HomeMy WebLinkAbout2025-02-06 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION February 6, 2025 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, February 6, 2025 commencing at 9:59 a.m. A notice was posted at the front entrance advising the public of the meeting. Stanway, Brooks Bulletin ATTENDANCE: lip FM 3 P-05/25 CALL TO ORDER The Chair called the meeting to order at 9: 59 a.m. EXCUSED FROM MEETING It was noted that Councillor H. Johnson and Councillor N. Johnson would be arriving late. No members were excused from this meeting. MINUTES IV MOVED BY COUNCILLOR LYNETTE KOPP that the minutes of the January 16, 2025 Municipal Planning Commission meeting be adopted as presented. Municipal Planning Commission February 6, 2025 MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. 5. ADOPTION OF AGENDA P-06/25 MOVED BY COUNCILLOR ADENA SKANDERUP that the agenda be adopted as presented. MOTION CARRIED 6. SUBDIVISIONS 6.1 Subdivision 2024-0-008 To reduce the size of the existing residential parcel NE 31-14-13W4M from 4.5 hectares (11.12 acres) to 1.713 hectares (4.23 acres) and increase the agricultural parcel from 59.2 hectares (146.3 acres) to 62 hectares (153.25 acres) to allow for additional farmland on the remainder of the quarter. The Planning and Development Supervisor provided background information on this item and responded to questions from MPC. Discussion followed. P-07125 MOVED BY COUNCILLOR DAN SHORT that the MPC approve, with conditions, the boundary line adjustment that reduces the size of the existing residential parcel (COT 191213426) from 4.5 hectares (11.12 acres) to 1.713 hectares (4.23 acres) and increases the agricultural parcel (COT 191213426) from 59.2 hectares (146.3 acres) to 62 hectares (153.25 acres) to allow for additional farmland on the remainder of the quarter for the following reasons: The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions of Approval: That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. That, pursuant to Section 655(1)(b) of the MGA, the applicant enters into a Development Agreement with the County which shall be registered concurrently with the final plan against the title(s) being created. 4. That the barn and west shed be removed prior to the final endorsement of the subdivision being granted. Reserve: Municipal reserve will not applicable as per Section 663(a) of the MGA, that one lot is to be created from a quarter section of land. MOTION CARRIED ARRIVED AT MEETING Councillor H. Johnson arrived at 10:04 a.m. 6.2 SUBDIVISION 2024-0-012 To subdivide an approximate 1.07-acre parcel from the SE 36-19-14W4M to be consolidated with Plan 1410658, Block 1, Lot 1 The Planning and Development Supervisor provided background information on this item and responded to questions from MPC regarding Municipal Reserve and access to the parcel. P-08/25 MOVED BY COUNCILLOR LYNETTE KOPP that the MPC approve, with conditions, the boundary line adjustment that subdivides an approximate 1.07- acre parcel from the SE 36-19-14W4M to be consolidated with Plan 1410658, Block 1, Lot 1 following reasons: The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. 2. Reserve: Municipal Reserve is applicable. It is recommended that money in place of land be taken on the ± 1.07-acre parcel as per County Policy POL-010-23 for an approximate amount of $1123.50. (10% of 1.07 acres x $10,500/acre), with the final amount to be determined at the time of finalization. MOTION CARRIED 7. OTHER BUSINESS There was no other business to discuss at this meeting. 8. POST AGENDA ITEMS There were no post agenda items to discuss at this meeting. 9. IN CAMERA There were no in camera items to discuss at this meeting. 10. QUESTION PERIOD A question period was held. No County ratepayers were in attendance. The moderator indicated that there were no questions from the public. 11.
