HomeMy WebLinkAbout2024-12-19 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION December 19, 2024 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, December 19, 2024 commencing at 10:00 a.m. A notice was posted at the front entrance advising the public of the meeting. MINUTES P-53/24 MOVED BY COUNCILLOR ADENA SKANDERUP that the minutes of the December 5, 2024 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. 5. ADOPTION OF AGENDA P-54/24 MOVED BY COUNCILLOR LYNETTE KOPP that the agenda be adopted as presented. MOTION CARRIED 6. SUBDIVISIONS 6.1 Subdivision 2024-0-006 To subdivide an ± 8.6-hectare (21.18 acres) parcel from the SW 11-21-18W4M and a±0.67-hectare (1.66 acres) parcel from the NW 11-21-18 W4M that are cut off from the remainder of the quarters by Highway #1. The Supervisor of Planning and Development provided background information on this item and responded to questions from MPC. MPC questioned why a deferred caveat is being considered. Historically, large parcels that remain agricultural, municipal reserve has been deferred by caveat. When it is subdivided further then municipal reserve would be applicable. P-55/24 MOVED BY COUNCILLOR LYNETTE KOPP that the MPC approve, with conditions, the subdivision of an ± 8.57-hectare (21.18 acres) parcel from the SW 11-21-18W4M and a ± 0.67-hectare (1.66 acres) parcel from the NW 11-21- 18W4M that are cutoff from the remainder of the quarters by HWY 1, for agriculture purposes for the following reasons: 1. The proposed subdivision is consistent with the South Saskatchewan Regional Plan and complies with the County of Newell Municipal Development Plan, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Municipal Planning Commission December 19, 2024 Conditions of Approval: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. 2. That, pursuant to Section 655(1)(b) of the Municipal Government Act, the applicant enters into a Development Agreement with the County of Newell which shall be registered concurrently with the final plan against the title(s) being created. 3. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. 4. That physical access to all parcels be established either by consolidation in a manner such that the resulting Certificate of Title could not be subdivided without the approval of the Subdivision Authority, or by easement provided before the final approval of the subdivision to be registered concurrently with the final plan. Reserve: That the 10% Municipal reserve requirement, pursuant to Section 666 and 669 of the Municipal Government Act, be deferred by caveat on the newly created parcel with the actual acreage to be determined at the time of finalization. 7. OTHER BUSINESS There was no other business. 8. POST AGENDA ITEMS MOTION CARRIED There were no post agenda items to discuss at this meeting. 9. No County ratepayers were in attendance. The moderator indicated that there were no questions from the public. 11.
