HomeMy WebLinkAbout2025-07-10 Municipal Planning Commission (Regular) MinutesCounty of Newell Municipal Planning Commission July 10, 2025 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, July 10, 2025 commencing at 10:00 a.m. A notice was posted at the front entrance advising the public of the meeting. MINUTES 3.1 Minutes - Municipal Planning Commission (June 19,2026) P-52125 MOVED BY AMANDA PHILPOTT that the minutes of the June 19, 2025 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission July 10, 2025 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. 5. ADOPTION OF AGENDA P-53/25 MOVED BY ELLEN UNRUH that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Officer presented the Development Report and responded to questions from MPC. This item was accepted as information. 7. DEVELOPMENT PERMITS 7.1 DP 2025042 Operation of a self -storage business with a variance to the setback adjacent to a County Road. The Development Officer provided background information on the item. B. Jackson, the applicant, was present to respond to questions from MPC. The Development Officer responded to questions regarding the adjacent landowner notification. B. Jackson responded to questions regarding RV storage and the access road. He explained the variance will allow them to make best use of his land. The Development Officer responded to further questions regarding shipping containers on the right of way. Discussion followed regarding the variance request. The Planning & Development Supervisor indicated that further discussion on setbacks for internal subdivision roads is required. P-54/25 MOVED BY ARNO DOERKSEN that the Municipal Planning Commission APPROVE Development Permit 2025042 for the operation of a self -storage business on lands legally described as Lot 4, Block 2, Plan 0710554, NW 36-18-15-W4. This development approval is subject to the conditions outlined below. DP 2025042 is Approved for the following reasons: The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Business Rural District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Adjacent landowners and referral agencies have been notified and had the opportunity to comment. Condition of Approval. This approval is effective as of July 30, 2025 (21-day appeal period). Page 2 of 8 Municipal Planning Commission July 10, 2025 2. The development complies with provisions pertaining to the Business Rural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #2016-21. 3. The development must be located as shown on the site plan approved with the application and submitted May 26, 2025. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. 4. That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 5. That the following setbacks are maintained for this development: Front (north): 25 m (82 ft); variance from 30 m (100 ft) Side (east): 3 m (10 ft) 6. That the property is not used for residential purposes. 7. That no structures be located on a right of way or easement on the parcel. 8. Any additional development or intensification shall require prior approval of a separate permit application. MOTION CARRIED 7.2 DP 2025045 Installation of an oversize ground mount solar system with a variance to the setback from a property line adjacent to a County Road. The Development Officer provided background information on this item. B. Schroeder and D. Visser the applicants were present to respond to questions from MPC. The Planning & Development Supervisor responded to questions regarding variances and traffic on the road. B. Schroeder responded to questions, indicating that it is unlikely that the angle of the panels will create glare that will impact driver visibility. The Planning & Development Supervisor provided information regarding setbacks. P-55/25 MOVED BY LYNETTE KOPP that the Municipal Planning Commission APPROVE Development Permit 2025045 for the installation of a 138 m2 (1485 ft2) ground mount solar for individual use with a variance to the south setback on lands legally described as SW 13-21-14-W4. This development approval is subject to the conditions outlined below. DP 2025045 is Approved for the following reasons: The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Adjacent landowners and referral agencies have been notified and had the opportunity to comment. The development complies with provisions pertaining to the Agriculture General District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #2016-21; except the proposed variance. 3. The development must be located as shown on the site plan approved with the application and submitted June 3, 2025. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. 4. That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 5. That the following setbacks on all sides are maintained for this development: Front Yard (south): 25 m (82 ft); varied from 30 m (100 ft) Side Yard (east): 6 m (20 ft) 6. That no structures be located on a right of way or easement on the parcel. 7. Any additional development or intensification shall require prior approval of a separate permit application. 8. That the developer must start construction before July 30, 2026 and construction is completed by July 30, 2027. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. MOTION CARRIED 7.3 DP 2025046 Installation of an oversize ground mount solar system with a variance to the setback from a property line adjacent to a County Road. The Development Officer provided background information on the item. D. Visser the applicant was present to respond to questions from MPC. P-56/26 MOVED BY HOLLY JOHNSON that the Municipal Planning Commission APPROVE Development Permit 2025046 for the installation of a 135 m2 (1453 ft2) ground mount solar for individual use with a variance to the west setback on lands legally described as NW 01-15-14-W4. This development approval is subject to the conditions outlined below. DP 2025046 is Approved for the following reasons: 1. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 2. That no structures be located on a right-of-way or easement on the parcel. 7. Any additional development or intensification shall require prior approval of a separate permit application. 8. That the developer must start construction before July 30, 2026 and construction must be completed by July 30, 2027. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. MOTION CARRIED 7.4 DP 2026047 Installation of an oversize ground mount solar system with a variance to the setback from a property line adjacent to a County Road. The Development Officer provided background information on the item, indicating two letters were received from adjacent landowners in opposition to the proposed development. C. Hanson the applicant was present and provided a response to the adjacent landowner letters. D. Visser was present to respond to questions from MPC. The Development Officer provided information regarding the notification period. C. Hanson and D. Visser responded to questions regarding the proposed system that will provide power to multiple irrigation systems. Discussion followed regarding the adjacent landowner concerns. D. Visser provided information regarding setbacks from the road and concerns about visual impact. Further discussion followed regarding potential sightline issues. P-57/25 MOVED BY ARNO DOERKSEN that the Municipal Planning Commission APPROVE Page 5 of 8 Municipal Planning Commission July 10, 2025 Development Permit 2025047 for the installation of a 675 m2 (7266 ft2) ground mount solar for individual use with a variance to the north and west setbacks on lands legally described as NW 07-19-13-W4. This development approval is subject to the conditions outlined below. DP 2025047 is Approved for the following reasons: The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Adjacent landowners and referral agencies have been notified and had the opportunity to comment. Condition of approval. This approval is effective as of July 30, 2025 (21-day appeal period). 2. SUBDIVISIONS 8.1 Subdivision 2025-0-007 To subdivide a 43.301-hectare (107 acres) parcel from the NW 20-18-14W4M to be used as an exhibition grounds. Page 6 of 8 Municipal Planning Commission July 10, 2025 The Planning & Development Supervisor provided background information on this item and responded to questions from MPC regarding deferral of the Municipal Reserve requirement. Discussion followed. P-58125 MOVED BY NEIL JOHNSON that the MPC approve, with conditions, the subdivision of one lot, 43.301-hectare (107 acres) in size from the NW 20-18-14W4M to be used as an exhibition ground, for the following reasons: 1. The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions to be Considered: That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. 3. That, pursuant to Section 655(1)b of the MGA, the applicant enters into a Development Agreement with the County which shall be registered concurrently with the final plan against the title(s) being created. Reserve: Municipal reserve is applicable as the proposed subdivision does not meet the provisions of section 663 of the MGA. Policy POL-010-23 applies. The 10% Municipal Reserve requirement, pursuant to Section 666 and 669 of the Municipal Government Act, be deferred by caveat on the newly created parcel with the actual acreage to be determined at the time of finalization.
