Minutes of Council Meeting
November 1, 1996
The regular Council Meeting of the County of Newell No. 4 was held in the County Office at
Brooks, AB on Thursday, November 7, 1996 commencing at 10:00 a.m.

2. Minutes
Minutes of the October 24,1996 meeting were presented. Moved by Councillor Baxter that we
adopt these minutes as circulated. Carried.
3. Call for Past Agenda Items
The Deputy Reeve called for post agenda items.
4. Adoption of Agenda
Moved by Councillor Stobbs that we adopt the agenda as amended. Carried.

5. Business from Minutes
8.1 911 Surve
The Administrator presented a 911 Survey for County residents. Moved by Councillor Harbinson
that we approve the 91 ~ Survey as presented. Carried.

Councillor Daniels arrived at the meeting at 10:12 a.m.
11.4 Convention Resolutions
The Administrator presented the resolutions to be brought forth at the Fall Convention. After
review, the decision was that Council will vote individually at the Convention after hearing the
comments of the assembly.
6. Correspondence
1. Alberta Municipal Affairs • Manufactured Homes Taxation Review

Council was presented with a draft copy of the Manufactured Homes Taxation Review. After
discussion, it was moved by Councillor Baksa that we approve the recommendations as presented
by the Assessor, John Dell. Carried.
7. Other Business
There was no other business.
8. Cheques for Payment
Moved by Councillor Baksa that Cheques #8846 • 9015, in the amount of X580,674.55, be
approved for payment. Carried.

Moved by Councillor loewen that we approve #his subdivision subject to the applicant entering
into a Development Agreement with the County of Newell for the construction of the service
road, the installation of approaches from the service road to each proposed parcel, the addition
of a road approach from S.H. 542 to the service road at the east end of the proposed subdivision
and removal of any additional approaches between these two approaches, allowing only two
approaches to the subdivision at the west and east ends; and subject to the applicant meeting
all requirements of the Eastern Irrigation District with respect to the conveyance of water.
Carried.

Moved by Councillor loewen that we approve this Area Structure Plan, in principle, subject to

the developer ensuring that the water dug-out on lot 3A meets the County of Newell set-back
regulations of 40 metres and subject to a 1l' dedication for road allowance E of lots 1, 2, 3
& 15 along the local Government road allowance. Carried.
10. Dele ation
1. Brooks & District Ambulance Association
Gerry Schaffer & Gary Hingley, from the Bassano Ambulance Association and the Town of
Bassano, and Larry Albrecht & Darren Lloyd, from the Brooks & District Ambulance Association,
met with Council. They presented an agreement between the Brooks & District Ambulance
Association and the Bassano Ambulance Association whereby 50°l0 of the requisition funds from
Division 6 would be returned to the Bassano Ambulance Association for calls outside the Bassano
area in the County of Newell; and also an agreement far co-operation between the two
Ambulance Associations. Moved by Councillor Scheuerman that we support the agreement, as
presented, between the Brooks & District Ambulance Association and the Bassano Ambulance
Association. Carried.
Moved by Councillor Baksa that we budget for training of four members under the Emergency
Medical Responder Training Program each year and that two individuals per area be allowed to
take this training. Moved by Councillor loewen that this motion be tabled. Carried.

Moved by Councillor loewen that we approve this subdivision subject to the applicant
consolidating the Title of the remnant parcel with the balance of the quarter section; and subject
to the applicant meeting all requirements of the Eastern Irrigation District with respect to the
conveyance of water. Carried.

Sale of Abandoned Railway Right of-way
Discussion took place on the procedures used by the C.P.R. & C.N.R. in selling abandoned right-
of-ways, and the adjacent landowners not being given f first priority. Moved by Councillor loewen
that the Municipal Planning Commission review the procedures for the sale of abandoned railway
right-of-ways and bring this information to a future Council Meeting. Carried.

By-law 1198.96
The Administrator presented By-law 1198.96, being a By-law to close and lease that portion of
road allowance E of NE 32.14.15.4 (C. Vermeeren). Moved by Councillor Daniels that By-law
1198.96 receive first reading. Carried.

1. Regional landfill
Councillor Daniels advised that an appeal will be held on November 20,1996 at Callaghan's Inn
and requested a letter of support from the County for the landfill site. Moved by Councillor
Daniels that Council send a letter to the Regional landfill Authority supporting the location for
the site of the Regional landfill. Councillor Harbinson requested a recorded vote. Those voting
for the motion: Div. 1 -Councillor Daniels; Div. 2 -Deputy Reeve Fabian; Div. 3 -Councillor
Berg; Div. 4 -Councillor Stobbs; Div. 6 -Councillor Baxter; Div. 7 • Councillor loewen; and Div.
8 -Councillor Scheuerman. Those opposed to the motion: Div. 5 -Councillor Harbinson. Those
absent - Div. 9 -Councillor Douglass & Div. 10 -Councillor Baksa. Motion -Carried.
2. Unit #221 -Scraper Accident
Information regarding this scraper will be brought to the meeting after the Public Hearing.
12. Public Hearing - Whale} Mar -land Use Change -Sec. 33.18.15.4

Moved by Councillor loewen that By-law 1191.96, being a By-law to amend land Use By-law
1004.90 in Pt. Sec. 33.18.15.4 from Agriculture to Mobile Home Park, receive second reading.
Moved by Councillor loewen that we amend By-law 1197.96 by adding, after the legal
description: "containing approximately 45.44 acres." Vote on the amendment -Carried. Vote
on second reading -Carried.
Moved by Councillor Berg that By-law 1197.96 receive third reading. Carried.

Minutes of Public Hearing
November 1, 1996
A Public Hearing of the County of Newell No. 4 was held in the County Office at Brooks, AB on
Thursday, November 7, 1996 commencing at 1:30 p.m.

The Deputy Reeve opened the Public Hearing at 1:30 p.m.
The Public Hearing dealt with By-law 1191.96, being an amendment to land Use By-law 1004-90
for a land use change in Pt. Sec. 33.18-15-4 (containing approximately 45.44 acres) from Agriculture
to Mobile Home Park.
Four members of the public were in attendance at this Public Hearing: the applicant, Whaley Mar;
Paul Seaton, landowner; Steve Harrison, from PanCanadian Petroleum limited; and Robert Matoba,
from the Eastern Irrigation District.
Mr. Mar was given the opportunity to address his application for land use change. He had nothing
to add to the application at this time.
Mr. Seaton addressed his objections as follows:
1) that Brooks and area is an appealing place to live and he feels that low-cost mobile homes will
take away the pleasant atmosphere around the Town of Brooks.
Z) he feels that mobile home parks situated in numerous areas around the County are, perhaps, not
in the best interest and that Council should have a better plan for areas for mobile home parks.
Mr. Harrison addressed the hearing and advised that he is not in opposition but was here on behalf
of PanCanadian Petroleum limited, as they have a pipeline that runs across this parcel.
Mr. Matoba did not wish to speak at this hearing.
Council was giuen the opportunity to ask questions of the members of the public.
Mr. Mar was giuen the opportunity for rebuttal regarding the responses from those objecting to the
land use change.
Council was again given the opportunity to ask questions of all individuals.
There being no further questions or comments, it was moved by Councillor Stobbs that the Public
Hearing adjourn at 1:58 p.m. Carried.
