Minutes of Council Meeting
January 25, 1996
The regular Council Meeting of the County of Newell No. 4 was held in the County Office at
Brooks, Alberta on Thursday, January 25, 1996 commencing at 10:00 a.m.

Moved by Councillor Berg that we excuse Councillor Baksa from this meeting. Carried.
2. Minutes
Minutes of the January 11, 1996 meeting were presented. Moved by Councillor Fabian that we

Minutes of the January 11, 1996 Public Hearing were presented. Moved by Councillor Loewen
that we adopt these minutes as circulated. Carried.

1. Alberta Education - A.S.F.F.
Administration presented a letter from Alberta Education regarding the A.S.F.F. and the Public
School Boards that are opting out.
2. Spring Convention
Administration presented information on the Spring Convention and requested the names of the
• ~ 'individuals planning to attend.
3. Alberta Transportation & Utilities -Retirement -Ken Morris
Letter from Alberta Transportation & Utilities advising of the retirement of Ken Morris from the
Calgary District Office was presented to Council for information.
4. Kyetech Inc. - E911
Letter from Kyetech Inc. regarding the E911 Service was presented to Council. Moved by
Councillor Fabian that we obtain more information from the A.A.M.D. & C. regarding the 911
Emergency Number. Carried.
7. By-law 1168-96 -Penalty By-law
Administration presented By-law 1168-96, being a By-law to set up penalty dates for taxes.
Moved by Councillor Loewen that By-law 1168-96 receive first reading. Carried.

Moved by Councillor Stobbs that By-law 1168.96 be amended to read on Item #2: "November
16th" rather than November 15th. Vote on the amendment -Carried. Vote on the amended
motion -Carried.
Moved by Councillor Berg that Bylaw 1168-96 receive consent of Council for third and final
reading. Carried Unanimously.
Moved by Councillor Loewen that By-law 1168.96 receive third reading. Carried.
8. By-law 1164-95
Administration advised that the advertising has been carried out regarding By-law 1164-95, being
a By-law for a road closure on Plan 8709 Cassils, and that there were no requests to be heard
by Council. Moved by Councillor Berg that we send this By-law to the Minister of Transportation
& Utilities for Ministerial approval. Carried.
9. Other Business
1. Supervisor's Boot Allowance Policy
Administration presented a Policy for safety boot allowance for Supervisors. Moved by Councillor
Baxter that we approve this Policy and insert it in our Municipal Policy Handbook. Carried.
2. Grievance Committee
Administration advised that, with the ratification of the G.U.P.E. Contract, a Grievance Committee
is to be set up. After discussion, it was moved by Councillor Berg that the Reeve or Deputy
Reeve, the Municipal Chairman or a Councillor designated, and the Administrator or the Assistant
Administrator make up the Grievance Committee. Carried.

3. Local Reclamation Expenses
Administration presented information on the per diem for the Local Reclamation Officers and the
reimbursement by the Province on mileage. After discussion, it was moved by Councillor
Scheuerman that we leave the per diem for the Local Reclamation Officers at S 110.00, and that
we pay mileage of 27C1km. Carried.
4. Bar laws
By-law 1170-96
Administration presented a By-law regarding the powers of Committees, which requires changes
due to reorganization and the new Municipal 6ov~rnment Act. Moved by Councillor Loewen that
By-law 1170.96 receive first reading. Carried.
Moved by Councillor Berg that By-law 1170-96 receive second reading. Moved by Councillor
Loewen that By-law 1170-96 be amended in Item #3 to read: "social well-being of the County".

Administration presented By-law 1171-96, being a By-law to rescind By-laws which are no longer
required. Moved by Councillor Daniels that By-law 1171-96 receive first reading. Carried.
Moved by Councillor Stobbs that By-law 1171-96 receive second reading. Carried.
Moved by Councillor Berg that By-law 1171-96 receive consent of Council for third and final
reading. Carried Unanimously.

Moved by Councillor Stobbs that By-law 1172-96, being a By-law for penalty for breach of 8y- `
laws, receive first reading. Carried.
Moved by Councillor Loewen that By-law 1172-96 receive second reading. Carried.
Moved by Councillor Stobbs that this By-law be postponed until the February 22, 1996 meeting.

By-law 1173-96, being a By-law for the operation of snowmobiles, was presented to Council.

Administration presented By-law 1167-95, being a By-law to amend Land Use By-law 1004-90
to add 'Machining Shop' as a discretionary use under the Agriculture District. She also advised
that a definition should be included. Moved by Councillor Fabian that By-law 1167-95 receive
second reading. Moved by Councillor Daniels that By-law 1167-95 be amended to include the
definition: "Machining Shop means the use of a building for the machining, repair, or fabrication
of metal components. and assemblies which may include some minor welding, but does not involve
any outside storage of related materials, supplies, or products." Vote on the amendment -
Carried. Vote on the amended motion -Carried.
Moved by Councillor Loewen that By-law 1167-95 receive third reading. Carried.

Administration presented By-law 1174.96, being a Bylaw to rescind an obsolete Bylaw and
amendments thereto, regarding establishing and collecting water rates for the Hamlet of Scandia.

and rescinding By-law 1086.93, and advised that, due to regionalization and the Municipal
Government Act, this By-law needs to be up-dated. Moved by Councillor Stobbs that By-law
1175.96 receive first reading. Carried.

Councillor Harbinson gave this report and advised that the Town of Brooks wants an agreement
where the Town and the County share the operating costs of the airport on a 50150 basis.
Moved by Councillor Harbinson that we do not enter into an agreement and that we continue to
pay $3,800.00 towards the operation, with an annual review. Moved by Councillor Berg that
we table this motion. Carried.

Foothills Little Bow Association
Councillor Daniels gave this report and advised that the next meeting has been scheduled for
~. September 23, 1996. He also advised that the fees have gone up 50% to S 150.00.

13. Post Agenda Items
1. Employee & Supervisors Meeting -January 15, 1996
The Administrator presented a copy of the minutes from the Employee & Supervisors Meeting
held January 15, 1996. Council will review these minutes and this item will be brought back
at a future meeting.
Moved by Councillor Daniels that we meet with the employees on February 15, 1996,
commencing at 10:00 a.m., and that we advise the seasonal employees that they may come to
this meeting if they wish but will receive no payment. After this meeting with the employees,
(~ Council will meet with the Supervisors, which should be later in the afternoon. Carried.
Administration is to make arrangements for lunch.
2. Phil Martin - Reguest for Funding for University of Alberta Local Gov't. Certificate Course
Letter from Phil Martin requesting funding for a Course for the Local Government Certificate
Program, was presented to Council. Moved by Councillor Scheuerman that we approve the
funding for this Course. Carried.
3. Scandia Water System
Administration advised that a request to Alberta Transportation & Utilities for additional funding
for the Scandia Water Treatment Plan up-grading has been refused. Moved by Councillor Stobbs
that we pay the Contractor's invoices. Carried.

4. Public Meeting
All Supervisors are to be advised of the public meetings to be held in Rolling Hills, Rainier and
Gem.
5. Chamber of Commerce • Fossil Trail
A letter from the Chamber of Commerce regarding the Great Canadian Fossil Trail, February 7
& 8, 1996, was presented for information.

Moved by Councillor Stobbs that we move into camera. Carried.
Moved by Councillor Stobbs that we move out of camera. Carried.
Moved by Councillor Loewen that we appoint Stephen Wylie as our Agricultural Fieldman,
beginning March 1, 1996. Carried.

Committee for Administrative and Supervisory salaries for 1996 & 1997. Carried.
Movetl by Councillor~Harbinson that we give a bonus of 51,000.00 to Bob McTavish, who has
been our Acting Agricultural Fieldman in the absence of the Fieldman, and relay to him our
appreciation for having taken over as Acting Fieldman during this term. Carried.

A Public Hearing of the County of Newell No. 4 was held in the County Office at Brooks, Alberta
on Thursday, January 25, 1996 commencing at 1:30 p.m.

The Reeve opened the Public Hearing at 1:30 p.m.
The Public Hearing dealt with By-law 1167-95, being an amendment to Land Use By-law 1004.90

to add 'Machining Shop' as a discretionary use under the Agricultural District with a definition for
the machining shop included, which states: "Machining Shop means the use of a building for the
machining, repair, or fabrication of metal components and assemblies which may include some minor
welding, but does not involve any outside storage of related materials, supplies, or products." This
information was presented by the Administrator.
Rolland & Hazel Blom & Alan Bone were in attendance at the hearing. Rolland & Hazel Blom
presented Council with information for the requested change.
Council was given the opportunity to ask questions of the applicant.
Moved by Councillor Baxter that the Public Hearing adjourn at 1:38 p.m. Carried.
