Minutes of Council Meeting
May 9, 1996
The regular Council Meeting of the County of New lei No. 4 was held in the County Office at
Brooks, Alberta on Thursday, May 9, 1996 commencing at 10:00 a.m.

2. Minutes
Minutes of the April 25, 1996 meeting were presented. Moved by Councillor Loewen that we

3. Call far Post Agenda Items
The Reeve called for post agenda items.
4. Adoution of Agenda
Moved by Councillor Stobbs that we adapt the agenda as amended. Carried.

6-1 Hamlet of Patricia -Patricia School
The Administrator advised that no further information has been obtained at this time.
911 Meeting -June 4196 -Heritage Inn - 6.30 p m
Administration advised that a 911 Meeting has been set up at the Heritage Inn at 6:30 p.m. on
Tuesday, June 4, 1996.
8-4 L & W Management -Tax Refund - Kinbrook
Administration presented information regarding the request for a tax refund for the months of
November & December, 1995 for L & W Management, as they were not leasing this property
at that time. Moved by Councillor Berg that we approve the re#und of 5565.12 and that this
be credited to their 1996 taxes. Carried.
Correspondence
1. Gem Rura) Fire Association -Construction of Fire Truck Building -Plan 5146 FF -Gem
A request from the Gem Rural Fire Association to construct a building on County property at the
above-noted location in Gem was presented to Council. Moved by Councillor Stobbs that we
approve this request provided the Gem Rural Fire Association be responsible for obtaining all of
the necessary permits required for this building. Carried.
2. Alberta Seniors Advisory Council -Senior Citizens' Week -June 2.8196
Moved by Councillor Loewen that we proclaim the week of June 2.8, 1996 as Senior Citizens'
Week. Carried.
3. Legislative Assembly - Judv Gordon -Ground Ambulance Task Force
Arrived at Meeting
Councillor Harbinson arrived at the meeting at 10:15 a.m.

Information was presented on the Ground Ambulance Task Force for review.

7. Cheques for Payment
Moved by Councillor Baxter that Cheques #7689 - 7844, in the amount of $693,646.81, be
approved for payment. Carried.
8. Other Business
There was no other business.
9. Alberta Government Assessment Change -Horticultural Station & Pheasant Hatchery
The Assessor, John Dell, was in attendance to provide Council with information he had received
from the Alberta Government regarding changes to assessment on the Horticultural Station and
r Pheasant Hatchery. He also provided information regarding a decrease of approximately
l;~ $50,000.00 in taxes, if this change is made this year. Moved by Councillor Baxter that a letter
be sent to the Government expressing our concerns at the loss of revenue and the impact this
would have on the County budget which has already been passed, and request that they proceed
in the same manner as the average individual regarding appealing their assessment and that this
not take place until 1997. Carried.

Moved by Councillor Loewen that Council accept the recommendations from the Agricultural
Service Board regarding the Duchess Landfill Site and that our taxpayers be informed of the costs
to the County in using the Duchess Landfill and that, because of these costs, they will be
directed to haul to either the Rosemary or Patricia Landfills. Carried.

11. Post Agenda Items
1. Music Fest. -Police Services
Administration presented costs received from the R.C.M.P. regarding additional policing services
they feel would be required for the Westwinds Entertainment Management Inc: Music Fest. to
be held this summer. Administration is to obtain abreak-down of these costs and to check with
Camrose regarding the policing services required there.
12. Public Hearing -Dwelling Units Per Parcel & intensive Livestock Confinement
Moved by Councillor Berg that we recess for a Public Hearing at 11:00 a.m. Carried.
13. By-law 1185-96 -Dwelling Units
Administration presented By-law 1185-96, being an amendment to Land Use By-law 1004-90
regarding Section 31 -Dwelling Units Per Parcel. Moved by Councillor Fabian that By-law
1185-96 receive second reading. Moved by Councillor Daniels that we amend this By-law by
j~ deleting Item #2, which reads::- "The Municipal Planning Commission may exempt any person or
~'~ • t land from the application of this section." Vote on the amendment -Lost.
Moved by Councillor Berg that Item #2 be amended to read: "The Municipal Planning Commission
may grant a waiver to any person or an land from the application of this section." Vote on the
amendment -Carried. Vote on second reading -Carried.
Moved by Councillor Baksa that By-law 1185-96 receive third reading. Carried.
14. By-law 1186-96 -Intensive Livestock Confinement
Administration presented By-law 1186-96, being an amendment to Land Use By-law 1004-90 to
include definitions for Intensive Livestock Operations. Moved by Councillor Loewen that By-law
1186-96 receive second reading. Carried.

2. Duck Lake Road
Letters from Joseph P. Hofer & Martin J. Hofer, and Elizabeth G. Miller & Mary Bartman, along
with a list of an extensive number of individuals, concerning the condition of the Duck Lake Road
and asking Council to remedy this situation, were read to Council.
15. Public Hearing -Richard Veen - E'/z 36-20-15-4 -Agriculture to Countrv Residential
Moved by Councillor Baksa that we recess for a Public Hearing at 12:00 noon. Carried.
16. By-law 1183-96 -Land Use Change - E'/Z 36-20-15-4
Administration presented By-law 1183-96, being an amendment to Land Use By-law 1004-90 for
a land use change at E'IZ 36.20-15-4 from Agriculture to Country Residential. Moved by
Councillor Loewen that By-law 1183-96 receive second reading. Moved by Councillor Loewen
that By-law 1183-96 be amended by adding the following clause: "This By-law is to take effect
on the date of registration of Registered Plan for the subdivision." Vote on the amendment -

17. Public Hearing -Ramer Ranches - Pt. SW 13-20.15-4 -Agriculture to Countrv Residential
Moved by Councillor Stobbs that we recess for a Public Hearing at 2:30 p.m. Carried.
18. By-law 1 i 84-96 -Land Use Change - Pt. SW 13-20-15-4
Administration presented By-law 1184-96, being an amendment to Land Use By-law 1004.90 for
a land use change at Pt. SW 13-20-15-4 from Agriculture to Country Residential. Moved by
Councillor Berg that Byfaw 1184-96 receive second reading. Moved by Councillor Loewen that

By-law i 184-96 be amended by adding the clause: "This By-law is to take effect on the date
of registration of Registered Plan for the subdivision." Vote on the amendment -Carried. Vote T
on second reading -Carried.

2. Duck Lake Road (Cont'd.)
Moved by Councillor Loewen that funds be taken from the Roadwork Contingency Fund for the
gravelling of the 6 miles of Duck Lake Road in Division 9 and that provisions be made to take
additional funds from the Roadwork Contingency Fund to gravel the area of the Duck Lake Road
in Division 6, if necessary, in 1996 subject to in-put from the Public Works Department regarding
the necessity of this gravel. Carried.
Moved by Councillor Baxter that we invite Alec Waters, from Alberta Transportation & Utilities,
to a future meeting to discuss the Duck Lake Road. Carried.
` 3. Urban Fringe Meeting

,b An Urban Fringe Meeting will be held on June 4, 1996 at 1:30 p.m.
4. Elected Officials Symposium
Councillor Berg reported on an upcoming Elected Officials Symposium. Moved by Councillor
Loewen that those wishing to attend this Symposium be allowed to go. Carried.
• 19. Delegation
1. Ron Axelson -Alberta Cattle Feeders' Association
Ron Axelson, Mark Wright and Don Alberts were in attendance to give a presentation to Council
regarding their letter requesting the County to support a comprehensive study on Rural Taxation
Policy.. After- fhe presentation, it was moved by Councillor Loewen that the motion from the April
11, 1996 meeting be lifted from the table: "Moved by Councillor Berg that we send a letter to
the Honourable Tom Thurber requesting him to do a comprehensive study on the issues of rural
taxation in Alberta." Moved by Councillor Daniels that this item be tabled. Carried.

Moved by Councillor Scheuerman that we request Art Eckert or Arno Doerksen, from Gem, to
~ attend a meeting for more information and that we contact the A.A.M.D. & C. to see if they
have a representative sitting on the present Steering Committee. Carried.
Administration is to obtain information from Lethbridge regarding their business licences.

Jody Osborne and Angela Parkinson were in attendance and presented information and a proposal
for advertising in The Paper.

1. Albert & Patty Snyders -Land Use Change - Pt. NE 27-18-14-4
Urban Fringe to Light Industrial ~-law 1189.96

Patty Snyders was in attendance at the meeting to discuss this proposed land use change.
Moved by Councillor Fabian that we approve this land use change and that By-law 1189-96,
being a By-law to amend Land Use By-law 1004-90 in Pt. NE 27-18-14-4 from Urban Fringe to
Light Industrial, receive first reading. Carried.
2. Agricultural Residence Parcels Per Quarter ~-law 1190-96
Administration presented By-law 1190-96, being a By-law to amend Land Use By-law 1004-90
regarding the number of Agricultural Residence Parcels Per Quarter. Moved by Councillor Loewen
that By-law 1190-96 receive first reading. Carried.
Councillor Fabian presented information on concerns of adouble-standard that may exist in that
agricultural operators are not required to obtain permits for farm buildings, whereas other
individuals require permits to construct buildings for their purposes. Council felt this should be
left as is at the present time.

3. Subdivision 96 NL 07 - SW 28-20-14-4 -Ramer Ranches Ltd.
Moved by Councillor Fabian that we approve this subdivision subject to the applicant entering into
a Domestic Water Agreement with the E.I.D.; subject to the applicant providing any required
easements to the E.I.D. for the conveyance of water; subject to the applicant providing any
required utility easements; and subject to payment of money in-place-of reserve in the amount
of $120.00 per acre being 10% of the market value of the existing parcel of land. Carried.
4. Subdivision 96 NL 09 - NE 8-18-14-4 • Robert Brodie
Moved by Councillor Fabian that we approve this subdivision subject to the applicant entering into
a Domestic Water Agreement with the E.I.D., and subject to the applicant entering into a
Development Agreement with the County of Newell to provide access to the proposed parcel from
the road allowance on the north side of the proposed parcel. Carried.
5. Subdivision 96 NL 12 -Block 15 Plan 8111857 (Patricia) -County of Newell

There being no members of the public in attendance, it was moved by Councillor Stobbs that the

The Reeve opened the Public Hearing and advised that this Public Hearing is in regard to By-law
~, 1183-96, being an amendment to our Land Use By-law regarding a land use change for Richard Veen
in E'/Z of 36-20-15-4, from Agriculture to Country Residential.
Richard Veen and members of the public were in attendance at this hearing. Richard Veen presented
information regarding this proposed land use change.
/~ . ~ Kerry Kopp spoke in opposition to this proposed land use change. The concerns of additional traffic
and a larger subdivision creating additional problems were presented. A letter #rom Kerry Kopp was
also presented to Council. A letter from Norma & Ray MacDonald in opposition to this proposed land
. use change was read by Administration. Eileen Klassen read a letter from Vern & Eileen Klassen in
opposition to the proposed subdivision and provided information regarding the problems with water
at the present subdivision. A letter from Craig & Cindy Ramsay was also read to Council in
opposition to the proposed land use change.
Council questioned members of the public regarding their concerns.
Richard Veen was given the opportunity for rebuttal.
There being no further comments or questions, it was moved 6y Councillor Stobbs that the Public
Hearing adjourn at 12:37 p.m. Carried.
