HomeMy WebLinkAbout2025-09-11 Municipal Planning Commission (Regular) MinutesCounty of Newell Municipal Planning Commission September 11, 2025 -10:00 AM The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in the County Office at Brooks, AB and livestreamed to the public on Thursday, September 11, 2025 commencing at 10:00 a.m. A notice was posted at the front entrance advising the public of the meeting. MINUTES 3.1 Minutes - Municipal Planning Commission (August 7, 2025) P-71/25 MOVED BY COUNCILLOR HOLLY JOHNSON that the minutes of the August 7, 2025 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. 5. ADOPTION OF AGENDA P-72/25 MOVED BY COUNCILLOR DAN SHORT that the agenda be adopted as presented. �� Municipal Planning Commission September 11, 2025 6. DEVELOPMENT REPORT MOTION CARRIED The Development Officer presented the Development Report and responded to questions from MPC. This item was accepted as information. 7. DEVELOPMENT PERMITS 7.1 DP 2025061 Installation of an oversize ground mount solar array. The Development Officer provided background information on the item. P-73/25 MOVED BY COUNCILLOR ADENA SKANDERUP that the Municipal Planning Commission APPROVE Development Permit 2025061 for the installation of a 138 m2 (1485 ft2) ground mount solar for individual use on lands legally described as SW 13-21- 14-W4. This development approval is subject to the conditions outlined below. DP 2025061 is Approved for the following reasons: The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Any comments or concerns from adjacent landowners and referral agencies should be received by September 5, 2025. Should no concerns be raised administration recommends approval. Conditions of approval. This approval is effective as of October 1, 2025 (21-day appeal period). 2. The development complies with provisions pertaining to the Agriculture General District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #2016-21. 3. The development must be located as shown on the site plan approved with the application and submitted July 17, 2025. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. 4. That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 5. That the following setbacks on all sides are maintained for this development: Front Yard (south): 30 m(100 ft) Side Yard (east): 6 m(20 ft) � Page 2 of 7 Municipal Planning Commission September 11, 2025 6. That no structures be located on a right of way or easement on the parcel. 7. Any additional development or intensification shall require prior approval of a separate permit application. 8. That the developer must start construction before October 1, 2026 and construction is completed by October 1, 2027. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. P-74/25 MOVED BY COUNCILLOR NEIL JOHNSON that the Municipal Planning Commission APPROVE Development Permit 2025063 for the installation of a 126 m2 (1356 ft2) ground mount solar for individual use on lands legally described as SE 04-21-16-W4. This development approval is subject to the conditions outlined below. DP 2025063 is Approved for the following reasons: The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Any comments or concerns from adjacent landowners and referral agencies should be received by September 5, 2025. P- 75/25 MOVED BY COUNCILLOR DAN SHORT that the Municipal Planning Commission APPROVE Development Permit 2025064 for the installation of a 156 m2 (1679 ft2) ground mount solar for individual use on lands legally described as NW 07-21-16-W4. This development approval is subject to the conditions outlined below. DP 2025064 is Approved for the following reasons: The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Any comments or concerns from adjacent landowners and referral agencies should be received by September 5, 2025. Should no concerns be raised administration recommends approval. Conditions of approval. This approval is effective as of October 1, 2025 (21-day appeal period). 2. The development complies with provisions pertaining to the Agriculture General District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #2016-21. 3. The proposed development occurs near a wetland area, it is the developer's responsibility to confirm mitigation of the wetland. 9. That the developer must start construction before October 1, 2026 and construction is completed by October 1, 2027. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. MOTION CARRIED 7.4 DP 2025065 Installation of an oversize ground mount solar array. The Development Officer provided background information on the item. The Development Officer responded to questions regarding an upcoming text amendment to the Land Use Bylaw that will increase the dimensions of the solar power development that can be approved as a permitted use. P-76/25 MOVED BY COUNCILLOR DAN SHORT that the Municipal Planning Commission APPROVE Development Permit 2025065 for the installation of a 126 m2 (1679 ft2) ground mount solar for individual use on lands legally described as NW 01-21-16-W4. This development approval is subject to the conditions outlined below. DP 2025065 is Approved for the following reasons: 1. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Any comments or concerns from adjacent landowners and referral agencies should be received by September 5, 2025. Should no concerns be raised administration recommends approval. Condition of approval. This approval is effective as of October 1, 2025 (21-day appeal period). 2.
