HomeMy WebLinkAbout2025-07-24 Municipal Planning Commission (Regular) MinutesCounty of Newell Municipal Planning Commission July 24, 2025 The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, July 24, 2025 commencing at 10:00 a.m. A notice was posted at the front entrance advising the public of the meeting. MINUTES 3.1 Minutes - Municipal Planning Commission (July 10, 2025) P-60/25 MOVED BY COUNCILLOR AMANDA PHILPOTT that the minutes of the July 10, 2025 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission July 24, 2025 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. 5. ADOPTION OF AGENDA P-61/25 MOVED BY COUNCILLOR LYNETTE KOPP that the agenda be adopted as presented. MOTION CARRIED LEFT MEETING Councillor E. Unruh declared a pecuniary interest as the applicant and left the meeting at 10:03 a.m. 6. DEVELOPMENT PERMITS 6.1 DP 2025048 Installation of an oversized ground mount solar system The Development Officer provided background information on the item and responded to questions. Land Use Bylaw is being reviewed to increase the size of solar development for permitted use. P-62/25 MOVED BY COUNCILLOR ARNO DOERKSEN that the Municipal Planning Commission APPROVE Development Permit 2025048 for the installation of an 84 m2 (900 ft2 ) ground mount solar for individual use on lands legally described as Lot 1, Block 2, Plan 0111870, SW 14-21-16-W4. This development approval is subject to the conditions outlined below. DP 2025048 is Approved for the following reasons: 1. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Any comments or concerns from adjacent landowners and referral agencies should be received by July 18, 2025. Should no concerns be raised administration recommends approval. Conditions of Approval. 1. This approval is effective as of August 13, 2025 (21-day appeal period). 2. The development complies with provisions pertaining to the Agriculture, General District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #2016-21. Page 2 of 4 J Municipal Planning Commission July 24, 2025 3. The development must be located as shown on the site plan approved with the application and submitted June 10, 2025. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. 4. That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 5. That the following setbacks on all sides are maintained for this development: Front Yard (west): 30 m (100 ft) Side Yard (north): 6 m (20 ft) 6. That no structures be located on a right of way or easement on the parcel. 7. Any additional development or intensification shall require prior approval of a separate permit application. 8. That the developer must start construction before August 13, 2026 and construction is completed by August 13, 2027. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. MOTION CARRIED ARRIVED AT MEETING Councillor E. Unruh returned at 10:05 a.m. 7. SUBDIVISIONS 7.1 Subdivision 2024-0-009 To subdivide a 2.538-hectare (6.27 acre) parcel from the NE 13-17-17M4W for residential purposes. The Planning & Development Officer Supervisor provided background information on this item and responded to questions from MPC. P-63/25 MOVED BY COUNCILLOR HOLLY JOHNSON that the MPC approve, with conditions, the subdivision of one lot, 2.538-hectare (6.27 acre) in size from the agriculture parcel located in the NE 13-17-17M4W, for residential purposes, for the following reasons: 1. The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions to be Considered: 1. That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall be paid to the County of Newell. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. 3. That, pursuant to Section 655(1)b of the MGA, the applicant enters into a Development Agreement with the County which shall be registered concurrently with the final plan against the title(s) being created. Reserve: Municipal reserve will not applicable as per Section 663(a) of the MGA, that one lot is to be created from a quarter section of land. MOTION CARRIED 8. OTHER BUSINESS There was no other business to discuss at this meeting. 9. POST AGENDA ITEMS There were no post agenda items to discuss at this meeting. 10. IN CAMERA There were no in camera items to discuss at this meeting. 11. INFORMATION ITEMS There were no information items to discuss at this meeting. 12. QUESTION PERIOD A question period was held. No County ratepayers were in attendance. The moderator indicated that there were no questions from the public. 13.
