CALL TO ORDER The Chair called the meeting to order at 10:00 a.m. 2. EXCUSED FROM MEETING All members were in attendance at this meeting. �' Municipal Planning Commission April 25, 2024 3. MINUTES 3.1 Minutes - Municipal Planning Commission (April 11, 2024) P-14/24 MOVED BY COUNCILLOR HOLLY JOHNSON that the minutes of the April 11, 2024 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. There were no post agenda items. 5. ADOPTION OF AGENDA P-15/24 MOVED BY REEVE ARNO DOERKSEN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS 6.1 DP 2024023 & DP 2024024 - Construction of two Single-Family dwellings for residential use. The Development Officer provided background informafion on this item to MPC. It was noted that Township Road 234 was previously redirected to provide access. P-16/24 MOVED BY REEVE ARNO DOERKSEN That the Municipal Planning Commission APPROVE Development Permit 2024023 and 2024024 for the construction of two 195 m2 (2100 ft2) Single-Family dwellings, on lands legally described as Lot 2, Block 1, Plan 1411232, S 28-23-18-W4. This development approval is subject to the conditions outlined below. DP 2024023 & 2024024 are APPROVED for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. 3. Adjacent landowners and referral agencies have been notified and have the opportunity to comments. Any comments or concerns should be received by the County administration by April 19, 2024. C-� Municipal Planning Commission April 25, 2024 Conditions of approval: a) This approval is effective as of May 15, 2024 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted March 18, 2024. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes, and standards. d) The applicant/owner must obtain all construction permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. e) That the applicant follow the land spreading requirements set out by Alberta Environment. fl Any additional development shall require prior approval of a separate permit application. g) That the following setbacks are maintained for this development: Front (west): 30 m (100 ft) Side (south): 30 m (100 ft) Side (north): 6 m (20 ft) Rear (east): 30 m (100 ft) MOTION CARRIED 6.2 DP 2024025 - Construction of a Single-Family dwelling with attached garage to be used as a second dwelling on the parcel. The Development Officer provided background information on this item to MPC. MPC inquired as to the staff procedure for ensuring conditions of development permit are met, specifically the removal of the existing manufacfured home. The Planning and Development Supervisor responded that non compliance of development permit conditions would be discovered by either neighboring complaints or further development requiring a permit. Applicants were present and answered questions regarding the removal of the existing manufactured home once the new home is constructed. P-17/24 MOVED BY COUNCILLOR DAN SHORT That the Municipal Planning Commission APPROVE Development Permit 2024025 for the construction of a 177 m2 (1900 ft2) Single-Family Dwelling with a 74 m2 (796 ftZ) attached garage to be used as the second dwelling on the parcel, on lands legally described as NE 21-16-13-W4. This development approval is subject to the conditions outlined below. DP 2024025 is APPROVED for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General Park District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. \ Municipal Planning Commission April 25, 2024 3. Any changes shall require the written approval of the Development Authority. c) That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes, and standards. d) The applicant/owner must obtain all construction permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. e) Any additional development shall require prior approval of a separate permit application. � That the existing second dwelling, the 2017 manufactured dwelling be removed from the parcel upon occupancy of the proposed dwelling. g) That the dwelling is not located on any right-of-way or easement on the parcel. h) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. i) That the following setbacks are maintained for this development: Front (east): 30 m (100 ft) Side (north): 30 m (100 ft) Rear (west): 6 m (20 ft) Side (south): 6 m (20 ft) j) That the applicant must install a temporary rural address sign at the road approach to the site as soon as construction starts. The sign must display the rural address as assigned by the County in the letter that will be mailed to the applicant after the permit has been approved. No other address may be displayed on the site. The sign must remain in place and in full view until it is replaced by a County of Newell issued rural address sign. MOTION CARRIED 7.
