MUNICIPAL PLANNING COMMISSION
April 24, 2025
The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in
the County Office at Brooks, AB and livestreamed to the public on Thursday,
April 24, 2025 commencing at 10:01 a.m.
A notice was posted at the front entrance advising the public of the meeting.

The Chair called the meeting to order at 10:01 a.m.

4. CALL FOR POST AGENDA ITEMS
The Chair called for post agenda items. There were no post agenda items.
5. ADOPTION OF AGENDA
P-35/25 MOVED BY COUNCILLOR AMANDA PHILPOTT that the agenda be adopted as
presented.

6. DEVELOPMENT PERMITS
6.1 DP 2025015 - Construction of a multi -use building to be used as a shop,
agriculture building and riding arena.
The Development Officer provided background on this development permit and
MPC was given the opportunity to ask questions. MPC questioned why riding
areas are a discretionary use. Administration responded that an enclosed riding
arena is a discretionary use as it could potentially lead to commercial use. Council
can discuss updating this to better reflect recent developments at the time of Land
Use Bylaw update. A change of use development permit would be required if use
intensifies.
P-36/25 MOVED BY COUNCILLOR ELLEN UNRUH that the Municipal Planning Commission
APPROVE Development Permit 2025015 for the construction of a 1561 m2 (16800 ft2)
multi -use building to be used as a shop, agriculture building and riding arena on lands
legally described as SW 27-21-14-W4. This development approval is subject to the
conditions outlined below.
DP 2025015 is Approved for the following reasons:
The Development Authority is satisfied that the proposed development is suitable
for the purpose for which it is intended under the Agriculture General District
(Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and
Activities as specified in the County of Newell Land Use Bylaw 2016-21.
2. The proposed development complies with the Municipal Development Plan,
specifically to promote growth.
3. Any comments or concerns from adjacent landowners and referral agencies should
be received by April 17, 2025. Should no concerns be raised administration
recommends approval.
Conditions of Approval:
This approval is effective as of May 14, 2025 (21-day appeal period).
2. The development complies with provisions pertaining to the Agriculture General
District and all relevant schedules, as outlined in the County of Newell Land Use
Bylaw #2016-21.

3. The development must be located as shown on the site plan approved with the
application and submitted February 28, 2025. It must be built according to the
description provided with this approval. Any changes shall require the written
approval of the Development Authority.
4. That the proposed development complies with all Federal, Provincial and Municipal
statutes, regulations, codes, and standards.
5. That the following setbacks on all sides are maintained for this development:
Front (south): 30 m (100 ft)
Side (west): 30 m (100 ft)
Rear (north): 6 m (20 ft)
Side (east): 6 m (20 ft)
6. That the proposed accessory building is not used for living purposes.
7. That the riding arena is for personal use only.
8. Wetlands are identified in the provincial wetland database. It is the developer's
responsibility to ensure the development meets all applicable legislation and all
permits from provincial or federal bodies are obtained.
9. That no structures be located on a right of way or easement on the parcel.
10. Any additional development or intensification shall require prior approval of a
separate permit application.
11. That the developer must start construction before May 14, 2026 and be completed
by May 14, 2027.

6.2 DP 2025022 & DP 2025023 - Change in use, specifically an auto wrecking
business which is an Industrial Heavy use.
The Development Officer provided background on this development permit and
MPC was given the opportunity to ask questions. The applicant indicated that the
business is for a full -service auto wrecker and will be selling parts, mostly
online. This will be a new business to the county. MPC asked about the fencing
requirements. Administration responded that there are no fencing requirements in
the land use bylaw. MPC asked who would ensure that the Emergency Response
Plan was being followed. Administration indicated that the Fire Chief would be
responsible for monitoring the emergency response conditions.

P-37/25 MOVED BY COUNCILLOR DAN SHORT that the Municipal Planning Commission
APPROVE Development Permit 2025022 and 2025023 for the change in use, specifically
an auto wrecking and mechanics shop which are Industrial Heavy uses on lands legally
described as Lot 4W, Block 2, Plan 8011608, NW 7-19-14-W4 and Lot 8, Block 2, Plan
9111302, NW 7-19-14-W4. This development approval is subject to the conditions outlined
below.
DP 2025022 is Approved for the following reasons:
The Development Authority is satisfied that the proposed development is suitable
for the purpose for which it is intended under the Industrial General District
(Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and
Activities as specified in the County of Newell Land Use Bylaw 2016-21.
The proposed development complies with the Municipal Development Plan.
3. Any comments or concerns from adjacent landowners and referral agencies should
be received by April 17, 2025. Should no concerns be raised administration
recommends approval.

statutes, regulations, codes, and standards.
5. That the applicant mitigates noise and dust.
6. That the vehicles are arranged in a way to allow emergency vehicles to access all
areas of the parcel.
The shipping containers must not display advertising, names, or marketing.
That no structures be located on a right of way or easement on the parcel.
9. Any additional development or intensification shall require prior approval of a
separate permit application.
10. That the operation of the business commences within 12 months of the effective
date.
