Municipal Planning Commission February 12, 2026 -10:00 AM
The regular Municipal Planning Commission (MPC) Meeting of the County of Newell was held in
the County Office at Brooks, AB and livestreamed to the public on Thursday, February 12, 2026
commencing at 10:00 a.m.
A notice was posted at the front entrance advising the public of the meeting.

5. ADOPTION OF AGENDA
P-11/26 MOVED BY COUNCILLOR NEIL JOHNSON that the agenda be adopted as presented.

6. DEVELOPMENT REPORT
The Development Officer presented the Development Report and responded to questions
from MPC. This item was accepted as information.
7. DEVELOPMENT PERMITS
7.1 DP 2025100 Approval of an existing shop with a variance to the side yard
setback.
The Development Officer provided background information on the item and
responded to questions from MPC. The applicant was present to provide
background information on the item and responded to questions from MPC. The
Planning of Development Supervisor responded to questions from MPC regarding
setbacks.
P-12/26 MOVED BY REEVE ARNO DOERKSEN that the Municipal Planning Commission
APPROVE Development Permit 2025100 for the approval of an existing 253 mz (2720 ftz)
shop with a variance to the rear yard setback on lands legally described as Lot 1, Block 1,
Plan 0813267, SE 33-20-15-W4. This development approval is subject to the conditions
outlined below.
DP 2025100 is Approved for the following reasons:
1. The Development Authority is satisfied that the proposed development is suitable for
the purpose for which it is intended under the Industrial General District (Schedule 2)
Section 3, General Regulations and Section 4, Specific Uses and Activities. as
specified in the County of Newell Land Use Bylaw 2016-21; except the proposed
variance.
2. The proposed development complies with the Municipal Development Pian.
3. Any comments or concerns from adjacent landowners and referral agencies should be
received by February 6, 2026. Should no concerns be raised administration
recommends approval.
If approved, the following conditions should be considered:
1. This approval is effective as of March 4, 2026 (21-day appeal period). �

2. The development complies with provisions pertaining to the Agriculture General
District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw
#2016-21.
3. The development must be located as shown on the site plan approved with the
application and submitted December 16, 2025. It must be built according to the
description provided with this approval. Any changes shall require the written approval
of the Development Authority.
4. That the proposed development complies with all Federal, Provincial and Municipal
statutes, regulations, codes and standards.
5. That the appiicant obtains approved safety codes permits for the development,
specifically building, electrical, gas, plumbing and private septic disposal where
applicable.
6. That the following setbacks on ail sides are maintained for this development:
Front (east): 30 m (100 ft)
Rear (west): 3 m(10 ft); variance from 6 m(20 ft)
7. That no structures be located on a right of way or easement on the parcel.
8. Any additional development or intensification shall require prior approval of a separate
permit application.
9. That the construction is completed by March 4, 2028. In the event that this date cannot
be met, the developer must apply for an extension and may be required to apply for a
new permit.

7.2 DP 2026002 Approval of an addition to a dwelling with a variance to the side
yard setback.
The Development Officer provided background information on the item and
responded to questions from MPC. The applicant was present to provide
background information on the item and responded to questions from MPC.
P-73/26 MOVED BY COUNCILLOR ADENA SKANDERUP that the Municipal Planning
Commission APPROVE Development Permit 2026002 for the approval of an addition to
dwelling, specifically an 8.9 m2 (96 ft2) roof extension, 45 mZ (480 ftZ) roof extension and
59 m2 (640 ft2) deck on lands legally described as SE 11-15-14-W4. This development
approval is subject to the conditions outlined below.
DP 2026002 is Approved for the following reasons:
The Development Authority is satisfied that the proposed development is suitable for
the purpose for which it is intended under the Agriculture General District (Schedule
2) Section 3, General Regulations and Section 4, Specific Uses and Activities. as
specified in the County of Newell Land Use Bylaw 2016-21; except the proposed
variance.

8. SUBDIVISIONS
8.1 Subdivision 2025-0-018: To subdivide a 1.13-hectare (2.79 acre) portion of
Plan 771 0473, Lot 2, to be consolidated with Plan 475EU, Parcel "A" in the
NE 15-19-14W4M.
The Planning & Development Supervisor provided background information on the
item and responded to questions from MPC.
P-14/26 MOVED BY COUNCILLOR LYNETTE KOPP that the MPC approve, with conditions,
the subdivision of a 1.13-hectare (2.79 acre) parcel from Plan 771 0473, Lot 2(CoT 921
188 012 +1) to be consolidated with Pian 475EU, Parcel "A" (CoT 251 080 564 +3) for the
following reasons:
1. The proposed subdivision is consistent with the SSRP and complies with the County
of Newell MDP and the Land Use Bylaw.

2. The Subdivision Authority is satisfied that the proposed subdivision is suitable for the
purpose for which the subdivision is intended pursuant to Section 7 of the Subdivision
and Development Regulations.
Conditions to be Considered:
That, pursuant to Section 654(1)(d) of the MGA, all outstanding property taxes shall
be paid to the County of Newell.
2. That the applicant supplies copies of any utility right of way plans, easements, and/or
agreements which are to be registered as a requirement for any affected utilities to the
County prior to the subdivision's registration with Alberta Land Titles.
3. That, pursuant to Section 655(1)b of the MGA, the applicant enters into a Development
Agreement with the County which shall be registered concurrently with the final plan
against the title(s) being created.
4. That the subdivided parcel is consolidated with 475EU, Parcel A in the NE 15-19-
14W4M and no new lots are being created.
Reserve:
Municipal Reserve is not applicable as no new lots are being created.
