MINUTES 3.1 Minutes - Municipal Planning Commission (September 11, 2025) MOVED BY COUNCILLOR ADENA SKANDERUP that the minutes of the September 11, 2025 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. � Municipal Planning Commission September 25, 2025 5. ADOPTION OF AGENDA P-78/25 MOVED BY COUNCILLOR NEIL JOHNSON that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS 6.1 DP 2025071 Installation of a 2025 Manufactured Home for residential use. The Planning & Development Supervisor provided background information on this item and responded to questions from MPC. P-79/25 MOVED BY COUNCILLOR LYNETTE KOPP that the Municipal Planning Commission APPROVE Development Permit 2025071 for the installation of a 113 m2 (1216 ftz) Manufactured Home that was constructed in 2025 for residential use on lands legally described as Lot 22, Block 2, Plan 9510189, NW 19-17-12-W4. This development approval is subject to the conditions outlined below. DP 2025071 is Approved for the following reasons: 1. The Development Authority is satisfied that the proposed development is suitabie for the purpose for which it is intended under the Industriai General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Any comments or concerns from adjacent landowners and referral agencies should be received by September 19, 2025. Should no concerns be raised administration recommends approval. If approved, the following conditions should be considered: 1. This approval is effective as of October 15, 2025 (21-day appeal period). 2. The development complies with provisions pertaining to the Residential Hamlet District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #2016-21. 3. The development must be located as shown on the site plan approved with the application and submitted August 25, 2025. It must be built according to the description provided with this approval. Any changes shall require the written approval ofthe DevelopmentAuthority. 4. That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes and standards. � Page 2 of 6 Municipal Planning Commission September 25, 2025 5. That the following setbacks on all sides are maintained for this development Front & Rear (east & west): 6 m(20 ft) Sides (north & south): 1.5 m(5 ft) 6. Thaf the height of the structure doesn't exceed 5 m. 7. That the dwelling must be placed on a foundation and be skirted within 30 days of siting. 8. Axles, wheels and trailer hitches shall be removed once dwelling is sited. 9. That no structures be located on a right of way or easement on the parcel. 10. That the developer must start construction before October 15, 2026, one year from the date the appeal period has lapsed and completed by October 15, 2027. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. MOTION CARRIED 6.2 DP 2025074 Approval of an existing oversized accessory building (shop). The Planning & Development Supervisor provided background information on this item and responded to questions from MPC. P-80/25 MOVED BY COUNCILLOR ARNO DOERKSEN that the Municipal Planning Commission APPROVE Development Permit 202504 for the approval of an existing 201 m2 (2160 ft2) accessory building (shop) on lands legally described as Block 1, Plan 8211065, SW 12-21-18-W4. This development approval is subject to the conditions outlined below. DP 2025074 is Approved for the following reasons: The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Residential Rural District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Any comments or concerns from adjacent landowners and referral agencies should be received by September 19, 2025. Should no concerns be raised administration recommends approval. If approved, the following conditions should be considered: 1. That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 5. That the property is not used for residential purposes. 6. That no structures be located on a right of way or easement on the parcel. 7. Any additional development or intensification shall require prior approval of a separate permit application. MOTION CARRIED ARRIVED AT MEETING L. Johnson arrived at 10:10 a.m. 7. SUBDIVISIONS 7.1 Subdivision 2025-0-010 To subdivide a 0.56 ha (1.38 ac) portion from the 1.62 ha (4.0 ac) parcel in the SE 05-05-19-75W4M (CoT 251 030 126) to be consolidated with the adjacent parcel. The Planning & Development Supervisor provided background information on this item and responded to questions from MPC. The Director of Corporate Services provided additional information regarding the Cassils Cemetery, indicating that it is inactive and no interments will be allowed in the future. An improvement plan for the site has been provided by the community group that will 6e responsib/e for ongoing maintenance. There are no graves located in the portion to be subdivided. P-81/25 MOVED BY COUNCILLOR GREG SKRIVER that the MPC approve, with conditions, the subdivision of a 0.56 ha (1.38 ac) portion from the 1.62 ha (4.0 ac) parcel in the SE 05-05-19-15W4M (CoT 251 030 126) to be consolidated with the adjacent parcel (CoT 151182901) to address the encroachment of the adjacent parcel., for the following reasons 1. The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable forthe purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. 3. That the subdivided parcel is consolidated with Lot 1, Block 8, Plan 1512056, SE 5-19-15 W4M and no new lots are being created. �, Page 4 of 6 Municipal Planning Commission September 25, 2025 Conditions to be Considered: 1. That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Tities. 3. That, pursuant to Section 655(1)b of the MGA, the applicant enters into a Development Agreement with the County which shall be registered concurrently with the final plan against the title(s) being created. 4. That the subdivided parcel is consolidated with Lot 1, Block 8, Plan 1512056, SE 5-19-15 W4M. 5. The habendum clause remains on the new title for the cemetery lands Reserve Municipal Reserve is not applicable as no new lots are being created. MOTION CARRIED 8.
