IN THE PROVINCE OF ALBERTA
BYLAW N O. 2088-25
BEING a bylaw of the County of Newell in the Province of Alberta, to amend the Land Use Maps
of Bylaw No. 2016-21, being the Land Use Bylaw;
WHEREAS the Council of the County of Newell is in receipt of an application for a Land Use
Bylaw Amendment to redesignate lands within the municipality, at the Bassano Airport, as shown
on the map in Schedule `A' attached hereto and legally described as:
PLAN 041 1757 BLOCK 2 LOTS 1,2, 5, 7-9, 11-15,17 - 20
PLAN 221 1195, BLOCK 2, LOT 28
PLAN 7911444, BLOCK 1
PLAN 2412380, BLOCK 2, LOTS 30-47
AND WHEREAS the purpose of proposed Bylaw No. 2088-25 is to redesignate the lands at the
Bassano Airport from Business — Rural District and Special — Parks and Public Service to Direct
Control District and to establish the uses and rules for the Direct Control District pertaining to the
above noted described lands and the uses and rules are as described in Schedule `B' attached
hereto;
AND WHEREAS the municipality must prepare a bylaw and provide for its consideration at a
public hearing.
NOW THEREFORE, under the authority and subject to the provisions of the Municipal
Government Act, Statutes of Alberta, Chapter M-26, 2000, as amended, the Council of the County
of Newell in the Province of Alberta duly assembled does hereby enact the following:
1. The Lands, illustrated on the map in Schedule `A' and legally described above shall be
redesignated
2. The Land Use District Map shall be amended to reflect this redesignation.
3. Bylaw No. 2016-21 is hereby amended and consolidated.
4. This bylaw shall come into effect upon third and final reading hereof.

PURPOSE: To provide regulations for the Bassano Airport to ensure continued safe and effective operations,
reduce hazards to air traffic, and attract compatible forms of development that encourage the
economic and financial viability of the airport.
LOCATION: PLAN 2412380, PLAN 2211195, PLAN 0411757 and PLAN 7911444 situated in the N 20-21-18-W4
(See Schedule A to Bylaw 2088-25)
PERMITTED USES: DISCRETIONARY USES:

Those uses, not otherwise defined in the Bylaw, which in the opinion of the Development Authority are similar to
the Permitted or Discretionary Uses and conform to the purpose of this District.

ADDITIONAL REQUIREMENTS:
Developments shall conform to the regulations of the Land Use Bylaw unless otherwise specified.
The Development Officer should make decisions on Development Permit Applications for Permitted Uses,
in accordance with Land Use Bylaw.
The Bassano Airport shall be protected through the enforcement and adherence to Transport Canada
TP312, Aerodrome Standards and Recommended Practices: Land Aerodromes, as updated from time to
time.
All development must be in line with Land Use Bylaw.
No development shall conflict with the safe operation of the airport.
The use or operation of development shall not cause any objectional or dangerous conditions, such as:
i. steam, smoke, dust, or other atmospheric emissions;
ii. toxic and noxious matter;
iii. radiation, fire and explosive hazards;
iv. extensive and unnecessarily bright exterior lighting;
v. accumulation of any materials or waste, edible or attractive to birds; and
vi. use of electric or electronic equipment.
vii. glare
A variance to the maximum building height of 11.0 metres may be granted if the additional height of the
building, structure, or object does not exceed the Obstacle Limitation Surfaces (OLS), as calculated
according to the guidelines of Transport Canada.
The principal building must be established prior to the development of any other structure or use on the
property.
A maximum of two shipping containers will be considered a permitted use, any more would be a
discretionary use.
Shipping containers will be in good repair and painted to ensure consistency and compatibility with
nearby buildings.
The outdoor storage of recreational vehicles is not permitted.
The Development Authority may refer the proposal for development to Transport Canada for an opinion.
If in the opinion of Transport Canada, the proposed development would negatively impact flight
operations, the Development Authority may refuse the application or may require amendments to the
application to reduce/mitigate the conflict.
