theadministrationoftheplan. (iii)provisionsrelatingto (3)Thecouncilofamunicipalitythatisrequiredunderthissectiontoadoptanintermunicipal developmentplanmusthaveanintermunicipaldevelopmentplanthatprovidesforallofthematters referredtoinsubsection(2)within2yearsfromthedatethissubsectioncomesintoforce. (5)Increatinganintermunicipaldevelopmentplan,themunicipalitiesmustnegotiateingoodfaith. Inadditiontothe MGA,theSouthSaskatchewanRegionalPlan(SSRP)cameintoeffectSeptember1, 2014.TheSSRPusesacumulativeeffectsmanagementapproachtosetpolicydirectionfor municipalitiestoachieveenvironmental,economicandsocialoutcomeswithintheSouthSaskatchewan Regionuntil2024. Pursuanttosection13ofthe AlbertaLandStewardshipAct,regionalplansarelegislativeinstruments. TheSSRPhasfourkeypartsincludingtheIntroduction,StrategicPlan,ImplementationPlanand RegulatoryDetailsPlan.Pursuanttosection15(1)of ALSA,theRegulatoryDetailsoftheSSRPare enforceableaslawandbindtheCrown,decisionmakers,localgovernmentsandallotherpersonswhile theremainingportionsarestatementsofpolicytoinformandarenotintendedtohavebindinglegal effect. TheRegionalPlanisguidedbythevision,outcomesandintendeddirectionssetbytheStrategicPlan portionoftheSSRP,whiletheImplementationPlanestablishestheobjectivesandthestrategiesthat willbeimplementedtoachievetheregionalvision.AspartoftheImplementationPlan,Section8: CommunityDevelopmentincludesguidanceregardingPlanCooperationandIntegrationbetween municipalitieswiththeintentiontofostercooperationandcoordinationbetweenneighbouring municipalitiesandbetweenmunicipalitiesandprovincialdepartments,boardsandagencies.Section8 containsthefollowingbroadobjectivesandstrategies. Objectives Cooperationandcoordinationarefosteredamongalllanduseplannersanddecisionmakers involvedinpreparingandimplementinglandplansandstrategies. Knowledgesharingamongcommunitiesisencouragedtopromotetheuseofplanningtoolsand theprinciplesofefficientuseoflandtoaddresscommunitydevelopmentintheregion. Strategies 8.1 Worktogethertoachievethesharedenvironmental,economic,andsocialoutcomesintheSouth SaskatchewanRegionalPlanandminimizenegativeenvironmentalcumulativeeffects. 8.2 Addresscommonplanningissues,especiallywherevaluednaturalfeaturesandhistoricresources areofintereststomorethanonestakeholderandwherethepossibleeffectofdevelopment transcendsjurisdictionalboundaries. 8.3 Coordinateandworkwitheachotherintheirrespectiveplanningactivities(suchasinthe developmentofplansandpolicies)anddevelopmentapprovalprocesstoaddressissuesof mutualinterest. thephysicalinfrastructure 8.4 Worktogethertoanticipate,planandsetasideadequatelandwith andservicesrequiredtoaccommodatefuturepopulationgrowthandaccompanyingcommunity developmentneeds. CountyofNewell&WheatlandCounty IntermunicipalDevelopmentPlanBylawNo.183015&BylawNo.201514 Page|4 8.5 Buildawarenessregardingtheapplicationoflanduseplanningtoolsthatreducetheimpactof residential,commercialandindustrialdevelopmentsontheland,includingapproachesandbest practicesforpromotingtheefficientuseofprivateandpubliclands. 8.6 Pursuejointuseagreements,regionalservicescommissionsandanyotherjointcooperative arrangementsthatcontributespecificallytointermunicipallanduseplanning. 8.7 Considerthevalueofintermunicipaldevelopmentplanningtoaddresslanduseonfringeareas, airportvicinityprotectionplanorotherareasofmutualinterest. 8.8 CoordinatelanduseplanningactivitieswithFirstNations,irrigationdistricts,schoolboards, andotheragenciesonareasofmutualinterest. healthauthorities TheabovestrategieswereconsideredbybothmunicipalitieswhendevelopingpolicywithinthisIDPand willbeconsideredwhenrenderinglandusedecisionspertainingtodevelopmentwithinthePlanArea. OtherstrategiescontainedintheSSRPshouldbeconsideredinthecontextofeachruralƒǒƓźĭźƦğƌźƷǤ͸ƭ MunicipalDevelopmentPlan,LandUseBylaworthroughpoliciesfoundwithinthisPlan. 1.4PlanPreparationProcess TheformationofthePlanwasguidedbytheIDPReviewCommitteeasestablishedbytherespective municipalities.TheReviewCommitteewascomposedoftwoCouncilmembersfromeachmunicipality. Senioradministrationfrombothmunicipalitieswerealsoinvolvedthroughouttheprocessastechnical advisors.Withrespecttocommitteedecisionmaking,bothpartiesagreedattheoutsetoftheprocess thattheirchosendecisionmakingmodelwouldbebasedonreachingconsensusontheissues discussed. PriortoidentifyingareasofimportanceandconcernwiththeReviewCommittee,plannersfromORRSC metwitheachmunicipalityprivatelytoclarifytheirmunicipalperspectivesongeneralissues.Onceeach ƒǒƓźĭźƦğƌźƷǤ͸ƭperspectiveswereidentified,adraftdocumentwaspreparedforreviewbytheReview Committee.Anoutlineoftheprojectpurpose,process,ideasandconceptswasthenreviewedwith affectedlandowners,stakeholdersandthegeneralpublicatanOpenHouse. AftertheOpenHousetheReviewCommitteeandeachmunicipalCouncilreviewedthedraft;arefined documentwasthenpreparedandsubmittedfortheReview/ƚƒƒźƷƷĻĻ͸ƭfinalapproval.Uponapproval, thefinaldraftdocumentwasthenforwardedtoeachCouncilforreview.Asrequiredbythe MGA, mandatorypublichearingswereheldbyeachCouncilandsubsequenttothepublichearings,theIDP wasadoptedbyeachmunicipalityunderseparatemunicipalbylaws.Bothmunicipalitiesthenappointed twoCouncilorstotheIntermunicipalDevelopmentPlanCommitteetoensurecontinueddialogueand cooperationthroughoutthecontinueduseofthisPlan. CountyofNewell&WheatlandCounty IntermunicipalDevelopmentPlanBylawNo.183015&BylawNo.201514 Page|6 2|PLANAREA 2.1StudyAreaAnalysis TodeterminetheextentofthePlanArea,themunicipalitiesbeganbyanalyzingaStudyArea approximately5km(3miles)oneithersideofthesharedborder.Thefollowingkeyfeaturesinthe StudyAreawereexamined: ResidencesandUrbanAreas LandUseDesignations SurfaceWater ConfinedFeedingOperations(CFOs) Active/PotentialSitesforSurfaceMaterialsExtraction TransportationCorridors CanadaLandInventory(CLI)SoilIndex EnvironmentallySignificantAreas(ESAs) HistoricalResourceValue(HRV)Sites MapsoftheabovefeaturescanbefoundinAppendixB. 2.2DefiningtheIntermunicipalDevelopmentPlanArea AftercarefulreviewbytheCommittee,themunicipalitiesusedtheStudyAreaanalysistohelpdefine theIntermunicipalDevelopmentPlanArea(alsoreferredtoasthePlanArea).Itwasdeterminedthat duetotheconsistencyofkeycharacteristicswithintheStudyArea,thataPlanAreaBoundaryofabout 3.2km(2miles)oneithersideoftheintermunicipalborderwouldnotonlyencompasskey characteristicsofthearea,butwouldmakeforaconsistentPlanArea.ThePlanAreaconsistsof approximately47,609hectares(76,619acres)andisillustratedinMap2. KeycharacteristicsofthePlanAreaincludethefollowing: Agriculture o Agricultureistheprimarylanduseofthearea. o Thereisamixofagriculturaloperationsincludinggrazingandconfinedfeeding operations. o IrrigatedagriculturalpracticesoccurmainlyintheCountyofNewell. ResidentialDevelopment patternsof o Residentialdevelopmentoccurssparselythroughoutwithnosignificant residentialdevelopment. o ThecommunitiesofMakepeaceandCrowfootarelocatedwithinthePlanArea. POLICIES 4.1.1Themunicipalities,asperthisplan,shallstrivetoengageineffectivedialoguewhen consideringlanduseinthePlanArea,whilestillmaintainingcompletejurisdictiononlands withintheirownboundaries. 4.1.2Themunicipalitiesmaycollaborateandinvestigatemethodsofgivingsupporttoprojects thatmaymutuallybenefitorenhancethequalityoflifeofresidentsfromboth municipalities.Thiscouldbeintheformofinkinddonations,materials,municipallettersof support,unifiedgovernmentlobbying,applicationforgrants,orothermorepermanent arrangementsifbothmunicipalitiesagreeandenterintodiscussionsandmakespecific agreementsforsuch. 4.1.3Bothmunicipalitiesagreetojointlydiscusswaystocooperatewithprovincialandfederal agenciesandutilityproviderstohelpfacilitatetheefficientdeliveryofinfrastructureand servicesthatareofamutualbenefit. 4.1.4TheCountyofNewellandWheatlandCountyshallstrive,tothebestoftheirabilityand knowledge,toreferallnoticesofgovernmentprojectswithinthePlanAreatotheadjacent municipality. 4.1.5Bothmunicipalitiesareencouragedtosharewiththeadjacentmunicipality,theresultsofall publiclyavailabletechnicalanalysesrequiredbyaSubdivisionandDevelopmentAuthority aspartofanapplication,wherethereisthepotentialforimpactsonlandsandbodiesof waterwithintheadjacentmunicipality. POLICIES 4.2.1AgriculturewillcontinuetobethepredominantlanduseinthePlan Area.Theimpacton agriculturalusesshouldbeaconsiderationwhendeterminingsuitabilityofnonagricultural landusesinthePlanArea. 4.2.2Bothmunicipalitieswillstrivetoworkcooperativelytoencouragegoodneighbourfarming practices,suchasdust,weedandinsectcontrol,adjacenttodevelopedareasthroughbest managementpracticesandAlbertaAgricultureguidelines. 4.2.3Ifdisputesorcomplaintsineithermunicipalityshouldarisebetweenratepayersand agriculturaloperators,themunicipalityreceivingthecomplaintshallstrivetodirectthe affectedpartiestotheappropriateagency,governmentdepartmentormunicipalityfor consultationorresolutionwherevernecessary. 4.3ConfinedFeedingOperations INTENT ThemunicipalitiesrecognizethatitisthejurisdictionoftheNaturalResourcesConservationBoard (NRCB)tograntapprovalsandregulateCFOs.However,bothmunicipalitiesagreeitisdesirableto specificallyregulateintensiveagriculturaloperationsforthedefinedPlanAreainanattemptto minimizepotentialnuisanceandconflict. POLICIES 4.3.1ExistingCFOslocatedwithinthePlanAreawillbeallowedtocontinuetooperateunder acceptableoperatingpracticesandwithintherequirementsofthe AgriculturalOperation PracticesAct andRegulations. 4.3.2IfeithertheCountyofNewellorWheatlandCountyareinreceiptofanapplicationfornew orexpandedCFOswithinthePlanArea,theyshallforwardacopyoftheapplicationtothe othermunicipality. POLICIES 4.4.1Themunicipalitiesshallconsidertheeffectsofvisualintrusion,dust,noise,traffic,andair andwaterpollutionwhenevaluatingapplicationsfor neworexpandedgravelpits,orother extractiveactivities,wheretheymaintainjurisdiction. 4.4.2Ifeithermunicipalityisinreceiptofanoticeofapplicationforaneworexpandedgravelpit withinthePlanArea,theyshallforwardacopyofthenoticetotheothermunicipality. 4.4.3Eachmunicipalitymustbenotifiedofanyresourcedevelopmentproposalintheother municipalitythatwillresultinaccessbeingrequiredfromaroadunderitscontrolor management.Administrationfrombothmunicipalitiesareencouragedtodialogue regardingthepotentialimpactstheproposeddevelopmentmayhaveontheaffected ƒǒƓźĭźƦğƌźƷǤ͸ƭroadspriortotheacceptanceoftheapplicationascomplete. 4.4.4Eithermunicipalitymayrequireanagreementregardingtheconstruction,repair,and maintenanceofanymunicipalroadswhichmaybeimpactedbyresourcedevelopment, whenthedevelopmentrequiresaccessfromtheotherƒǒƓźĭźƦğƌźƷǤ͸ƭroad. 4.4.5IfeithertheCountyofNewellorWheatlandCountyareinreceiptofanoticeforanewor expandedAlbertaTransportationgravelpitwithinthePlanArea,theyshallforwardacopy ofthenoticetotheothermunicipality. 4.5RenewableEnergyDevelopment INTENT TheCountyofNewellandWheatlandCountyrecognizetheimportantrolethatindustryandenergy developmentplayinsupportingthelocalandregionaleconomy.ThepoliciesinthisSectionaddress theneedtoensurethecompatibilityoflanduses. POLICIES 4.5.1ThemunicipalitiesencouragethelocationofRenewableEnergydevelopmentswithinthe PlanArea: a)wherecompatiblewithexistinglanduses,and b)inconsiderationofcommentsfromtheadjacentmunicipality. CountyofNewell&WheatlandCounty IntermunicipalDevelopmentPlanBylawNo.183015&BylawNo.201514 Page|12 4.5.2Eithermunicipalityshallreferanyapplicationforarenewableenergydevelopmentwithin thePlanAreaincludingbutnotlimitedto: windfarms, hydroelectricdevelopment, solarpower, or otherrelatedandsimilardevelopments, totheothermunicipality. 4.6TransportationandRoadNetworks INTENT Asmultipleprovincialhighwaysandmunicipalroadsconnectthetwomunicipalities,theCountyof NewellandWheatlandCountyagreeontheimportanceofconsideringtheimpactofdevelopment onmunicipalandprovincialroadinfrastructurewithinthePlanArea. POLICIES 4.6.1Eachmunicipalityshallbenotifiedofanysubdivisionordevelopmentproposalintheother municipalitythatwillresultinaccessbeingrequiredfromaroadunderitscontrolor management.Administrationfrombothmunicipalitiesareencouragedtodialogue regardingthepotentialimpactstheproposeddevelopmentmayhaveontheaffected ƒǒƓźĭźƦğƌźƷǤ͸ƭroadspriortotheacceptanceoftheapplicationascomplete. 4.6.2EithermunicipalitymayrequireadevelopertoenterintoaRoadUseManagement Agreementtocontroltraffic,managedustcontrolormaintenanceissuesifaccesstothe developmentisrequiredfromaroadunderitscontrolorjurisdiction. 4.6.3WhenrequiredbyAlbertaTransportation,developersshallconducttrafficstudieswith respecttotheimpactandaccessonthehighway.Anyupgradingidentifiedbyatrafficstudy conductedbyadeveloperwithrespecttothehighwayshallbeimplementedbythe developeratitssolecostandtothesatisfactionofAlbertaTransportation. 4.7TelecommunicationTowers/Utilities INTENT Thecontinueddemandforthelocationoftelecommunicationsinfrastructureandutilityservicing hasthepotentialtoimpactlandusewithinmunicipalities;however,themunicipalitiesareaware thatthejurisdictionofutilityapprovalsisoutsideoftheirdirectcontrol.Thefollowingpoliciesare tobeusedbythemunicipalitieswhenprovidingcommentstoapplicantsorrelevantagencies regardingapplicationswithinthePlanArea. CountyofNewell&WheatlandCounty IntermunicipalDevelopmentPlanBylawNo.183015&BylawNo.201514 Page|13 POLICIES 4.7.1Wherethereisanapplicationforanew,expandedorretrofittedtelecommunicationstower withinthePlanArea,theCountyofNewellandWheatlandCountyshallnotifytheother municipalitytoseektheircomments. 4.7.2WhenprovidingaLetterofConcurrenceforanew,expandedorretrofitted telecommunicationstower,theCountyofNewellandWheatlandCountyshallrequest telecommunicationscompaniestocolocatewithinthePlanAreawheretechnicallyfeasible. 4.7.3Whenprovidingcommentstoprovincialdepartmentsregardingutilitydevelopmentwithin thePlanArea,theCountyofNewellandWheatlandCountyshallrequestthatconsideration begiventotheestablishmentofutilitycorridorswithmultipleusers. 4.8NaturalEnvironment INTENT Bothmunicipalitiesrecognizetheconnectionbetweenthenaturalenvironmentandqualityoflife andstrivetoprotect,preserveandenhancenaturalsystemsandenvironmentallysignificantareas, whilepromotingappropriatedevelopment. POLICIES 4.8.1Whenmakinglandusedecisions,eachmunicipalitywill: a)utilizeandincorporatemeasureswhichminimizepossibleimpactsontheBowand RedDeerRiversandanyotherimportantwaterresource; b)determineappropriatelandusepatternsinthevicinityofsignificantwater resourcesandotherwaterfeatures; c)establishappropriatesetbackstomaintainwaterquality,floodwaterconveyance andstorage,bankstabilityandhabitat. 4.8.2Landsthathavebeenidentifiedthatmaycontainanenvironmentallysignificantsitemaybe requiredtoconductanenvironmentalimpactassessment(EIA)andtheproponentshould contactAlbertaEnvironmentandParks. 4.8.3Landsthathavebeenidentifiedthatmaycontainahistoricresourcemayberequiredto conductahistoricalresourceimpactassessment(HRIA)andtheproponentshouldconsult the HistoricalResourcesAct andAlbertaCultureandTourism. 4.8.4BothmunicipalitiesshouldconsidertheprovincialWetlandPolicywhenmakinglanduse decisionswiththegoalofsustainingenvironmentandeconomicbenefits. CountyofNewell&WheatlandCounty IntermunicipalDevelopmentPlanBylawNo.183015&BylawNo.201514 Page|14 4.9Interpretation INTENT ToensurethepoliciesandlanguagewithinthisPlanarecommunicatedinthepropercontextsoas toensuretheintentofthePlanisasclearandconciseaspossible. POLICIES 4.9.1Unlessotherwiserequiredbythecontext,wordsusedinthepresenttenseincludethe futuretense;words usedinthesingularincludetheplural;andthewordpersonincludesa corporationaswellasanindividual.Unlessotherwisestipulated,the InterpretationAct, ChapterI8,RSA2000 asamended,shallbeusedintheinterpretationofthisbylaw.Words havethesamemeaningwhethertheyarecapitalizedornot. 4.9.2Allreferencestoaspecificagency,body,ordepartmentwereaccurateatthetimeof writing.Itisunderstoodthatagency,bodyanddepartmentnameschangefromtimeto time.AllreferencesthroughoutthePlanshallthereforebeconsideredtobeapplicableto thecurrentrelevantagency,bodyordepartment. 4.9.3Thegeographicalorrelativeboundariesoranyvariablepresentedonthemapscontainedin thisPlan,withtheexceptionoftheboundariesofthePlanArea,shallbeinterpretedasa roughapproximationandnotanaccuratedepictionofitsactualorfullextension.The OldmanRiverRegionalServicesCommission(ORRSC),therespectivemunicipalities,orthe Council,administrationstafforagentsofeithermunicipalitydonotguaranteeorendorse theaccuracyofanyoftheinformationorinterpretationsthereofaspartofapprovalofthis Plan. CountyofNewell&WheatlandCounty IntermunicipalDevelopmentPlanBylawNo.183015&BylawNo.201514 Page|15 5|PLANADMINISTRATION&IMPLEMENTATION 5.1IntermunicipalDevelopmentPlanCommitteePolicies INTENT TheimplementationofthisPlanisintendedtobeanongoingprocesstoensureitismaintainedand remainsapplicable.Acommitteewithjointrepresentationwillensurecontinueddialogueand cooperation,asthepurposeofthiscommitteeistopromoteactivecooperationandconflict resolutionthroughaconsensusbasedapproach. POLICIES 5.1.1ForthepurposesofadministeringandmonitoringtheIDP,theCountyofNewelland WheatlandCountyestablishtheIntermunicipalDevelopmentPlanCommittee(the Committee)comprisedoftwo(2)membersofCouncilfromboththeCountyofNewelland WheatlandCounty.EachmunicipalitymayappointanalternateCommitteememberinthe eventaregularmembercannotattendascheduledmeeting.AlternateCommittee membersshallhavestanding.Quorumshallconsistoffour(4)votingmembers. 5.1.2ThetermofappointmentforCommitteemembersshouldbefour(4)years,coincidingwith theelectioncycle.Followingeachelection,MembersoftheCommitteeshallbeappointed byrespectiveCouncilsattheirOrganizationalMeeting.IfaCouncilwishestoappointanew membertotheCommittee(includingthealternate),theymustdosobymotionofCouncil ataregularCouncilmeeting.Themunicipalitiesshallnotifyoneanotheruponappointing membersandalternatememberstotheCommittee. 5.1.3TheCountyofNewellandWheatlandCountyagreethatthemainfunctionsofthe Committeeareto: a)createaforumfordialogueonissuesofcommonconcernandinterest; b)addressconcernsregardingthepoliciesofthePlan; c)addressproposedamendmentstothePlan; d)addressrezoningapplications,changestolandusedistrictsorotherlanduse amendmentsaffectingthePlanArea; e)addressissuesinrelationtotheimplementationofPlanpolicies,andtoprovide commentsrelatedtosubdivisionand/ordevelopmentproposals; f)engageinresolvinganyconflictsordisputeswhicharisefromthistƌğƓΓĬƚƷŷ municipalitieswillequallysharecostsassociatedwithusingoutsideassistanceto resolveadispute;and g)addressanyotherlanduseissuesdeemedappropriate,butwhicharenotexplicitly identifiedinthePlan. CountyofNewell&WheatlandCounty IntermunicipalDevelopmentPlanBylawNo.183015&BylawNo.201514 Page|16 5.1.4MeetingsoftheCommitteeshallbeheldonan"asneededbasis",orattherequestofeither municipality.Committeemeetingsshouldbeheldassoonaspossibleifanyconflictarises, orifanymatterisbroughtbeforeit. 5.1.5AmunicipalitymaycallameetingoftheCommitteeatanytimeuponnotlessthanfive(5) days'noticeofthemeetingbeinggiventoallmembersoftheCommitteeandsupport personnel,statingthedate,thetime,purposeandtheplaceoftheproposedmeeting.The five(5)days'noticemaybewaivedwith¾oftheCommitteeƒĻƒĬĻƩƭ͸agreementnoted. 5.1.6ThemunicipalitythatcalledthemeetingoftheCommitteeshallhostandchairthemeeting andisresponsibleforpreparinganddistributingagendasandminutes. 5.1.7Atleastone(1)memberofeachƒǒƓźĭźƦğƌźƷǤ͸ƭadministrativestaffshouldattendeach meetinginthecapacityoftechnical,nonvotingadvisor. 5.1.8BothCouncilsagreetheCommitteeisnotadecisionmakingbodyandthattheCommittee shallissueawrittenresponseintheformofcommentsand/orrecommendationstothe appropriateandrelevantdecisionmakingbodywithin10businessdaysfromtheCommittee meetingdate. 5.1.9AnychangestotheCommitteeformat,composition,roles,responsibilitiesoranyaspectof itsexistenceoroperationmayberequestedbyeithermunicipality. 5.1.10WhereamatterhasbeenreferredtotheCommitteeandaresolutioncannotbefound,the DisputeResolutionprocessinSection6ofthisPlanshouldbeadheredto. POLICIES General 5.2.1Whereanintermunicipalreferralisrequiredbythe MGA orthepoliciescontainedinthis Plan,bothmunicipalitiesagreetosharemailingaddressandpropertyownership informationforcirculationpurposeswiththeadjacentmunicipality,andwhereapplicable, theƒǒƓźĭźƦğƌźƷǤ͸ƭprocessingagency. 5.2.2Whereaplanorbylaw,includingamendments,orapplication,requiresnotificationstobe senttoamunicipalitythatisexternaltothisIDP,thereferringmunicipalityshallfollowthe referralrequirementsoutlinedinthe MGA,orwhereapplicable,thosecontainedina relevantIntermunicipalDevelopmentPlan. 5.2.3AdministrativestafforrepresentativesfortheCountyofNewellandWheatlandCountyare encouragedtodiscuss,withoneanother,forthcomingStatutoryPlansandLandUseBylaws, includingamendments,whichmayimpactthePlanArea. 5.2.4AdministrativestafforrepresentativesfortheCountyofNewellandWheatlandCountyare encouragedtodiscusswithoneanotherforthcomingsubdivisionanddevelopment applicationsthatmayimpactlandswithinthePlanArea. 5.2.5Ifeithermunicipalityisinreceiptofareferral,priortotheholdingofamandatorypublic hearing,thereceivingmunicipalityshallpresenttheircommentsandconcernsattheother ƒǒƓźĭźƦğƌźƷǤ͸ƭpublichearing. POLICIES AddressingProvincialRegionalPlanningRequirements TheSouthSaskatchewanRegionalPlan(SSRP)hasbeencompletedandcameintoeffectSeptember 1,2014.Themunicipalitiesareunderthemandateofthislegislationandwillconsiderthefollowing inrespectoftheSSRPlegislation: 5.3.1Themunicipalitiesagreethattheywillcomplywiththeadoptedregionalplanstrategies,and areoftheopinionthisPlanalignswithstrategiesoftheSSRP. CountyofNewell&WheatlandCounty IntermunicipalDevelopmentPlanBylawNo.183015&BylawNo.201514 Page|22 6|DISPUTERESOLUTION 6.1GeneralDisputeProcess INTENT ThepoliciesofthisPlanaredesignedtobegeneralinnature,ensuringthatboththeCountyof NewellandWheatlandCountymaintainjurisdictionoverthedecisionsmadewithintheirborders.It isanticipatedthatbyfollowingtheprocessbelow,anydisputesorconflictsthatmayarisecanfirst beavoided,andwherenecessary,settledatthelocallevel.Onlyinthosecircumstanceswherea resolutioncannotbeachievedlocallywouldthedisputebereferredtooutsideparties. POLICIES GeneralAgreement Themunicipalitiesagreethat: 6.1.1ItisimportanttoavoiddisputebyensuringthatthePlanisadheredtoasadopted,including fullcirculationofanypermitorapplicationthatmayaffectthemunicipalityasrequiredin thePlanandpromptenforcementofthePlanpolicies. 6.1.2PriortothemeetingoftheCommittee,eachmunicipalitythroughitsadministration,will ensurethefactsoftheissuehavebeeninvestigatedandclarified,andinformationismade availabletobothparties.Staffmeetingsareencouragedtodiscusspossiblesolutions. 6.1.3TheCommitteeshoulddiscusstheissueordisputewiththeintenttoseekarecommended solutionbyconsensus. DisputeResolution Inthecaseofadispute,thefollowingprocesswillbefollowedtoarriveatasolution: 6.1.4Whenapotentialintermunicipalissuecomestotheattentionofeithermunicipalityrelating toatechnicalorproceduralmatter,suchasinadequatenotificationorprescribedtimelines, misinterpretationofPlanpolicies,oraclericalerrorregardingthepoliciesofthisPlan,either ƒǒƓźĭźƦğƌźƷǤ͸ƭLandUseBylaw,oranyotherplanaffectinglandsinthePlanarea,itwillbe directedtotheadministratorsofeachmunicipality.Theadministratorswillreviewthe technicalorproceduralmatterandifbothadministratorsareinagreement,takeactionto rectifythematter. 6.1.5ShouldeithermunicipalityidentifyanissuerelatedtothisPlanthatmayresultinadispute thatcannotbeadministrativelyresolvedoranyotherissuethatmayresultinadispute,the municipalityshouldcontacttheotherandrequestthataCommitteemeetingbescheduled CountyofNewell&WheatlandCounty IntermunicipalDevelopmentPlanBylawNo.183015&BylawNo.201514 Page|23 todiscusstheissue.TheCommitteewillreviewtheissueandattempttoresolvethematter byconsensus. 6.1.6ShouldtheCommitteebeunabletoarriveataconsensus,theadministrationofeach municipalitywillscheduleajointmeetingofthetwoCouncilstodiscusspossiblesolutions andattempttoreachconsensusontheissue. 6.1.7ShouldtheCouncilsbeunabletoresolvethematter,aformalmediationprocesstofacilitate resolutionoftheissueshallbeinitiated.
