HomeMy WebLinkAbout2023-06-08 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION JUNE 8, 2023 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public via Lifesize on Thursday, June 8, 2023 commencing at 10:00 a.m. A notice was posted at the front entrance advising the public of the meeting. CALL TO ORDER The Chair called the meeting to order at 10:00 a.m. 2. EXCUSED FROM MEETING All members were in attendance af fhis meeting. 3. MINUTES P-29/23 MOVED BY COUNCILLOR LYNETTE KOPP that the minutes of the May 25, 2023 Municipal Planning Commission meeting be adopted as presented. Municipal Planning Commission June 8,2023 MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. 5. ADOPTION OF AGENDA P-30/23 MOVED BY COUNCILLOR AMANDA PHILPOTT that the agenda be adopted as presented. MOTION CARRIED 6. SUBDIVISIONS 6.1 Subdivision 2023-0-006 To create one new 1.05 ha (2.60 ac) lot from the 4.03 ha (9.96 ac) Lot 1, Block 1, Plan 7911008. The Municipal lntern - Planning provided background information on the proposed subdivision application. MPC was given the opportunity to ask questions. Discussion followed regarding the shape of the subdivision and the minimum size requirements. The Supervisor of Planning and Development confirmed minimum parcel size. P-31/23 MOVED BY COUNCILLOR NEIL JOHNSON that the MPC approve, with conditions, the subdivision of a 1.05 ha (2.60 ac) parcel from the 4.03 ha (9.96 ac) Lot 1, Block 1, Plan 7911008 (CoT 811 030 166) for residential purposes for the following reasons: 1. The proposed subdivision is consistent with the South Saskatchewan Regional Plan and complies with the County of Newell Municipal Development Plan, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions to be Considered: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. 2. That, pursuant to Section 655(1)(b) of the Municipal Government Act, the applicant enters into a Development Agreement with the County of Newell which shall be registered concurrently with the final plan against the title(s) being created. 3. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected Page 2 of 7 Municipal Planning Commission June 8, 2023 utilities to the County prior to the subdivision's registration with Alberta Land Titles. Reserve: The proposed subdivision complies with Section 663(d) of the Municipal Government Act, that money in place of reserve was provided in respect of the land that is subject of the proposed subdivision (77 M 126), therefore Municipal Reserve is not required. MOTION CARRIED 7. DEVELOPMENT PERMITS 7.1 DP 2023022 - Application is for the operation of a self-storage business and the construction of a storage building Development permit was extended by 30 days. MPC questioned whether the 30- day extension had allowed communication between the two parties. E. Hugill received architectural controls approximately two weeks ago from the HOA and they met on June 7, 2023. C. Archer indicated that the HOA remains against the development of this property. C. Archer requested a copy of the applications Notice of Completeness. The Supervisor of Planning and Development responded that the Notice of Completeness was sent directly to the applicant to indicate that all the required information has been received by the development authority and the application was ready for processing. This included a recent title, and any required caveats, encumbrances and restrictive covenants that are listed on title. C. Archer reviewed an extensive list of requests from the HOA if development/construction were to proceed. MPC was concerned with the level of progress made in the past 30 days. Discussion seems to be at a standstill befween the developer and the HOA. Discussion followed regarding the architectural controls. C. Archer indicated he did not want to see any development on the lot. G. Skriver spoke against the development and commented that homeowners building at the lake must abide by significant architectural controls. This storage unit does not "fit" with the current housing development. J. Philipsen is not opposed to the development of the lot but is opposed to the potential negative impact on property values. He indicated that the subdivision adjacent to the existing storage lot within the Hamlet of Lake Newell Resort has seen no residential development. J. Philipsen asked MPC what the definition of discretionary use is. The Supervisor of Planning and Development responded to the question. E. Unruh spoke against the development due to unsuitable location. Page 3 of 7 Municipal Planning Commission June 8, 2023 8. Endersby requested an environmental study be added to the condifions of the development. E. Hugill received email from Alberta Environment senior biologist that indicated given the substantial development in the area there is minimal environmental impact. N. Johnson spoke to the funds received last year from recreation funding that was to provide upgrades to the municipal reserve parcel adjacent to the proposed development. K. McClelland spoke to development of the municipal reserve (trees and water) to act as a barrier to the subject property development. This development hasn't occurred yet as they are waiting for the result of the development of the lot. K. McClelland spoke against the development. P-32/23 MOVED BY COUNCILLOR ADENA SKANDERUP that the Municipal Planning Commission APPROVE Development Permit 2023022 for the operation of a self-storage business and the construction of a 471 m2 (5075 ft2) storage building, on lands legally described as Lot 26, Block 5, Plan 0514207, Lake Newell Resort. This development approval is subject to the conditions outlined below. DP 2023022 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Business Hamlet District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. 3. The proposed development complies with the Lake Newell Resort Area Structure Plan 1428-03. Conditions of the approval: a) This approval is effective as of June 29, 2023 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted April 3, 2023. It must be built according to the description provided. Any changes shall require the written approval of the Development Authority. c) That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes and standards. d) The applicant/owner must obtain all construction permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. Page 4 of 7 Municipal Planning Commission June 8, 2023 e) That the applicant must enter into a Development agreement for the upgrade to the road approach. fl That no outdoor storage be permitted on the parcel. g) That the parcel and the bays are only used for storage. h) That the following setbacks are maintained for this development: Front (west): 6 m (20 ft) Side (north): 3 m (10 ft) Rear (east): 6 m (20 ft) MOTION CARRIED 8 County Ratepayers and E. Hugill left at 10:59 a.m. 7.2 DP2023030 - Application is for two additions to a manufactured home and the development of a shed The Municipal Planning - Infern provided background information on the proposed development permit and MPC was given the opportunity to ask questions. P-33/23 MOVED BY COUNCILLOR DAN SHORT that the Municipal Planning Commission APPROVE Development Permit 2023030 for the construction of two 15 mz (160 ft2) additions to a manufactured home and the development of a 15 m2 (160 ft2) shed, on lands legally described as Block 3, Plan 9812557, SE 1-19-15-W4. This development approval is subject to the conditions outlined below. DP 2023030 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under Section 5, Residential Manufactured Home Park District, Section 3, General Regulations and Section 4, Specific Uses and Activities, as specified in the County of Newell Land Use Bylaw 2016-21. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of the approval: a) This approval is effective as of June 29, 2023 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted May 10, 2023. It must be built according to the description provided with this approval. Any changes shall require the written Page 5 of 7 Municipal Planning Commission June 8,2023 approval of the Development Authority. c) That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes, and standards. d) The applicant/owner must obtain all construction permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. e) Any additional development shall require prior approval of a separate permit application. fl That the property is not used for conducting a business or commercial operation without first obtaining the required permits. g) That the following setbacks are maintained for this development: Front (west): 6 m (20 ft) Side (north and south): 1 m(3 ft) Rear (east): 1 m (3 ft) h) That the developer must begin construction before June 29, 2024. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. The Development shall be completed before June 29, 2025.
