2106-25 Local Improvement - LNR Path
COUNTY OF NEWELL PROVINCE OF ALBERTA BYLAW 2106-25 A BYLAW OF THE COUNTY OF NEWELL, IN THE PROVINCE OF ALBERTA, TO AUTHORIZE THE COUNCIL OF THE COUNTY OF NEWELL TO IMPOSE A LOCAL IMPROVEMENT TAX IN RESPECT OF ALL LANDS THAT DIRECTLY BENFIT FROM THE "LAKE NEWELL RESORT PATHWAY" LOCAL IMPROVEMENT PROJECT. WHEREAS, the Council of the County of Newell has decided to issue a bylaw pursuant to Section 397 of the Municipal Govemment Act to authorize a local improvement tax levy to pay for the "Lake Newell Resort Pathway" local improvement project. The project is to construct a paved pathway throughout Lake Newell Resort and Jinked directly to the Kinbrook Connection Pathway. WHEREAS a local improvement plan has been prepared and the required notice of intention to undertake and complete the "Lake Newell Resort Pathway" project has been given to the owners within the Hamlet of Lake Newell Resort in accordance with the attached Schedule "A" and no sufficient objection to Lake Newell Resort Pathway Local Improvement Project has been filed with the Municipality's ChiefAdministrative Officer. WHEREAS Council has decided to set a uniform tax rate per parcel based on the total number of parcels within the Hamlet of Lake Newell Resort. The total number of parcels is TWO HUNDRED AND SIXTY SIX (266). WHEREAS plans and specifications have been prepared. The total cost of the project is $1,782,883 and the local improvement plan estimates the following contributions will be received or applied to the project: 1) Benefiting Owners (Revenue raised by local improvement tax): $825,000 2) Municipality: $275,000 3) Provincial Grants $682,883 TOTAL: $1,782,883 The local improvement tax will be collected for TWENTY (20) years and the total amount levied annually against the benefiting owners is $236.00. All the required approvals for the project have been obtained and the project is in compliance with all Acts and Regulations of the Province of Alberta. NOW, THEREFORE, the Council of the County of Newell duly assembled, enacts as follows 1. That for the purpose of completing the "Lake Newell Resort Pathway" local improvement project the sum of TWO HUNDRED THRITY SIX (236.00) be collected by way of an annual, uniform local improvement tax rate assessed against the owners as provided in Schedule "A". 2. The net amount levied under the bylaw shall be applied only to the local improvement project specified by this bylaw. 3. This bylaw comes into force the date of final reading.
