HomeMy WebLinkAbout2025-05-08 Municipal Planning Commission (Regular) MinutesCOUNTY OF NEWELL MUNICIPAL PLANNING COMMISSION May 8, 2025 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, May 8, 2025 commencing at 10:02 a.m. A notice was posted at the front entrance advising the public of the meeting. CALL TO ORDER The Chair called the meeting to order at 10:02 a.m. 2. EXCUSED FROM MEETING All members were in attendance at this meeting. 3. MINUTES 3.1 Minutes - Municipal Planning Commission (April 24, 2025) P-38/25 MOVED BY COUNCILLOR AMANDA PHILPOTT that the minutes of the April 24, 2025 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission May 8, 2025 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. 5. ADOPTION OF AGENDA P-39/25 MOVED BY COUNCILLOR ADENA SKANDERUP that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Officer presented the Development Report and responded to questions from Council. This item was accepted as information. 7. DEVELOPMENT PERMITS 7.1 DP 2025027 Construction of an accessory building with a variance to the rear yard setback. The Development Officer provided background information on this item. J. Cote, the applicant, was present to respond to questions. The Municipal Planning Commission was given the opportunity to ask questions. The Development Officer and Planning & Development Supervisor responded to permitting requirements for shipping containers. A development permit is required in this instance as the shipping containers are considered an accessory building. J. Cote responded to additional information regarding the footings and the electrical connection. P-40/25 MOVED BY COUNCILLOR ARNO DOERKSEN that the Municipal Planning Commission APPROVE Development Permit 2025027 for the construction of a 291 m2 (3136 ft2) accessory building with a variance to the rear yard setback on lands legally described as Lot 1, Block 1, Plan 9110716, SW 6-19-14-W4. This development approval is subject to the conditions outlined below. DP 2025027 is Approved for the following reasons: 1. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21; except the proposed variance. 2. The proposed development complies with the Municipal Development Plan. 3. Any comments or concerns from adjacent landowners and referral agencies should be received by May 2, 2025. Should no concerns be raised administration recommends approval. Page 2 of 6 Municipal Planning Commission May 8, 2025 If approved, the following conditions should be considered: 1. This approval is effective as of May 28, 2025 (21-day appeal period). 2. The development complies with provisions pertaining to the Agriculture General District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 2016-21. 3. The development must be located as shown on the site plan approved with the application and submitted March 28, 2025. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. 4. That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 5. That the following setbacks on all sides are maintained for this development: Rear (north): 1.8 m (6 ft); varied from 6 m (20 ft) Side (west): 6 m (20 ft) 6. That no structures be located on a right of way or easement on the parcel. 7. Any additional development or intensification shall require prior approval of a separate permit application. 8. That the developer must start construction before May 28, 2026 and be completed by May 28, 2027. MOTION CARRIED LEFT THE MEETING J. Cote left the meeting at 10:14 a.m. 7.2 DP 2026029 Construction of a building and the operation of an Agricultural Processing business. The Development Officer provided background information on this item. J. Jheetey provided additional background information. B. Wipf presented a video and slide deck of an example black soldier fly growing farm. J. Jheetey responded to questions regarding the life cycle of the black soldier fly and anticipated future production estimates. S. Simpson and B. Wipf responded to further questions. P-41/25 MOVED BY COUNCILLOR GREG SKRIVER That the Municipal Planning Commission APPROVE Development Permit 2025029 for the construction of a 1003 m2 (10800 ft2) building to be used as a processing plant and an office on lands legally described as NW 10-22-19 W4. This development approval is subject to the conditions outlined below. DP 2025029 is Approved for the following reasons: Page 3 of 6 Municipal Planning Commission May 8, 2025 1. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Any comments or concerns from adjacent landowners and referral agencies should be received by May 2, 2025. That no structures be located on a right of way or easement on the parcel. 7. Any additional development or intensification shall require prior approval of a separate permit application. 8. That the developer must start construction before May 28, 2026 and be completed by May 28, 2027. LEFT THE MEETING MOTION CARRIED B. Wipf and J. Jheetey left the meeting at 10:31 a.m. Page 4 of 6 Municipal Planning Commission May 8, 2025 8. SUBDIVISIONS 8.1 Subdivision 2025-0-006 To subdivide a 6.097 ha. (15.07 acre) parcel from the SE 16-18-16W4, containing a farmstead and pastureland. The Planning & Development Supervisor provided background information on this item and responded to questions from Council. P-42/25 MOVED BY COUNCILLOR LYNETTE KOPP That the MPC approve, with conditions, the subdivision of one lot, 6.097 ha. (15.07 acres) in size from the SE 16-18-16-W4, containing a farmstead and pastureland, for the following reasons: 1. The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions of Approval: 1. That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. 3. That, pursuant to Section 655(1)(b) of the MGA, the applicant enters into a Development Agreement with the County which shall be registered concurrently with the final plan against the title(s) being created. Reserve: Municipal reserve is not applicable as per Section 663(a) of the MGA, that one lot is to be created from a quarter section of land. MOTION CARRIED 9.
