MINUTES 3.1 Minutes - Municipal Planning Commission (December 11, 2025) MOVED BY COUNCILLOR LYNETTE KOPP that the minutes of the December 11, 2025 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED CALL FOR POST AGENDA ITEMS The Chair called for post agenda items. ADOPTION OF AGENDA MOVED BY REEVE ARNO DOERKSEN that the agenda be adopted as presented. MOTION CARRIED DEVELOPMENT REPORT This item was accepted as information. DEVELOPMENT PERMITS 7.7 DP 2025091 Intensification of an Agricultural (Processing) business and newly proposed construction of buildings. The Development Officer provided background information on the item and responded to questions from MPC. The applicant was present to give background information on the item and responded to questions from MPC. P-04/26 MOVED BY COUNCILLOR LYNETTE KOPP that the Municipal Planning Commission APPROVE Development Permit 2025091 for the intensification of use for an Agricultural (Processing) business, specifically the addition of 6 grain bins to bring the total to 12, 1486 m2 (16000 ft2) building and 167 m2 (1800 ft2) building on lands legally described as SE 20-21-18-W4. This development approval is subject to the conditions outlined below. DP 2025091 is Approved for the following reasons: 1. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. Page 2 of 9 � Municipal Planning Commission January 15, 2026 If approved, the following conditions should be considered: 1. This approval is effective as of February 4, 2026 (21-day appeal period). 2. The development complies with provisions pertaining to the Agriculture General District and all relevant schedules, as outlined in the County of Neweil Land Use Bylaw #2016-21. 3. The development must be located as shown on the site plan approved with the application and submitted November 4, 2025. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. 4. That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 5. That the foilowing setbacks on all sides are maintained for this development: Front (east): by Alberta Transportation Side (north and south): 6 m(20 ft) Rear (west): 6 m (20 ft) 6. That the property is not used for residential purposes. 7. That the applicant submit a Stormwater Management Plan to be approved by the County of Newell prior to development. 8. That the applicant enter into a Development Agreement with the County of Newell for the construction of the road approach. 9. That the applicant provide an Emergency Response Plan to be reviewed by the County of Neweli Fire and Emergency services prior to development. 10. That lighting is installed on the parcel to the satisfaction of the County of Newell. 11. That any air and noise pollutants are maintained on the parcel. 12. That garbage is stored in weather-proof containers screened from adjacent properties and maintained on a regular basis. 13. That no structures be located on a right of way or easement on the parcel. 14. Any additional development or intensification shall require prior approval of a separate permit application. � Page 3 of 9 __ Municipal Planning Commission January 15, 2026 15. That the developer must start construction before February 4, 2027. That the construction is completed by February 4, 2028. In the event that this date cannot be met, the developer must apply for an extension and may be required to appiy for a new permit. MOTION CARRIED 7.2 DP 2025094 Intensification of Agriculture (Processing) Operation. The Development Officer provided background information on this item and responded to questions from MPC. The applicant was present and responded to questions from MPC. P-05/26 MOVED BY COUNCILLOR NEIL JOHNSON that the Municipal Planning Commission APPROVE Development Permit 2025094 for the intensification of use for the Agriculture (Processing) operation on lands legally described as NW 15-22-19-W4. This development approval is subject to the conditions outlined below. DP 2025094 is Approved for the following reasons: 1. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agriculture General District (Schedule 2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 2. The proposed development complies with the Municipal Development Plan. 3. Any comments or concerns from adjacent landowners and referral agencies should be received by January 9, 2026. Should no concerns be raised administration recommends approvaL If approved, the following conditions should be considered: 1. This approval is effective as of February 4, 2026 (21-day appeal period). 2. The development complies with provisions pertaining to the Agriculture General District and ail relevant schedules, as outlined in the County of Newell Land Use Bylaw #2016-21. 3. The development must be located as shown on the site plan approved with the application and submitted November 17, 2025. It must be built according to the description provided with this approval. That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 5. Any additional development or intensification shall require prior approval of a separate permit application. MOTION CARRIED 7.3 DP 2025097 Home-Based Business Type Two, Vehicle repair The Development Officer provided background information on the item and responded to questions from MPC. The applicant was present and responded to questions from MPC. P-06/26 MOVED BY REEVE ARNO DOERKSEN that the Municipal Planning Commission APPROVE Home-Based Business Type Two Permit 2025097 for the operation of a vehicle services business, on lands legally described as Block 1, Plan 8211065, SW 12-21-18- W4. This development approval is subject to the conditions outlined below. DP 2025097 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Residential Rural District (Schedule 2) Section 3, Generai Regulations and Section 4, Specific Uses and Activities. as specified in the County of Newell Land Use Bylaw 2016-21. 3. Adjacent landowners and referral agencies have been notified and have had the opportunity to comment. Any comments or concerns should be received by the County administration by January 9, 2026. If approved, the following conditions should be considered: 1. This approval is effective as of February 4, 2026 (21-day appeal period). 2. The development must be located as shown on the site plan approved with the application and submitted November 26, 2025. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. 3. That there is no outdoor storage. 4. That no more than one (1) commercial vehicle is parked onsite. 5. That there are no more than 4 business related visits per day. 6. That the applicant mitigates noise and dust. � Page 5 of 9 Municipal Planning Commission January 15, 2026 7. That the Home-Based Business Type Two permit is only valid for the time that the property is occupied by the applicant. 8. The applicant/owner must obtain all construction permits applicable to development and is responsible to ensure all permits are closed with work complying to the building code. 9. That the proposed development complies with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 10. Any additional development shall require prior approval of a separate permit application. MOTION CARRIED 8. SUBDIVISIONS 8.1 Subdivision 2025-0-016 To subdivide a 0.051-hectare (0.13 acre) parcel from the SE 7-20-14W4M (CoT 241 317 364+2) to be consolidated with Plan 241 2440, Block 7, Lot 4(CoT 241 317 364 The Planning & Development Supervisor provided background information on the item and responded to questions from MPC. P-07/26 MOVED BY REEVE ARNO DOERKSEN that the MPC approve, with conditions, the subdivision of a 0.051-hectare (0.13 acre) parcel from the SE 7-20-14W4M (CoT 241 317 364+2) to be consolidated with Plan 241 2440, Block 7, Lot 4(CoT 241 317 364) for the following reasons 1. The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions to be Considered: 1. That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. That, pursuant to Section 655(1)b of the MGA, the applicant enters into a Development Agreement with the County which shall be registered concurrently with the finai plan against the title(s) being created. 4. That the subdivided parcel is consolidated with Plan 241 2440, Block 7, Lot 4 in the SE 7-20-14W4M and no new lots are being created. Reserve: Municipal Reserve is not applicable as no new lots are being created. MOTION CARRIED 8.2 Subdivision 2025-0-017 To subdivide a 0.530-hectare, (1.31-acre parcel) from Lot 1, Block 5, Plan 2117375 (CoT 221 198 219) for residential purposes. The Supervisor of Planning & Development provided background information on the item and responded to questions from MPC. The Applicant was present to respond to questions from MPC. The Applicant expressed concern with the condition requiring the PSDS on both parcels to meet the Alberta Safety Codes Standard prior to the issuance of title, stating that the cost of upgrading both PSDS systems simultaneously is significant. The Applicant requested that the newly created parcel meet PSDS standards prior to subdivision finalization, and the remnant parcel be upgraded within 12 months following title issuance. Additional background was provided regarding the shared /agoon system. Administration provided the reasons for recommending the PSDS compliance for both systems prior to subdivision finalization. Administration provided MPC with the option to defer the com�Jliance requirement for the remnant parcel through the provisions of a development agreement. The Applicant shall provide proof that the PSDS for the proposed parcel meets Alberta Safety Codes Standards prior to subdivision finalization. The Applicant shall enter into a development agreement requiring the remnant parcel to meet Alberta Safety Codes Standards within 12 monfhs of title issuance. A 25% security deposit based on the estimated cost of the potential upgrade, shall be provided and held until compliance is achieved. P-08/26 MOVED BY REEVE ARNO DOERKSEN that the MPC approve, with conditions, the subdivision of one lot, 0.530 ha (1.31 acre) in size, from Lot 1, Block 5, Plan 2111375 (CoT 221 198 219) for residential purposes, for the foliowing reasons: 1. The proposed subdivision is consistent with the SSRP and complies with the County of Newell MDP, and the Land Use Bylaw. Page 7 of 9 1 .. Municipal Planning Commission �, January 15, 2026 2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision and Development Regulations. Conditions to be Considered: 1. That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant supplies copies of any utility right of way plans, easements, and/or agreements which are to be registered as a requirement for any affected utilities to the County prior to the subdivision's registration with Alberta Land Titles. 3. That, pursuant to Section 655(1)b of the MGA, the applicant enters into a Development Agreement with the County which shall be registered concurrently with the final plan against the title(s) being created. 4. That the proposed 7-metre-wide access right-of-way be extended to ensure access to the frontage of the dwelling. 5. That a 20-metre-wide service road be dedicated by caveat on the RR142 frontage along the west side of the proposed and remnant parcel. 6. That the applicant provide proof that the Private Septic Disposal system on the proposed parcel meets the Alberta Safety Code Standard prior to the finalization of the subdivision. 7. That the applicant enters into a Development Agreement with the County to ensure the Private Septic Disposal System on the remnant parcel meets the Alberta Safety Code Standard within one year after the registration of the subdivision. Reserve: Municipal Reserve is not applicable as it was paid as money in place of land when the parcel was first subdivided (subdivision file 83-SE 016). MOTION CARRIED � 10.
