IN THE PROVINCE OF ALBERTA
BYLAW NO. 1959-19
A BYLAW OF THE COUNTY OF NEWELL IN THE PROVINCE OF ALBERTA TO
ESTABLISH ASSESSMENT REVIEW BOARDS.
WHEREAS, the Municipal Government Act, R.S.A. 2000, Chapter M-26 as
amended, authorizes the establishment of Assessment Review Boards;
AND WHEREAS, the Municipal Government Act, R.S.A. 2000, Chapter M-26 as
amended, authorizes two or more Councils to establish jointly the Assessment
Review Boards to have jurisdiction in their municipalities.
NOW THEREFORE, the Council of the County of Newell in the Province of Alberta
hereby enacts as follows:
TITLE
1. This Bylaw may be cited as the "Assessment Review Boards Bylaw".
DEFINITIONS:
2. In this Bylaw;
(a) "Chair" means the member of the Regional Assessment Review
Board that has been appointed by each participating municipality to
fill the responsibilities of the Regional ARB Chair as outlined in
Sections 454 & 455 of the Municipal Government Act.
(b) "Council" means the Municipal Council of the County of Newell;
(c) "Member" means a member of an Assessment Review Board duly
appointed by Council or the Province, in accordance with the
Municipal Government Act, R.S.A. 2000, Chapter M — 26 as
amended;
(d) "Regional Assessment Review Boards Agreement" means the
Agreement signed by municipalities within the County of Newell,
agreeing to participate in the establishment of Regional Assessment
Review Boards.
(e) "Regional Pool" means the group of Assessment Review Board
members duly appointed by the Councils of municipalities
participating in the Regional Assessment Review Boards
Agreement.

3. The purpose of this Bylaw is to authorize the County of Newell to enter into
the Regional Assessment Review Boards Agreement and to establish
Assessment Review Boards;
4. Council hereby establishes the following Assessment Review Boards for
the County of Newell:
a) Local Assessment Review Board that shall consist of three (3) members;
b) Composite Assessment Review Board that shall consist of two (2)
members plus one (1) member appointed by the Province of Alberta.
5. The Assessment Review Boards shall carry out the duties and
responsibilities as set out in the Municipal Government Act, R.S.A. 2000,
Chapter M — 26 as amended and the Matters Relating to Assessment
Complaints Repulation.
MEMBERSHIP
6. Members and the Chair shall be appointed to the Regional Pool from time
to time by resolution of Council. Each must complete the legislated training
requirements.
7. If a vacancy shall occur at any time, Council shall by resolution, appoint a
new person to fill the vacancy.
8. Members, including the Chair, shall be appointed for three (3) years terms
and may be reappointed at the expiration of their terms.
9. Council delegates authority to the Chair to convene a panel of duly
appointed members from the Regional Pool to the Assessment Review
Boards, as required. The Chair may delegate any of the powers, duties, or
functions of the Chair to any other Member appointed to the Regional Pool.
10. The Chair and the Members will be supported in their roles by the
Assessment Review Board Clerk or the Clerk's Designate and the
Administrative Coordinator, as outlined in the Regional Assessment Review
Boards Agreement between the County of Newell and the other partnering
municipalities.
11. The Chair and the Members shall be compensated as outlined in the
Regional Assessment Review Boards Agreement.

COMPLAINT FEES
12. Complaint fees are outlined in the County's Fee Schedule Bylaw as
amended from time to time;
REPEAL OF BYLAW
13. That Bylaw No. 1694-10 and amendments thereto is hereby repealed.
EFFECTIVE DATE
14. This Bylaw shall come into force and take effect on the date of final passing.
