Minutes of Council Meeting
January 9, 1997
The regular Council Meeting of the County of Newell No. 4 was held in the County Office at
Brooks, AB on Thursday, January 9, 1991 commencing at 10:00 a.m.

2. Minutes
Minutes of the December 19, 1996 meeting were presented. Moved by Councillor Berg that we

3. Call for Post Agenda Items
The Reeve called for post agenda items.

Moved by Councillor Stobbs that we adopt the agenda as amended. Carried.
5. Business from Minutes
10.1 Emergency Medical Responder Training Pro ,ram
Moved by Councillor loewen that we accept this as information. Carried.
7.4 Music Fest By-law 1204.96
Moved by Councillor Loewen that By-law 1204.96 receive third reading. Carried.

Moved by Councillor Daniels that we lift this item from the table. Carried.

Moved by Councillor Daniels that we amend the amendment by deleting "10` right-of-way" and
adding "5-metre right-of-way". This amendment will now read: "subject to a 5-metre right-of-
way on the south side of the road allowance lying north of this proposed subdivision." Moved
by Councillor Scheuerman that we table this application for more information from our P.W.
Department. Carried.
13.3 litter By-law 1206.97
Moved by Councillor loewen that By-law 1206.91, being a By-law to control litter within the
County of Newell from areas zoned Public Solid Waste Management Districts and Public Waste
Transfer Site Districts, and the transportation of wastes to these sites, receive first reading.
Carried.
Moved by Councillor Berg that Bylaw 1206.97 receive second reading. Moved by Councillor
Harbinson that we amend Item 7 to read: "any person caught shall be subject to a fine of
$50.00." Vote on the amendment -Carried. Vote on second reading -Carried.

13-6 Investments
Finance Officer, Phil Martin, was in attendance at this meeting and presented a list of four
recommendations. Moved by Councillor toewen that the Finance Officer proceed with the
recommendations presented regarding our investments. Carried.
Moved by Councillor Daniels that we tender far our banking requirements separate from our
investments. Carried.
14 Notice of Motion
Maned by Councillor Daniels that the County`s Bylaw Control Officer monitor the vehicles hauling
waste to the County's modified landfills on one of the days they are open and that he give a
warning to anyone hauling waste to the landfill whose load of waste is not adequately contained,
secured, or covered to prevent it from falling onto the highway and that he report back at the
February 3, 1997 Municipal Meeting. Carried.

week, monitor the transporting of waste on the County roads on a day when the landfills are

6. Correspondence
1. Alberta Environmental Protection • local Reclamation Inspectors
Moved by Councillor Berg that we accept this as information. Carried.
2. Town of Brooks • S.W. Annexation Proposal
A letter from the Town of Brooks regarding their S.W. Annexation Proposal was presented to
Council. Maned by Councillor Harbinson that a letter be sent to the Town of Brooks advising
them that, under Section 18.2 of the Municipal Government Act, they are responsible for roads
and road diversions lying south of their boundaries, and that until such time as the Town advises
the County that they accept the responsibility of the road south of the proposed annexation,
Council is not prepared to give approval to this annexation. Carried.

Moved by Councillor Berg that Bylaw 1205.97, being a Bylaw for the establishment, functions
and powers of Council Committees, receive first reading. Carried.
Moved by Councillor Baksa that Bylaw 1205.91 receive second reading. Moved by Councillor
Scheuerman that this Bylaw be amended by changing Item 5 to read: "budget review by the
Municipal Budget Committee." Uote on the amendment -Carried. Uote on second reading -
Carried.

Moved by Councillor Berg that we recess for a Public Hearing at 1:30 p.m. Carried.

10. Public Hearing -Agricultural to Country Residential

Moved by Councillor Stobbs that we recess for a Public Hearing at 2:00 p.m. Carried.
The meeting reconvened at 2:10 p.m.

11. By-law 1202.96
Moved by Councillor Baksa that By-law 1202.96 receive second reading. Carried.
Moved by Councillor Baxter that By-law 1202.96 receive third reading. Carried.
12. Other Business
Caoital Budaets
The Capital Budgets for all departments were presented to Council. Moved by Councillor Stobbs
that we approve the Capital Budget for 1997 for all departments and proceed with these
' purchases. Moved by Councillor Harbinson that this motion be amended by adding: "except for
;~,,,r~ the A.S.B. half-ton truck and the P.W. half-ton truck." Vote on the amendment -Carried. Vote

2. Regulated Assessment Review
Moved by Councillor Stobbs that we refer this to the next meeting and that we have our
Assessor present at that meeting. Carried.
13. Committee Reports

Sale of Abandoned Railway Riaht•af-wa
Information was presented to Council on the abandoned right-of-ways that CP Rail still have in
their possession. Moved by Councillor Daniels that a letter be sent to CP Rail advising that the
County of Newell is interested in all of the property contained within this abandoned rail line in
the County of Newell. Carried.

Z. Randy Baksa -land Use Change • NW 1.19.14.4 • Agriculture to Country Residential
Councillor Baksa asked to be excused from, discussion and voting on this item and left the Council
Chambers.
Randy Baksa was in attendance at the meeting. Moved by Councillor Stobbs that we approve
this land use change and that it take effect on the date that a subdivision for this parcel is
registered. Carried.
Bylaw 1207.97
Moved by Councillor loewen that Bylaw 1207.97, being a Bylaw to amend land Use Bylaw
1004.90 in Pt. NW 1.19.14.4 (containing 40 acres) from Agriculture to Country Residential,
receive first reading. Carried.
Councillor Baksa returned to the Council Chambers and resumed participation in the meeting.

Moved by Councillor Fabian that we approve this subdivision subject to the applicant meeting all
requirements of the Eastern Irrigation District with respect to the conveyance of water; and
subject to the applicant entering into a Development Agreement with the County of Newell #or
the provision of access to the remnant parcel. Carried.
4. Alberta Municipal Affairs -land Use Policies
A copy of the land Use Policies were presented to Council for information.

1. By-law 1173.96
Discussion took place on Bylaw 1173.96 allowing snow vehicles to operate on the untravelled
portion of our road allowances. Administration is to investigate and bring proposed amendments
to the next meeting.

2. Hirin~ Cq ommittee
Moved by Councillor Douglass that a Hiring Policy be established for all County departments in
which the hiring of all employees be done by an Administrative Hiring Committee of three, which
is to consist of one or two members from the department doing the hiring and the Administrator
andlor Assistant Administrator, unless otherwise determined by Council resolution. Carried.
14. Post Agenda Items
1, Gem Grader Building
A letter from the Gem Rural Fire Association requesting funding far utilities on the building in
which the Gem grader is housed was presented to Council. Moved by Councillor Daniels that we
reimburse the Gem Rural Fire Association $1,000.00 per year towards the utilities and
maintenance of this building and that this amount be reviewed annually. Carried.
2. Town of Brooks • Fire Protection -Subdivisions
A letter from the Town of Brooks requesting consideration in ensuring that water is available for
fire fighting in rural subdivisions was presented to Council. Moved by Councillor Baksa that we
refer this to the M.P.C. for review and a recommendation, to be brought back to a future Council

3. Emergenc~Operation Centre
Councillor Scheuerman presented information on the Emergency Operation Centre. Administration
is to invite Ken Jones, Disaster Services Officer, to attend a future Council Meeting for f urther
information.
4. Accounting Procedures
Councillor Baxter requested information regarding the revision of our accounting procedures.
5. Regional landfill
Moved by Councillor Baxter that all garbage in the County of Newell go through a transfer site
before being transported to the Regional landfill. 1Jote on the motion -lost.
Moved by Councillor Baksa that we recommend to the Newell Regional Solid Waste Mana ement

In Camera
Moved by Councillor Stobbs that we move into camera. Carried.
Moved by Councillor Baksa that we move out of camera. Carried.
Moved by Councillor Berg that we negotiate with C.U.P.E. local #1032 for stand-by hours for
truck drivers on Saturdays & Sundays, and the addition of a new position in the C.U.P.E.
Bargaining Unit. Carried.
P.W. Supervisor, Rod Hansen, presented information on soils and equipment #or gravel testing and
dirt testing. Moved by Councillor Baxter that we proceed with the purchase of this equipment
and that it be added to the 1991 Budget. Carried.

There was one member of the public in attendance at this Public Hearing.
Mr. Joe Duenk ask questions of Council as to how this would affect his property.
Council was given the opportunity to ask questions of Mr. Duenk.
There being no further questions or comments, it was moved by Councillor Baksa that the Public
Hearing adjourn at 1:50 p.m. Carried.

The Administrator presented a letter from the Town of Brooks stating their concerns over the
redesignation of this property.
There being no further questions or comments, it was mooed by Councillor Baxter that the Public
Hearing adjourn at 2:10 p.m. Carried.
