Minutes of Council Meeting
October 25, 1990
The regular Council Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, Alberta on Thursday,
October 25, 1990 commencing at 10:00 a.m.

Minutes of the October 11, 1990 meeting were presented to Council.
Moved by Councillor Wallace that we adopt these minutes as circulated.
Carried.
Minutes of the October 18, 1990 Organizational Meeting were presented
to Council. Moved by Councillor Bulger that we adopt these minutes
as circulated. Carried.

5-1 Patricia Water System - Report
Councillor Conners gave an up-dated report on the Patricia Water
System. Moved by Councillor Conners that we proceed with the
slow-sand filter system, obtaining estimates, final costs and
grants available. Carried.
7-4 Speed Limits - By-law 976-89
The Assistant Administrator gave an up-date on the Speed Limit
By-law.
7-4 Development Permit ~~916
The Assistant Administrator advised that the Committee that was
set up to review this Permit should do so as soon as possible.
4-2 Scandia Dog Problem
This item remained tabled.
4-6 Rainier Water System
Councillor Nelson reported on this item.
7-2 Rolling Hills AQ. Society - Water Agreement
The Assistant Administrator reported on the changes requested.
Moved by Councillor Nelson that we proceed with the drafting
of an Agreement and specify that this Agreement will be subject
to a yearly review on rates and water supply. Carried.

4, Delegations
1. Clarence Olivier - Moved-in Trailer - SW 33-19-14-4
Clarence Olivier met with Council to discuss moving a trailer
onto his acreage, SW 33-19-14-4. The Development Control Officer,
Don Grosfield, was also in attendance.
This item will be dealt with at the next M.P.C. Meeting to be
held on October 30, 1990.
5. Treasurer's Report
The Treasurer's Reports to July 31st and September 30th were
presented to Council. Moved by Councillor Wallace that we accept
these reports. Carried.
6. Correspondence
1. Alberta Water Resources Commission
Policy re: Management of Wetlands
Letter from the Alberta Water Resources Commission regarding
Management of Wetlands was read to Council for information.
2. Alberta Public Safety Services - Rescue Kit
Letter from Alberta Public Safety Services regarding rescue kits
was read to Council. The Assistant Administrator advised that
we do not qualify under Sections 3 (B, C & D).
3. Agriculture Canada - Tax Deferral 1990
Letter regarding tax deferral on income from drought induced
~ sales of breeding livestock was read to Council for information.

2. Roy Dennis re: Joe Buck
Roy Dennis met with Council to discuss the problem of the unsightly
premises on the Joe Buck property.
7. Public Hearing
Moved by Councillor Bulger that we recess at 11:30 a.m. for the
Public Hearing. Carried.
Moved by Councillor Scheuerman that we return to the Council
Meeting at 11:34 a.m. Carried.
8. By-law 1014-90
Moved by Councillor Douglass that By-law 1014-90 receive second
reading. Carried.
Moved by Councillor Wells that By-law 1014-90 receive third and
final reading. Carried.

3. Town of Bassano - Ambulance District
Mr. R. Broad, Mr. G. Schaffer and Mr. D. Ursalan, from the Town
of Bassano, met with Council to discuss the Bassano Ambulance
District.

Council recessed for lunch from 12:10 - 1:00 p.m.

Moved by Councillor Conners that we excuse Councillor Wallace
from the remainder of the rneeting. Carried.
Town of Bassano - Ambulance District (Cont'd.)
After discussion, it was moved by Councillor Bulger that we support
the Town of Bassano in establishing an Ambulance District which
coincides with the Bassano Hospital District. Moved by Councillor
Henderson that we table this item until the next meeting. Carried.
Correspondence (Cont'd.)
4. Canada Post - Scandia P.O.
Letter from Canada Post advising of the proposed changes in retail
hours of the Scandia P.O. was read to Council for information.
5. Southeastern Alberta Health Unit - Water Reports
Water reports from the various Hamlets were presented for information.
6. County Board of Education - Corporate Pooling of Assessments
Letter from the County of Newell Board of Education regarding
Corporate Pooling of Assessments was read to Council. Moved
by Councillor Conners that we write a letter to the Minister
of Education, the Honorable Jim Dinning, with a copy to our M.L.A.,
~ the Board of Education and Sandra Weidner, advising that we support
~/~ ~~ the position of the County of Newell Board of Education. Carried.

7. Minister of Municipal Affairs
Minister's Report on Local Development Initiatives
A copy of this report was given to Council.
8. Shell Canada - TransCanada Property
Letter from Shell Canada advising that they intend to ensure
that the land and buildings are kept in presentable condition
until they are sold was read to Council for information.
9. Municipal Statutes Review Committee - Report
This report was given to Council for study.
10. Alberta Forestry, Lands & Wildlife - C.P.R. Right-of-way
Letter from Alberta Forestry, Lands & Wildlife advising that
adjacent landowners have an opportunity to purchase the abandoned
railway right-of-way, which has now become public land, was read
to Council. Moved by Councillor Wells that we proceed with the
application to purchase all of the property from Alberta Forestry,
Lands & Wildlife, which amounts to 27.96 acres. Carried.
9. Other Business
1. ~-law 1018-90 to Rescind By-law 847-84 - Irrigation Sprinklers
Moved by Councillor Douglass that By-law 1018-90, being a By-law
to rescind By-law 847-84, receive first reading. Carried.
Moved by Councillor Wells that By-law 1018-90 receive second
reading. Carried.

Moved by Councillor Conners that By-law 1018-90 receive consent
of Council for third and final reading. Carried Unanimously.
Moved by Councillor Nelson that By-law 1018-90 receive third
and final reading. Carried.
2. By-law 1019-90 - ALARIE
Moved by Councillor Fabian that By-law X019-50, being a By-law
to authorize entering into an Agreement with the Alberta Local
Authorities Reciprocal Insurance Exchange (ALARIE) and providing
the Power of Attorney to ALARIE Attorney In Fact Ltd., being
the attorney in fact for the Exchange, receive first reading.
Carried.
Moved by Councillor Douglass that By-law 1019-90 receive second
reading. Carried.
Moved by Councillor Bulger that By-law 1019-90 receive consent
of Council for third and final reading. Carried Unanimously.
Moved by Councillor Wells that By-law 1019-9U receive third and
final reading. Carried.
3. PanCanadian - Wellsite on Road Allowance
Sections 24 & 25 LSD 4 & 13-16-15-4
Discussion took place on the above-noted wellsite. Moved by
Councillor Conners that we table this item for more information.
Carried.
/ 4. Esso - Waiver of Set-back Regulations
Request from Esso for waiver of our set-back regulations for
~~ their compressor site expansion on LSD 1 Section 3-18-13-4 was
presented to Council. Moved by Councillor Fabian that we approve
this expansion. Vote on the motion - Lost.
5. Annual Awards Night Committee
Moved by Councillor Conners that we approve the recommendation
of the Board of Education for the individuals of Council to sit
on the Annual Awards Night Committee, these members being:
Councillors Wallace & Nelson. Carried.
6. Change Dates of December A.S.B. & Municipal Meetings
Ploved by Councillor Conners that we change the December A.S.B.
meeting to November 30, 1990 commencing at 2:00 p.m. Carried.
Moved by Councillor Bulger that we change the date of the December
Municipal meeting to December 10, 1990 commencing at 10:00 a.m.
Carried.
7. Joel Akin - Permission to Look for Rocks in County Gravel Pits
Moved by Councillor Wells that we approve the request from Joel
Akin to look for rocks in our County gravel pies providing there
is no liability to the County. Carried.

A Public Hearing of the proposed Land Use Change and By-law
1014-90 was held in the County Office on October 25, 1990
commencing at 11:30 a.m.
