Minutes of Council Meeting
May 22, 1997
The regular Council Meeting of the County of Newell No. 4 was held in the County Office at
Brooks, AB on Thursday, May 22, 1997 commencing at 10:00 a.m.

Minutes of the May 8, 1991 meeting were presented. Moved by Councillor Stobbs that we
adopt these minutes as circulated. Carried.

5. Business from Minutes
13. Contracting of Management Consultant
This item remained tabled.
Moved by Councillor Baksa that we add the Retreat to post agenda items. Carried.
14.1 Press Release -Draft Municipal Development Plan
Administration presented a draf t copy of the press release. Moved by Councillor Stobbs that we
approve the draft copy of this press release. Carried.
14.2 Advertising
Moved by Councillor Daniels that we lift this item from the table. Carried.

Moved by Councillor Fabian that we advertise once in the Brooks Bulletin to every two times in
the Paper. Uote on the motion -lost.
Moved by Councillor Berg that we do our regular advertising in the Brooks Bulletin and that the
advertising for M.P.C. be done in the Paper until the end of 1991. Uote on the motion -lost.
Moved by Councillor Harbinson that Administration decide on where advertising will be done.
Carried.
15. Membership on Committee • S.D.A.B. Representative
Moved by Councillor loewen that we appoint Liz Buday as a representative-at•large on the
Subdivision & Development Appeal Board. Carried.

6. Correspondence
1. Town of Brooks • Donation -Brooks Recreation Aquatic Centre
A letter from the Town of Brooks requesting donations far the Brooks Recreation Aquatic Centre
was presented. Moved by Councillor Baksa that a letter be sent to the Town advising that the
County contributes a recreation requisition to the Town of Brooks for recreation funding and no
further donations will be given. Carried.
2. Town of Brooks - S.W. Annexation
A letter from the Town of Brooks advising that they have sent their application far annexation
to the Municipal Government Board was presented. Moved by Councillor Fabian that we hold
another meeting with the Town of Brooks Council at the County Office as soon as possible.
Carried.
Moved by Councillor Loewen that a letter be sent to the Municipal Government Board advising
them of the County`s objections regarding this annexation. These objections are: not including
the road running south of the annexation in their proposal; that Council does not feel this is a

~ ~`` minor application; that direct negotiations in trying to resolve these issues did not take place; and

1~ J ~~AR that Council feels the process laid out in the Municipal Government Act for annexations was not
adequately (allowed. Carried.
7. Dele ation
1. Alberta Wheat Pool -Lawrence Nicholson
Lawrence Nicholson, of the Alberta Wheat Pool, was in attendance at the meeting regarding the
development of the Wheat Pool elevator at Cassils. He asked for a commitment from Council
regarding the access roads from Highway #36 to the proposed development and the road from
Highway #1 to the proposed development, stating that it is necessary to have a high quality
market road access to this elevator. After discussion, it was moved by Councillor Harbinson that
we build a road from Highway #36 to Cassils to accommodate Wheat Pool traffic. Carried.
Moved by Councillor Harbinson that a letter be sent to the M.I.A., the M.P., and the Brooks
Trucker's Association requesting assistance for #unding from the Government for the up-grading
of this road. Carried.

3. Town of Brooks • Section 1111) • Subdivision & Development Regulations
A letter from the Town of Brooks advising that they have sent a letter to Alberta Municipal
Affairs requesting that Section 11(1) remain in effect until an Inter-municipal Development Plan
is adopted by the Town of Brooks and the County. Moved by Councillor Daniels that a letter
be sent to the Town of Brooks advising them that, as we have an Urban Fringe Agreement in
place at this time in the County's land Use Bylaw, we do not feel it will have an effect on us
if this section is removed September 1st, and that we are in agreement with the A.A.M.D. & C.'s
position to have this section expire September 1, 1991. Carried.
Moved by Councillor loewen that we send a letter to the Minister of Municipal A#fairs, the
Honourable Iris Evans, stating our views and agreeing with the position that this section expire
on September 1,1991 and also advising that we have an Urban Fringe Agreement in our land

Use Bylaw and have had ample time to get an new Inter•municipal Development Plan in place.
We have had over 10 meetings but progress seems to be very slow regarding agreement on this
Plan. Carried Unanimously.
4. Alberta Environmental Protection • Brooks Wastewater Release to One Tree Reservoir
A letter from Alberta Environmental Protection regarding the release of wastewater into the One
Tree Reservoir was presented to Council for information.
8. Other Business
1. P.F.R.A. • Rallinq Hills Water Supply System Study
A study completed by the P.F.R.A. on the Rolling Hills Water System was presented to Council.
Moved by Councillor Daniels that we send a copy of this study to the Rolling Hills Hamlet
Advisory requesting their input regarding the recommendations contained in this study. Carried.

9. Municipal Development Plan
A draft copy of the proposed Municipal Development Plan was presented to Council. Moved by
Councillor Fabian that we approve the May, 1997 draft copy. Carried.
10. Bylaw 1218.97
By-law 1218.97, being a Bylaw far the adoption of the Municipal Development Plan, was
presented.
Moved by Councillor Berg that By-law 1218.91 receive first reading. Carried.

Moved by Councillor loewen that we approve the Treasurer's Report for April. Carried.

13. Post Agenda Items
1. Jager Road
Information on the procedures for the local Improvement Plan for the Jager Road were presented
to Council by the Administrator. The road standards and costs of this road will be brought up
at the Municipal Committee Meeting at which time this item will be brought back to the Council
table.
2. Tax Penalty Dates
Information was presented by Councillor Stobbs on concerns the public has on our tax penalty
date.
3. Aimoto Estates
Councillor Steinbach brought concerns to Council regarding the house numbers and road signage
at Aimoto Estates. The road signage will be brought to the Municipal Committee Meeting.
Councillor Steinbach will approach the residents in Aimoto Estates for a possible solution
~~~ regarding house numbering.

4. Railway line Abandonment & Sale
Councillors Harbinson, loewen and the Administrator reported on concerns from an individual
regarding the County's position on consolidation of this right•af•way into the parcel that it
originally came from.
5. Retreat
Moued by Councillor Daniels that we hold a retreat. Moved by Councillor loewen that this
motion be amended by adding: "and that an independent facilitator be used at this Retreat."
Vote an the amendment -Carried. Vote on .the amended motion • Carried.
Moved by Councillor loewen that tentative dates be set for August 18 & 19, 1997. Carried.
Moued by Councillor Berg that we look into the possibility of holding this Retreat at the Brooks
Sailing Club at Lake Newell. Vote on the motion • lost.
